What to Do After an AI Assistant Exposes Sensitive Data

If an AI assistant exposes sensitive data, restrict further access, alert the provider and responsible team, preserve evidence, and assess harm and notification duties.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

First, stop any exposure you can control, alert the AI provider and the responsible security or privacy team, and preserve evidence. Then establish what information was exposed, who could access it, and what harm may follow. Treat an accidental disclosure as a potential data breach even if there is no sign of a hacker. Reporting duties depend on the people and data involved, the organization’s role, the likely risk, and the applicable law.

Act quickly to contain the exposure

If a conversation, file, shared link, integration, or assistant feature is still making sensitive information available, restrict or disable that route if you have authority. For example, remove public access to a shared item or pause the affected feature while the responsible team investigates. Do not assume that deleting a conversation removes copies held elsewhere or resolves the incident; the assistant’s operator must confirm how its particular system works.

Tell the AI provider through its incident or security channel. If the assistant is used at work, report the incident immediately to your organization’s security team and privacy lead. The Federal Trade Commission (FTC) advises businesses to “Move quickly to secure your systems and fix vulnerabilities that may have caused the breach.” Its guidance recommends securing systems and restricting unnecessary access.

Do not make changes outside your role or attempt to investigate by repeatedly querying the assistant. That could expose more data or alter useful evidence.

Preserve evidence and establish what happened

Keep a factual record, using approved and secure channels. Preserve relevant timestamps, conversation or incident identifiers, prompts where safe and permitted, access and audit logs, recipient details, screenshots that do not spread the sensitive information, and communications with the provider or response team. Avoid deleting records before the response team has assessed what needs to be retained. If you must first remove public access to contain the exposure, record what you changed and when.

Work out, with the people responsible for the system, what information was involved and how it became available. Record what is known separately from what remains uncertain.

  • Which people’s information was involved, and what types of data appeared?
  • Was it visible only to the user, accessible through a shared link, or sent to another person or service?
  • When did the exposure begin and end, and who could access the information during that period?
  • Is there evidence that anyone accessed, downloaded, or misused it, or is that still unknown?
  • Which assistant, account, integration, permissions, or data flow was involved?

Do not describe data as stolen, downloaded, or misused unless the available evidence supports that conclusion. The Information Commissioner’s Office (ICO) defines a personal data breach broadly to include accidental or unlawful disclosure or access, as well as destruction, loss, or alteration. A malicious intrusion is not required for an incident to qualify.

Know what to do based on your role

If you are… Your next steps
An individual using an assistant Stop sharing or using the affected feature if it may continue the exposure; report the incident to the provider. If the data belongs to an employer, client, school, or another organization, notify its security or privacy contact promptly rather than handling the incident alone.
An employee or contractor Use your organization’s incident-reporting route and follow instructions from its security and privacy teams. Do not contact affected people, regulators, or outside recipients on the organization’s behalf unless authorized.
A developer or system administrator Contain the affected access path within your authority, preserve relevant logs and configuration details, and escalate to the incident lead. Avoid broad changes that could destroy evidence or interrupt unrelated systems without coordination.
An organization responsible for the assistant or data Assign an incident lead, secure the system, review access and data flows, verify the affected information and people, assess likely harm, and determine legal and contractual notification duties with the responsible privacy officer or qualified counsel.

For organizations, the FTC’s Data Breach Response: A Guide for Business recommends reviewing access, verifying what information and people were affected, and considering help from forensic experts. NIST Special Publication 1800-29, published February 23, 2024, describes an organizational approach to detecting, responding to, and recovering from data-confidentiality attacks.

Protect people based on the information exposed

Protective steps should match the exposed data, not be a generic list attached to every incident. The organization handling the response should give affected people concise, accurate information about what happened, what information was involved, what is being done, and where to get help.

  • Passwords or account credentials: Change an exposed password and any other account password that reused it. Use the service’s account-security options to protect the affected account, and follow the provider’s instructions if account access may have been compromised.
  • Social Security numbers: FTC guidance points affected people to fraud alerts or credit freezes as possible protective measures.
  • Health information: Contact the organization responsible for the information and follow its advice for the particular incident. Whether a specific health-data rule applies depends on the entity and circumstances.
  • Other personal or financial information: Ask the responsible organization what specific monitoring or account-protection steps fit the data and what signs of misuse to watch for.

Do not send people an unverified claim that their information was misused. Explain what is confirmed, what remains under investigation, and how they can reach a genuine response contact.

Determine whether anyone must be notified

There is no single notification deadline for every AI-related exposure. Requirements can vary with the country or state, the organization’s role, the type of information, the likelihood of harm, and whether data was accessed or acquired. Organizations should promptly assess applicable laws with their privacy officer or qualified counsel and should not wait for every investigative detail if an applicable rule requires earlier notice.

UK personal-data cases

Under the ICO guidance described on its personal-data-breach page, a UK-regulated organization must notify the ICO within 72 hours where feasible when a breach is likely to risk people’s rights and freedoms. If the risk to people is high, they must be informed without undue delay. The ICO says its guidance is under review following the Data (Use and Access) Act coming into force on June 19, 2025, so confirm the current requirements before relying on that guidance.

U.S. business and health-data cases

The FTC’s business guidance tells U.S. organizations to check applicable state and federal requirements; it does not establish one deadline for all incidents. Separately, the FTC’s Health Breach Notification Rule guidance applies to covered vendors of personal health records and related entities. It recognizes that an unauthorized disclosure can trigger the rule even without a cyber intrusion. For covered cases, the FTC’s 2024 guidance states that individual notices are due within 60 calendar days, subject to the rule’s “without unreasonable delay” standard. That period is not a general deadline for other kinds of data or organizations.

Other locations or uncertain coverage

The cited FTC and ICO materials do not provide a complete global legal survey. If people or organizations in other jurisdictions are involved, identify the relevant privacy regulator and local requirements rather than applying a U.S. or UK deadline by default.

Fix the cause and check the recovery

Once the immediate exposure is contained, the organization responsible should identify and fix the cause—not just remove the visible item. Review assistant permissions, integrations, sharing settings, data flows, and relevant access records; test that the fix works; and monitor for recurrence. Where the investigation requires specialist expertise, the FTC identifies forensic support as an option for businesses. Record decisions and retain the information needed to explain the response.
