What to Ask Before a Data Centre Is Approved Near Your Community

Before a data centre is approved nearby, ask who decides, what the project will use, who pays for upgrades and how written commitments will be enforced.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before a data centre is approved, ask for project-specific figures, studies and written conditions—not broad assurances about jobs, water use or electricity. Find out which local and state bodies make each decision, who pays for utility and infrastructure upgrades, how impacts will be measured, and what remedy applies if the operator breaks a commitment. Approval rules vary by jurisdiction, and a data centre’s effects depend on its size, design, location and operating plans.

First, establish what is being decided and who has authority

There is no single approval path for every data centre. Pennsylvania’s Department of Community and Economic Development has published a local-government toolkit covering evaluation from initial inquiry through zoning, permitting and long-term planning. Michigan’s guidance describes a division of responsibilities: state agencies regulate several environmental and utility matters, while local governments have authority over land use and community impact. These are jurisdiction-specific examples, not nationwide rules.

Questions to ask about the application and process

  • What application is before the town, county or state, and what decision is being requested now?
  • Which board or agency decides zoning, site plans and building permits? Who handles air, water, wastewater and utility service?
  • What are the next hearing dates and public-comment deadlines? Where can residents inspect the application, technical studies and draft conditions?
  • Are there related applications, additional parcels or later phases that could expand the site or increase its utility demand?
  • Which decisions are still open to change, and which approvals have already been granted?

Ask for the project’s full proposed footprint and phasing, not only the first building or current application. A useful starting point is the relevant local zoning code, permit notices, utility filings and meeting records. The officials handling the proposal can identify which documents govern in that jurisdiction.

How will the project affect electricity supply and household costs?

A facility may require substantial electricity, but the amount and grid effects are project-specific. Request the utility’s assumptions and supporting analysis rather than relying on a general estimate from a developer.

  • What are the expected average and peak electrical loads, in megawatts, for each phase? What is the expected timeline for reaching each load?
  • Which substations, transmission lines, generation or local distribution upgrades are needed? What will each upgrade cost, and who is responsible for paying?
  • How will the utility allocate those costs, and what prevents costs attributable to the project from being shifted to other customers?
  • How could the load affect reliability during periods of grid stress? Is there a demand-response plan, and under what circumstances would the facility reduce consumption?
  • Will the site have on-site generation? If so, what fuel will it use, what emissions permits are required, and when and how often may it operate?

Pennsylvania’s Governor’s Office announcement of August 18, 2026, described a state-specific policy requiring developers to bear new generation and grid-infrastructure costs and report energy use. That announcement is not a guarantee about cost allocation elsewhere; residents should ask which rules and utility agreements apply to their own proposal.

How much water will it use, and how will cooling and wastewater work?

“Data centre” does not describe one standard design. Michigan’s guidance notes that facilities vary in size, purpose, cooling technology, water use and electricity demand, and that applicable requirements depend on project size, design and location. Ask for operating figures under ordinary and high-demand conditions, plus the assumptions behind them.

  • How much water will the facility withdraw or purchase on an average day and a maximum-use day? What source or water system will supply it?
  • What cooling system is proposed, and how does its water demand change during hot weather, drought or other peak conditions?
  • What wastewater will be discharged, where will it go, and which permit and treatment requirements apply?
  • What plans cover stormwater, wetlands, streams and drinking-water supplies? Have water and sewer utilities modelled the effects on existing customers and infrastructure?
  • Who will pay for any needed utility studies or improvements, and will the results be available to the public?

Michigan identifies water withdrawals, wetlands, streams, stormwater, wastewater and drinking-water systems among possible areas of environmental review. Which permits apply to a specific facility depends on its design and site.

How loud will it be, and what other impacts reach nearby homes?

Request a noise analysis that identifies equipment, locations and operating conditions—not just a statement that the project will comply with applicable limits. The same specificity matters for generators, traffic, lighting and stormwater.

  • What construction and permanent service traffic, lighting, visual screening, runoff and waste-heat effects are expected?
  • Could equipment be moved or enclosed, or could setbacks, landscaping or other site-design changes reduce effects on homes and public spaces?

Michigan lists air emissions as a possible permitting topic. St. Louis’s April 21, 2026 approval for one project put noise-emitting equipment away from primary frontages and within acoustically treated structures, set generator-testing windows and required heat reporting. Those conditions illustrate possible project-specific measures; they are not general legal requirements.

What does the community get in return—and what will it cost?

Ask officials and the developer to distinguish temporary construction work from permanent operating jobs, and projected public revenue from the costs or incentives associated with serving the facility.

  • Is there a written community-benefit agreement? Does it name beneficiaries, measurable milestones, a reporting schedule and consequences for missed commitments?
  • Are local hiring, training or other benefits enforceable terms, or voluntary forecasts?

St. Louis’s announcement for the single project approved in April 2026 described a $30-per-square-foot community contribution estimated at $15 million, along with minimum employment levels of 25 jobs in year one, 50 in year two and 100 thereafter. Those figures are negotiated project terms, not a standard residents should expect elsewhere. The city also published project-specific provisions concerning projected tax revenue and community pathways.

What evidence will be public, and who enforces the promises?

A promise is easier to evaluate when its baseline, measurement method, reporting schedule and consequences are written down. Ask for the documents before a decision is made and identify who has authority to verify compliance afterward.

  • Will the full application, impact studies, utility assumptions, permit conditions and any community-benefit agreement be public before decisions are made?
  • What baseline measurements will be taken before construction, and which outcomes—such as water use, noise, energy use or jobs—will be reported during operations?
  • Who will inspect or independently verify the reports, how often, and where will results be published?
  • What penalties, operating limits, permit remedies or other consequences apply if the operator misses a commitment? Who can initiate enforcement?
  • Can a permit or occupancy approval be suspended or revoked if a violation is not corrected?

Pennsylvania’s August 2026 announcement described public-engagement and reporting expectations, stated that nondisclosure agreements for data-centre projects are not permissible under its announced process, and referred to permit conditions and penalties. St. Louis said its occupancy permit for the cited project could be revoked if conditions were unmet and issues were not corrected. These are examples tied to particular jurisdictions and processes; confirm the rules that actually govern the proposal under review.

A comparison worksheet for competing designs or sites

If officials or the developer present multiple site plans, phases or cooling options, request the same measures for each version. Otherwise, a headline comparison may conceal differences in demand, public cost or nearby impacts.

Use reported figures carefully

The Pennsylvania Governor’s Office reported on August 18, 2026, that publicly sourced databases listed more than 100 data-centre projects in the state. It said 58 projects had engaged with the Department of Environmental Protection at some level of formality, 15 had applied for at least one DEP permit, and five had received all permits needed for their first phase. These are Pennsylvania pipeline figures reported by that office on that date; they are not national totals, and they do not establish the status of a different proposal.
