Ask the Korean vendor to document how it classified the exact goods, software and technology in your transaction; who will receive and use them, and where; and what Korean export authorization, if any, covers that transaction. Do not rely on “not controlled” or “no license needed” without the supporting basis. Classification and licensing depend on the product’s specifications and technology, destination, parties, end use, route and current rules—not simply on the vendor’s country or product category.
1. What exactly are you supplying?
Start with the full scope of what the vendor will provide, not just the product name on a quote. Ask for the model and revision, relevant performance specifications, and a list of associated software and technology. Include services that could transfer technical information or access, such as installation, training, maintenance, support and remote access.

Ask the vendor to identify which parts of the scope it considers goods, software or technology, and which Korean control-list entries it reviewed. A product sale, software delivery and technical support may raise different classification questions. A general assurance about a product family does not show that the exact configuration and services in your transaction were assessed.
2. How did you classify the goods, software and technology?
Request the Korean strategic-item classification and the reasoning behind it: the control-list category considered, the relevant specifications, and how those specifications compare with the entry. Ask whether the result is the vendor’s self-classification or an expert classification by the Korea Strategic Trade Institute (KOSTI).
#1 Best Overall
KOSTI describes expert classification as specialist review for cases where a company or individual has difficulty determining an item’s status. Its guidance says this process normally takes 15 days from receipt and that a classification is valid for two years; these are process details, not a guaranteed turnaround or a substitute for checking that the decision applies to your item and transaction. If the vendor cannot resolve an uncertain classification, ask whether it will seek specialist review through YESTRADE.
Ask for a redacted decision or written explanation if one is available. You need enough detail to verify that the classification covers the model, revision, configuration and technology being supplied, while respecting confidentiality and limits on sharing sensitive technical information.
3. Could a catch-all control apply even if the item is not listed?
Ask whether Korean authorities have notified the vendor about the transaction, or whether the vendor knows facts indicating a weapons-related diversion risk. Ask who evaluates those facts and whether shipment is held while a potential licensing issue is resolved.

Korean law provides for catch-all licensing in specified proliferation or diversion-risk circumstances involving goods that are not on the control list. That means “not listed” is not, by itself, a complete answer to whether authorization is required. The vendor should be able to explain how it reached its conclusion for the known end use and circumstances.
4. Who is the buyer, consignee and actual end user—and where will the item go?
Get the destination country, named buyer, ultimate consignee, actual end user and installation or use site. Identify intermediaries and any intended onward sale, transfer or re-export. If the buyer is not the end user, ask the vendor to explain the chain and what evidence supports the stated end use.
Ask how the vendor screens relevant parties and checks end-use statements. Korean licensing review considers destination, civilian use, the buyer, consignee and end user, the credibility of the proposed end use, potential re-export and whether parties raise concerns. A buyer’s name alone may not establish who will ultimately use the item or for what purpose.

5. What authorization covers this specific transaction?
If a license is required, request its type, issuing authority, number or status, validity period, and the scope and conditions that matter to your shipment. Confirm that it covers the product and quantity, buyer and end user, destination, end use and route in your contract. Ask whether the authorization contains conditions the buyer or downstream recipient must follow.
If the vendor says no license is needed, ask for the classification basis and the legal or administrative basis for that conclusion. Also ask whether the transaction’s route or structure raises separate transit, transshipment or brokerage permission questions. Korean law provides for related authorization types, so an export-license answer alone may not settle every permission relevant to a particular route.
6. Does the September 1, 2026 amendment affect this item?
Ask the vendor specifically whether the Korean strategic-item list amendment effective September 1, 2026 changes the classification or licensing analysis for the product, software or technology. The Ministry of Trade, Industry and Resources (MOTIR) said the amendment incorporated approximately 80 updates agreed by the Wassenaar Arrangement, Australia Group, Nuclear Suppliers Group and Missile Technology Control Regime. It identified high-performance integrated circuits for AI and semiconductor manufacturing equipment among newly designated advanced dual-use items.

MOTIR stated: “Starting September 1, 2026, exporters of these newly designated strategic items must obtain an export license from MOTIR.” Ask for the specific entry and technical comparison if the vendor says the amendment applies—or a documented explanation if it says it does not. The National Law Information Center’s notice page has surfaced a version dated February 28, 2025; confirm the current full notice and annexes before relying on detailed list entries.
7. What changes would trigger a pause and a fresh review?
Agree in writing that the vendor will pause shipment and reassess if material facts change. Relevant changes can include the model or performance, destination, buyer or end user, end use, intermediary, route or ownership of the transaction.

Set out who is responsible for obtaining an updated classification or authorization, who must notify the other party, and what records each side will retain. This makes a previously sound assessment less likely to be carried forward after the transaction it described has changed.

8. Could another country’s rules apply?
Ask whether the supply includes U.S.-origin content, software or technology, or otherwise raises another jurisdiction’s re-export or export-control rules. Request a separate, documented assessment identifying the relevant content and transaction facts. A Korean vendor’s conclusion under Korean rules does not itself decide whether another jurisdiction’s rules apply.
KOSTI identifies assistance with determining U.S. re-export applicability as part of its consulting scope. That availability does not establish that any particular product is subject to U.S. controls; the vendor must assess the actual item and facts.
9. What evidence can the vendor share?
Ask for evidence proportionate to the risk and your role in the transaction. Useful records may include a redacted classification decision, license or exemption documentation, end-user statement, party-screening procedure and a named escalation contact. Agree how confidential records will be shared and handled, and do not request sensitive technical detail beyond what is needed and permitted.

- Classification: Is there a technical basis tied to the actual configuration and technology, rather than only a broad product description?
- End user and end use: Does the vendor identify the ultimate recipient and use, and explain how it checked the information?
- Authorization: Does the license or documented no-license conclusion fit the transaction’s parties, destination, scope and route?
- Diversion and re-export: Has the vendor considered onward transfers and any relevant catch-all concerns?
- Change management and records: Is there a defined reassessment and notification process if transaction facts change?
- Other jurisdictions: Is any separate assessment of foreign-origin content or rules documented?
10. Who can resolve an open classification or compliance issue?
If the vendor cannot explain a material point, ask whether it has consulted KOSTI or qualified Korean export-control counsel, and whether it can provide a written conclusion applicable to this transaction. KOSTI says it offers consulting on classification, regulatory implementation, export licensing, end-use and end-user checks, U.S. re-export applicability, and compliance-program development.
Before relying on any outside conclusion, confirm that it describes the actual product, transaction parties, end use and destination, and ask who will update it if those facts change. No general vendor statement can establish the status of an unspecified product or settle every foreign jurisdiction’s requirements.
