If a contractor or service provider suffers or enables a security breach, treat it as a possible route into your own systems—not just as the contractor’s problem. Contain further access while preserving evidence, establish what information and systems were exposed, verify remediation, and assess notification duties based on the people, data, jurisdictions, and organizational roles involved. There is no single notification deadline that applies everywhere.
What should you do first?
- Activate your incident-response team. Bring in the people needed to make security, operational, legal, communications, and management decisions. Coordinate containment with that team and record decisions and actions as they happen.
- Limit further access without destroying evidence. Secure affected systems, stop ongoing data loss, and change credentials that may have been stolen. The Federal Trade Commission (FTC) advises taking affected equipment offline, but not turning machines off before forensic experts arrive. Preserve logs and other evidence; its business guide cautions, “Do not destroy evidence.”
- Set an accountable channel with the contractor. Ask for a named incident contact and a clear account of what happened, when it was discovered, what systems and data may be involved, and what containment steps have been taken. Keep communications and requests documented.
How do you determine whether your own systems or information were exposed?
Map the contractor’s access and investigate whether an attacker could have used it to move into your network. The contractor’s incident may expose your organization even if the affected equipment belongs to the provider.

- Identify the systems, accounts, connections, and personal information the contractor could reach.
- Review available logs and preserved data to determine whether that access was used, what information may have been accessed or taken, and how many people could be affected.
- Assess whether the information was encrypted and whether the relevant permissions were limited to what the contractor needed.
- Check your own network for unauthorized activity connected to the contractor’s access, not only for activity on the contractor’s systems.
Restrict or remove access that is no longer necessary. If the risk warrants it, consider suspending the contractor’s access until vulnerabilities are fixed and the information is safe. The FTC’s Cybersecurity for Small Business guidance recommends checking that a provider’s claimed fixes work rather than relying on assurances.

Ask the contractor to explain the cause, affected systems and information, containment, and corrective actions. Verify the fixes and reassess what access the provider still needs. If your team cannot establish the source, scope, or safety of the environment, the FTC identifies independent forensic investigators and experienced cybersecurity staff as options.

When evaluating incident-response or forensic help, compare relevant expertise rather than choosing on a generic label: experience with the affected systems and data, ability to preserve evidence while containing access, and ability to coordinate with your response team and counsel. Privacy or data-security counsel can help assess legal duties. These services are not a substitute for checking the contractor’s access and your own network.
Which notification rules might apply?
Work out early who is legally responsible, whose information was affected, what type of information was involved, and where those people are located. Review the vendor agreement and its incident-notice terms, and consult counsel as needed. The FTC notes that federal and state laws may apply in the United States; notification language and timing depend on the applicable rules. The distinctions below are not interchangeable:

| Situation | What the cited guidance says | What to establish |
|---|---|---|
| UK GDPR: contractor acting as a processor | The processor must inform the controller without undue delay after becoming aware of a personal data breach. The processor-controller contract should specify breach-reporting requirements. | Confirm the parties’ roles and the contract’s reporting channel and terms. The controller assesses whether regulator notification is required. |
| UK GDPR: controller reporting to the ICO | A controller must report a notifiable breach to the Information Commissioner’s Office (ICO) without undue delay and within 72 hours after becoming aware. If information is incomplete, the ICO allows a phased submission without undue further delay. | Assess whether the breach is notifiable, document the decision, and keep a record of all personal data breaches, including those not reported. |
| United States: state and other generally applicable requirements | There is no single nationwide deadline in the FTC’s general business guidance. All states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands have breach-notification legislation; federal or sector-specific rules may also apply. | Identify affected states and applicable sector rules, then determine what notices are required and what they must say. |
| United States: certain services covered by the FTC Health Breach Notification Rule | Coverage can include personal health record vendors, related entities, and third-party service providers. A covered third-party service provider must notify its designated client contact—or a senior official if none is designated—identify affected people, and obtain acknowledgment. FTC guidance describes an outer limit of 60 calendar days and requires action without unreasonable delay. | Check whether the service and organization are covered. The rule’s coverage is not the same as HIPAA coverage, and downstream duties differ for covered entities. |
The FTC’s Health Breach Notification Rule guidance reflects the July 2024 amendments. For a breach affecting people in EEA countries, assess EU GDPR obligations and whether a lead supervisory authority must be identified; UK guidance alone does not resolve those duties.

How should you communicate with affected people?
When notice is required—or when communicating is otherwise appropriate—explain what is known, what information was involved, what your organization has done, what protective steps people can take, and how they can reach a reliable contact. Be clear about uncertainty without making unsupported claims. Avoid misleading statements and do not disclose technical details that could create further risk. Coordinate timing with law enforcement where relevant.

If Social Security numbers were exposed, the FTC points people toward fraud alerts or credit freezes. When financial information or Social Security numbers were involved, the FTC also recommends considering at least a year of free credit monitoring or other identity support. This is a recommendation, not a universal legal requirement or a guarantee against identity theft.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should you record and change after the incident?
Keep an incident record covering what happened, the investigation, containment, the contractor’s corrective actions, and your notification decisions. For UK GDPR purposes, the ICO says to document all personal data breaches and whether the decision was to report them.

Use what the incident revealed to tighten supplier arrangements: set security and data-handling expectations, limit access to what is needed, specify incident-reporting channels and timescales, name communication contacts, and define how remediation will be verified. ICO guidance on third-party arrangements describes written provisions for processor breach responsibilities, reporting timescales, and contacts; the ICO says that page is under review following the Data (Use and Access) Act.
