A Council recommendation does not, by itself, make a new rate legally operative: the relevant legal instrument and its effective date determine what applies to a particular supply.
What does the GST Council do?
Article 279A of the Constitution establishes the Goods and Services Tax Council as a joint Union–State forum. It recommends GST policy, including which goods and services may be taxed or exempted and the rates that may apply. Its remit also covers model GST laws, principles for levying GST and determining place of supply, turnover thresholds, floor rates with bands, special rates during natural calamities or disasters, special provisions for certain States, and other GST matters it chooses to consider. The GST Council’s official overview describes its constitutional role and remit.

Who is on the Council?
- The Union Finance Minister chairs the Council.
- The Union Minister of State in charge of Revenue or Finance is a member.
- Each State Government nominates its minister in charge of finance or taxation, or another minister, to represent it.
How are Council decisions made?
The Council generally seeks consensus in its meetings. Consensus is its usual approach, not a voting formula. If a proposal is put to a vote, Article 279A assigns one-third of the weighted votes to the Centre and two-thirds collectively to the States. It passes only if at least three-fourths of the weighted votes of members present and voting support it. The Council’s official page sets out both its consensus-based approach and the constitutional voting rule.
Does a recommendation immediately change a GST rate?
No. A Council recommendation is not, on its own, an amendment to primary legislation or the final legal text setting a rate. In Union of India v. Mohit Minerals, decided on 19 May 2022, the Supreme Court explained that Article 279A recommendations are recommendatory in the constitutional scheme. The judgment also distinguished statutory situations in which a recommendation can bind government action when it exercises delegated authority to make secondary legislation. The legal effect therefore depends on the applicable constitutional and statutory route; it is inaccurate to say recommendations are always binding or never binding. Read the Supreme Court judgment.

How does a recommended rate change become operative?
- The Council discusses and recommends a change. A meeting announcement explains the policy decision, but is not necessarily the operative rate text.
- The authority responsible for the relevant tax issues or amends the applicable legal instrument. The route depends on the tax and supply concerned.
- Read that instrument for the effective date and scope. Classification details and exceptions can affect whether the change applies to a particular transaction.
The GST Council’s notification archive labels Central Tax (Rate) notifications as measures to implement Council recommendations. For a specific supply, consult the actual current notification that applies; the archive landing page and meeting release are not substitutes for that legal text.
What did the 56th GST Council meeting recommend?
The 56th meeting recommended a broad rate-change package for goods and services. The Council proposed 22 September 2025 as the implementation date for services and goods generally. It set a different condition for pan masala, gutkha, cigarettes, chewing tobacco such as zarda, unmanufactured tobacco and bidi: these were to remain at their existing GST and applicable compensation-cess rates until the compensation-cess loan and interest obligations were discharged. The actual transition date for those products was to be decided separately by the Union Finance Minister and Council chair. The dated proposal and exception are described in the August 2025 GST Council newsletter and the official release of 3 September 2025.
Examples in the announced package
The official release described reductions from 18% or 12% to 5% for a range of household goods, from 28% to 18% for air conditioners and certain other goods, and from 12% to 5% for specified hotel accommodation. These are examples from that package, not a complete rate schedule. A broad announcement does not establish the present treatment of every product, service or transaction.
How to check the rate for a particular purchase or service
- Identify the precise good or service and its relevant classification; similar-sounding products can fall under different entries or conditions.
- Find the current notification applicable to that supply, rather than relying only on a Council meeting summary.
- Check the notification’s effective date and any exceptions or conditions.
- Confirm which tax component applies: CGST and SGST, or IGST, as relevant to the transaction.
The 56th-meeting package establishes what the Council recommended and its stated implementation framework; it does not by itself resolve the classification or current tax treatment of every individual supply.
