What to Check Before Publishing an AI-Generated Game

Before publishing an AI-generated game, distinguish shipped assets from live generation and internal AI tools, then check rights, storefront disclosures, ratings, marketing, and territory-specific rules.

Before publishing an AI-generated game, inventory everything players will see, hear, read, or create; verify rights to the content; complete the disclosures required by each storefront and rating route; and check that the store page, promotions, and territorial compliance match the finished product. The checks differ depending on whether AI helped make fixed assets, generates content during play, or was used only as an internal development aid.

1. What AI use will players encounter?

Start with a content inventory, not a blanket label such as “AI-generated.” Separate fixed content that ships in the game from content generated while it runs, and from tools used only behind the scenes. That distinction affects what a platform asks you to disclose.

Shipped, player-consumed content

List AI-assisted artwork, music, sound effects, dialogue, narrative, localization, and other material a player encounters. Include content in menus, cutscenes, optional areas, and other parts of the release—not just the main gameplay loop. Record where each item appears and whether it was generated, materially edited, or assembled with AI assistance.

Content generated during play

Document features that generate text, images, audio, or other material in response to player input or game state. Note what the system can produce, whether output is public or private, and what controls or moderation operate before content reaches players.

Internal development tools

Record AI used only to improve internal efficiency separately from content that ships. Steam’s current Content Survey focuses on AI-generated content shipped with the game and consumed by players; Steamworks says, “Efficiency gains through the use of these tools is not the focus of this section.” That describes the scope of this survey section, not a general exemption from other platform, contract, or legal requirements.

2. Can you publish and promote every asset?

For each item in the inventory, establish its source and the terms that govern its use. A platform disclosure does not establish that you own the rights or have permission to publish the material.

  • Identify the tool or service used and review the applicable license and terms, including any limits on commercial use or redistribution.
  • Check whether a third party’s protected material, likeness, voice, or other rights may be implicated by the source material or output.
  • Keep records of relevant prompts or source inputs, generated files, licenses, edits, and the final version used in the game.
  • Confirm that you can make any rights or compliance promises required by the storefront, publisher, or other distribution partner.

The U.S. Copyright Office’s AI study includes a Part 2 on copyrightability of generative AI outputs. It does not support a blanket conclusion that every AI output is—or is not—copyrightable. The answer can depend on the output, human contribution, applicable licenses, jurisdiction, and other facts; send uncertain or high-risk cases for qualified legal review.

3. What does each storefront require you to disclose?

Check the current submission requirements for every storefront and align the answers with both the actual build and the store page. For Steam, complete the Content Survey before submitting the store page and product build for review. The survey helps Steam review the product and informs customers about its content.

For Steam: fixed content and live generation

  • Disclose pre-generated AI content that ships with the game and is consumed by players.
  • If the game generates content while running, describe the implementation and the guardrails intended to prevent illegal content.
  • Do not treat internal efficiency use as equivalent to shipped, player-consumed content in this survey section.
  • Check that survey answers accurately describe the product and are consistent with the store page and build. Completing the survey does not guarantee approval; Steam’s other content rules still apply.

After the build and store page are approved, Steam says some survey answers cannot be edited without contacting Steam Support. If the game connects to a live AI service with ongoing input or output costs, plan how access and payment will work; Steam identifies options including pricing those costs into the game, microtransactions, a subscription, or DLC.

For other storefronts

Do not assume Steam’s categories or disclosure process apply elsewhere. Check each platform’s current rules and submission form, and record which version of the disclosure you provided. The relevant comparison is storefront by storefront, not one universal “AI disclosure” that covers every release.

4. Which rating process applies to your release?

Identify the distribution route and target market before preparing rating materials. ESRB describes different processes for physical retail games and digital games; ESRB is not automatically the right route for every territory or digital storefront.

Physical retail games using the ESRB process

ESRB’s process includes a publisher questionnaire and a gameplay video showing typical gameplay, missions, cutscenes, and the most extreme content. The inventory should also account for pertinent locked content and the context in which material appears. ESRB says physical-game content videos are reviewed by at least three trained raters. Its process page also says sanctions and fines of up to $1 million may apply to publishers who fail to fully disclose content.

Digital games using IARC

Digital games use the International Age Rating Coalition (IARC) questionnaire process where it is available. Answer for the content players can encounter, including relevant context, reward systems, player control, and edge or locked material. Check the requirements of the specific storefront and market rather than assuming that a physical-retail submission or another region’s process covers the digital release.

5. Does the store page accurately represent the game?

Compare the shipped product with every public-facing description of it: screenshots, trailers, demos, store copy, and rating claims. Make sure examples of AI-generated content are representative of what players can actually encounter and that no statement implies a capability or safeguard the product does not have.

For qualifying advertising of ESRB-rated physical games in the United States and Canada, the Advertising Review Council (ARC) says ads should accurately reflect the product and its rating. Internet trailers may show game content when they reflect the game’s true nature and do not exceed pertinent content in the game. Apply those claims only to the qualifying advertising and distribution context they describe.

6. Are there territorial transparency rules to assess?

For distribution in the European Union, assess whether the game’s actual AI use and publication fall within the transparency duties in Article 50 of the EU AI Act. The European Commission states that those obligations apply from August 2, 2026. The described concerns include machine-readable marking and detection, and disclosure for specified deepfakes and some AI-generated public-interest text.

This is not a requirement to put a visible label on every AI-assisted game asset. Applicability depends on the actual system, content, and publication context. The Commission’s voluntary code of practice supports compliance but does not replace the legal obligations. Obtain jurisdiction-specific advice where the scope is unclear.

7. How should you keep the release review current?

Maintain one review record that connects each AI-assisted or generated item to its final use, rights basis, human edits, and relevant platform or rating disclosure. This makes it easier to check that the final build, forms, and marketing materials describe the same product.

  1. Update the inventory whenever content, generation features, or service integrations change.
  2. Recheck storefront forms and territorial guidance immediately before submission; policies and implementation guidance can change.
  3. Compare the final build and store page with the submitted survey and rating materials.
  4. If an approved Steam survey answer needs changing, contact Steam Support where required, since Steam says some answers cannot be edited after approval through the normal process.
