Eligible work can include new or expanded fabrication plants, assembly and testing, advanced packaging, semiconductor materials, manufacturing equipment, wafer production and related research and development. The programs are substantial but not automatic: projects must satisfy statutory, program and tax rules, and the commonly cited dollar totals describe federal authority rather than a guaranteed payment to every applicant.
What the CHIPS Act factory program can pay for
Section 4652 of Title 15 of the U.S. Code directs the Department of Commerce to provide financial assistance for U.S. facilities and equipment used in semiconductor fabrication, assembly, testing, advanced packaging, production, semiconductor materials, semiconductor-manufacturing equipment and related research and development. That wording reaches beyond a conventional front-end fab.

A qualifying project may therefore be a new facility, an expansion of an existing site or a modernization project, provided it meets the program’s eligibility, national-security, economic and other conditions. The statute identifies activities and assets that can receive support; it does not promise that every project containing one of those activities will receive an award.

Eligible activity categories
- Semiconductor fabrication: facilities that manufacture semiconductor devices on wafers.
- Assembly and testing: back-end operations that turn manufactured dies into tested components.
- Advanced packaging: packaging processes that combine or interconnect chips in sophisticated packages.
- Semiconductor production and materials: production steps and inputs needed for semiconductor manufacturing.
- Manufacturing equipment: equipment used to make semiconductors, including equipment produced for that purpose.
- Related research and development: R&D tied to the covered manufacturing and technology objectives.
The practical implication is that a company does not need to operate a complete transistor-fabrication line to be relevant. A materials producer, equipment manufacturer, testing provider or advanced-packaging operator can fall within the statutory universe, subject to the specific program rules and the facts of its project.

How the three federal incentives fit together
Commerce’s CHIPS Program Office administers the manufacturing incentive. The separate CHIPS Research and Development Office handles the R&D side. Treasury and the Internal Revenue Service administer the Section 48D tax credit. A project may evaluate more than one channel, but each channel has its own application, documentation, timing and compliance requirements.
| Support | What it is | Potentially covered work | How the benefit arrives | Important qualification |
|---|---|---|---|---|
| Commerce direct funding | An award from the CHIPS Program Office | U.S. semiconductor facilities, equipment, fabrication, assembly, testing, advanced packaging, materials, equipment production and related R&D that meet program conditions | Project funding under an executed award; exact draw and performance terms are project-specific | Application and award conditions, including continuing compliance obligations, govern the amount and timing |
| Commerce loans or loan guarantees | Debt financing or federal support for debt | Eligible semiconductor manufacturing and related projects under the Commerce program | Borrowed capital that must be repaid; a guarantee supports financing rather than functioning as a grant | The statute and transaction documents control interest, repayment, security and other terms; no universal terms are stated |
| Section 48D credit | A federal investment tax credit administered by Treasury and the IRS | Qualified investment in an advanced manufacturing facility whose primary purpose is manufacturing semiconductors or semiconductor-manufacturing equipment | A tax benefit tied to qualified property placed in service | The applicable percentage depends on the placed-in-service date and current tax rules |
The incentives are designed to work together rather than represent three versions of the same payment. Direct funding and loans address project financing through Commerce. Section 48D reduces federal tax liability for qualifying investment. A company must analyze the interaction of awards, debt, tax basis and other restrictions with its advisers; the existence of one incentive does not by itself establish eligibility for another.
What the headline dollar amounts mean
Commerce’s Office of Inspector General describes the overall CHIPS package as $50 billion in program funding for semiconductor research, development, innovation and manufacturing. The same 2025 status reporting describes authority for up to $75 billion in direct loans and loan guarantees.

Those figures are different kinds of numbers. The $50 billion is program funding. The $75 billion is lending and guarantee authority. Neither figure means that every applicant receives cash, that all authority has been committed, or that a single project can claim a pro-rata share. Awards depend on eligibility, selection, negotiated terms, appropriations and available authority.

Commerce grants: when direct funding is the right tool
A Commerce grant is a direct federal award to an eligible project. It can help close the financing gap for construction, equipment or other covered investments, but the award is tied to the approved project and its obligations. The CHIPS Program Office evaluates applications and sets terms through the award process.
What a grant can accomplish
- Support construction of a new U.S. semiconductor facility.
- Help expand or modernize an existing facility when the project satisfies program requirements.
- Finance equipment and manufacturing capabilities for fabrication, assembly, testing, packaging, materials or semiconductor-equipment production.
- Support covered activities that connect manufacturing investment with related R&D.
What an applicant should be ready to document
The exact submission package varies by program notice and project, so there is no single universal checklist in the statute. In practical terms, an applicant should be prepared to identify the U.S. site, describe the manufacturing or R&D activity, separate eligible costs from unrelated spending, explain the project schedule and financing plan, and show how it will meet continuing award conditions. Private investment and matching expectations are part of the comparison applicants must make, but no single percentage applies to every award.
Commerce loans and loan guarantees: debt, not a second grant
The CHIPS framework also provides for Commerce loans and loan guarantees. A loan supplies borrowed capital that the recipient must repay. A guarantee can support a lender’s willingness to finance a project, but it does not erase the underlying debt. The authority is described as up to $75 billion, not as $75 billion of free project funding.
Debt can be useful when a project has substantial predictable cash flows and the owner wants to preserve grant capacity or combine federal support with private financing. It also creates repayment, interest, collateral and covenant obligations. Those terms are negotiated or set in transaction documents; they should not be inferred from the headline authorization.

Section 48D: the advanced manufacturing investment tax credit
Section 48D applies to qualified investment in an advanced manufacturing facility whose primary purpose is manufacturing semiconductors or semiconductor-manufacturing equipment. Unlike a Commerce award, the benefit is a tax credit calculated under tax rules for qualified property placed in service.
Credit rate by placed-in-service date
| Qualified property placed in service | Credit rate stated in current IRS guidance | Practical reading |
|---|---|---|
| December 31, 2022 through December 31, 2025 | 25% | The 25% rate applies to qualifying property placed in service on or before December 31, 2025, subject to the statute and IRS rules. |
| After December 31, 2025 | 35% | The 2025 WFTC Act increased the stated rate for qualifying property placed in service after December 31, 2025, subject to current eligibility and tax rules. |
The date is attached to the property, not merely to the date a company announces a project or signs a construction contract. A facility can contain property placed in service in different periods, so the applicable rate must be determined asset by asset under the tax rules. Companies should preserve the records needed to establish qualified investment, primary purpose and placed-in-service dates.
How the credit complements Commerce support
Treasury has described the credit, when paired with CHIPS direct funding and loans, as part of a comprehensive federal incentive package for semiconductor manufacturing capacity. In financial modeling, the credit is a tax benefit; a grant is an award; and a loan is repayable capital. Their timing and accounting effects differ, and a project should model all three rather than add their headline percentages or dollar authorities together.
Wafer production is broader than front-end transistor fabrication
Final IRS regulations define semiconductor wafer production to include several upstream and finishing operations. The definition covers:

- Growing single-crystal ingots and boules.
- Slicing wafers.
- Etching and polishing.
- Bonding and cleaning.
- Epitaxial deposition.
- Metrology.
This breadth matters for companies whose facilities perform material preparation, wafer finishing, deposition or measurement rather than complete front-end transistor fabrication. Inclusion in the definition does not remove the need to satisfy the other requirements for the particular credit or Commerce program, but it prevents an overly narrow assumption that only a traditional fab can qualify.

CHIPS Program Office
The CHIPS Program Office within Commerce administers the manufacturing incentive, including the direct-funding and financing processes for covered U.S. facilities and equipment.
CHIPS Research and Development Office
The Research and Development Office handles the R&D side of the CHIPS effort. R&D awards are therefore not simply another label for a factory grant; they belong to a separate administrative track with its own objectives and award process.
Treasury and the IRS
Treasury and the IRS administer Section 48D. Taxpayers must apply the Internal Revenue Code, regulations and current IRS guidance to determine whether a facility, property and investment qualify and which rate applies.

Implementation status: use dated figures, not stale totals
The latest status figures supplied here are a historical snapshot from Commerce’s Office of Inspector General. As of January 31, 2025, the CHIPS Program Office had made 20 awards for up to $33.7 billion in direct funding and up to $5.5 billion in loans. The R&D Office had awarded almost $8.3 billion by that reporting point.
These amounts describe commitments reported at that date. They are not October 2026 totals, and they should not be used to claim that the program has since awarded a particular amount without a newer official status report. “Up to” also signals that the maximum amount authorized or stated in the awards may not equal cash already disbursed.
The foreign-country-of-concern restriction and 10-year recapture risk
Final Treasury and IRS regulations include a special 10-year recapture rule tied to a significant transaction that materially expands semiconductor manufacturing capacity in a foreign country of concern. In practical terms, a taxpayer that receives the benefit can face a long post-award exposure if it later enters a transaction that meets those conditions.
Recapture is not an automatic consequence of every overseas activity. The rule turns on the transaction’s significance, the expansion of manufacturing capacity and the applicable definition of a foreign country of concern. Because the analysis is highly fact-specific, a company should review the current regulations before signing a transaction, expanding a foreign site or changing ownership and investment plans. The 10-year period means compliance planning must continue well beyond construction and the initial tax filing.
How to decide which support to pursue
- Map the physical project. List each site, building, production line, tool, material operation, packaging step, testing operation and R&D activity. Identify which work occurs in the United States.
- Classify the financing need. Separate costs that need an upfront award from investments that could be financed with debt and property that may generate a tax credit when placed in service.
- Test the primary purpose. For a Section 48D claim, confirm that the advanced manufacturing facility’s primary purpose is manufacturing semiconductors or semiconductor-manufacturing equipment.
- Build an asset-level schedule. Track qualified property, expected placed-in-service dates and the records supporting each cost. This is essential when some property falls before and some after the December 31, 2025 rate change.
- Prepare a compliance plan. Assign responsibility for Commerce award conditions, loan covenants, tax documentation and the 10-year foreign-country-of-concern restriction.
- Check current notices and rules. Commerce application requirements and Treasury/IRS interpretations can change. Use the current program notice, regulations and guidance for the filing and transaction at hand.
Common mistakes to avoid
- Treating authorization as cash: $50 billion of program funding and up to $75 billion of loan or guarantee authority are portfolio-level figures, not an entitlement for an individual project.
- Calling a loan a grant: debt must be repaid, and a guarantee supports financing rather than replacing repayment obligations.
- Using the wrong tax-credit date: the Section 48D percentage follows when qualifying property is placed in service.
- Assuming only a traditional fab qualifies: the statutory categories and wafer-production definition include materials, equipment, assembly, testing, packaging and several wafer-processing steps.
- Ignoring post-award conduct: a transaction that materially expands semiconductor capacity in a foreign country of concern can create recapture exposure during the 10-year period.
- Presenting old status numbers as current: the January 31, 2025 award figures are historical and should be labeled with that date.
Bottom line for a semiconductor project
The CHIPS Act pays for capacity, not a blank check. A U.S. project may combine a Commerce direct award, Commerce debt financing and the Section 48D credit when its activities, assets and documentation satisfy the separate rules. The opportunity extends from fabs to assembly, testing, advanced packaging, wafer processing, materials, equipment and related R&D. The largest planning issues are choosing the right form of support, documenting each asset and placed-in-service date, and preserving compliance for years after the award or credit is claimed.
