If sensitive files were exposed, sent to the wrong person, stolen, or deleted without permission, first stop any continuing access or spread, then preserve evidence and establish what happened. Do not assume that deletion means nobody copied the files. The right response depends on the incident, the data involved, and the laws that apply.
Start by identifying the kind of incident
“Exposed,” “deleted,” and “ransomware” describe different problems. A file may have been publicly accessible, viewed through a compromised account, copied before deletion, or made unavailable by malicious encryption. Those differences affect what to contain, what evidence to preserve, and how to recover.

| What may have happened | Key question | Response priority |
|---|---|---|
| Files were posted publicly or shared with the wrong person | Can others still access the files, and are copies or cached versions available? | Restrict access or remove the material while preserving evidence of how it was exposed. |
| An account or system may have been compromised | Does the unauthorized party still have access, and which credentials or systems are affected? | Coordinate access revocation and containment with the incident-response lead. |
| Files were deleted, altered, or encrypted | Is there a clean recovery copy, and could the attacker also have accessed or copied data? | Preserve evidence, contain the affected systems, and verify backups before restoring. |
These situations can overlap. CISA’s archived 2012 guidance on malicious erasure notes that responders may have difficulty distinguishing access, theft, and changes to system files. Treat deletion as evidence of a change—not proof that information stayed private.
Do these 3 things before closing this tab:

1. Assign responsibility and contain ongoing harm
Activate the incident-response plan. Depending on the organization, assign technical/security, privacy or legal, operations, communications, and management responsibilities. Secure affected physical areas and digital access points. If ransomware or an active compromise is suspected, coordinate containment with the response lead: CISA’s #StopRansomware Guide advises isolating affected systems, but the right action depends on the system and threat.

The FTC advises taking affected equipment offline while cautioning against turning machines off before forensic experts arrive. Coordinate isolation and shutdown decisions with qualified responders where possible; an action that limits attacker access may also affect evidence or system operations.
2. Preserve evidence and record a timeline
Log when the incident was discovered, what is known, which systems and people are involved, the data categories at issue, actions taken, and what remains uncertain. Preserve relevant logs, communications, system images, and volatile evidence where feasible. Avoid wiping or rebuilding systems before evidence is captured unless immediate containment requires it. The FTC’s Data Breach Response: A Guide for Business warns organizations not to destroy forensic evidence during investigation and remediation. Engage qualified forensic support and law enforcement as appropriate.
3. Stop further disclosure or unauthorized access
If personal information was published on an organization’s website, remove it promptly. Then ask search engines to remove cached versions and contact other sites holding copies. If a file was sent to the wrong recipient, request secure deletion, return, or retrieval when appropriate. Revoke unauthorized access, change compromised credentials, review vendor access, and verify that the vulnerability or access path was actually fixed.

4. Establish scope before making claims
Determine what data was involved, whose data it was, how many people may be affected, who accessed it, whether copies were made or misused, and whether any systems remain vulnerable. Review available logs, preserved data, service-provider access, and backups. State uncertainty plainly; do not tell people that information was not copied unless evidence supports that conclusion.
5. Recover only after containment
For ransomware or malicious deletion, prioritize essential services and restore from clean backups after the incident team has contained the threat. CISA recommends offline, encrypted backups as part of recovery planning. Do not reconnect potentially compromised systems until responders determine they are safe. NIST’s February 2024 SP 1800-29, Data Confidentiality: Detect, Respond to, and Recover from Data Breaches, provides organizational guidance for detecting, responding to, and recovering from data breaches.
6. Decide what to communicate and to whom
Consult privacy or legal counsel and the relevant regulator’s current guidance. Notify affected organizations and people when required or appropriate. A useful notice explains what happened, what data was involved, what the organization has done, what recipients can do, and how to get updates. Avoid technical details that could create additional risk or impair an investigation. Match protective advice to the data actually involved.

What affected individuals can do
Use the organization’s official notice, but verify contact details independently through its known website or account portal. Be alert for phishing that refers to the incident. Take steps relevant to the exposed information:

- Financial account access information: Contact the bank or card issuer using a trusted number, such as one on the card or its official website.
- A Social Security number exposed in the United States: The FTC advises considering a credit freeze or fraud alert, reviewing credit reports, and using IdentityTheft.gov if the information has been misused.
- Other sensitive information: Follow the organization’s notice and ask what specific protective steps apply to the data involved.
Organizations may offer a year of credit monitoring or other identity-protection or restoration assistance, particularly when financial information or Social Security numbers were exposed. The FTC mentions this as optional support; it is not proof that a service prevents identity theft. Credit monitoring also does not replace securing an affected account.

There is no single worldwide deadline. The 72-hour rule cited here is UK guidance for qualifying personal data breaches, not a general deadline for every incident.

United Kingdom
The Information Commissioner’s Office (ICO) says qualifying personal data breaches must be reported without undue delay and within 72 hours of discovery. The ICO also says individuals need not be notified where risk is not high; high-risk incidents require notification without undue delay. Its small-organization guidance is under review following changes made by the Data (Use and Access) Act, so check the current ICO guidance and obtain legal advice before deciding what to report.
United States
The FTC says state breach-notification laws typically govern required notice details, while federal rules apply to particular sectors, including health information. Requirements depend on the state, the data, the organization, and the circumstances. Do not apply the UK 72-hour rule to a US incident as a general deadline.

Other jurisdictions and regulated sectors
Identify where the organization operates, where affected people are located, the organization’s role, the data involved, and any applicable sector rules or contracts. The applicable legal duties cannot be determined from the fact of file exposure or deletion alone.
Prepare for safer recovery before another incident
For organizations, maintain backups that are offline and encrypted, and ensure responders know how to verify and restore them. An encrypted external drive can be one part of an offline-backup plan, but buying one does not contain an active incident or guarantee recovery of files already deleted. CISA’s recovery guidance supports offline, encrypted backups; it does not endorse a particular product or model.
