There is no single U.S. tax incentive that automatically pays for an ordinary data-center building. The main opportunities are state and local sales/use tax exemptions, property-tax abatements, and project-specific credits or development incentives. What qualifies—and whether a program is open—depends on the location, purchases, investment, jobs, application timing, and continuing obligations. Federal incentives may apply to qualifying energy assets, but that does not make the data-center building or its IT equipment eligible.
Where data-center incentives are available
Most incentives are state or local programs, not a nationwide construction credit. The National Conference of State Legislatures reported that at least 38 states offered data-center incentives in its April 17, 2026 snapshot, including sales/use tax exemptions and property-tax abatements. The Council of State Governments reported 40 states and the District of Columbia as of July 2026, using a broader category that includes incentives applicable to data-center operations. These figures describe different dates and scopes; they are not interchangeable counts of identical programs.

For a project, the practical question is not simply whether a state “has incentives.” A benefit may depend on the county or zone, local approval, the facility’s investment and jobs, the type and timing of purchases, and the applicant’s compliance with program rules.
What kinds of tax incentives can reduce project costs?
Sales and use tax relief on specified purchases
Some states exempt or refund sales/use tax on defined data-center purchases. Covered items may include servers or other computer equipment; some programs also reach installation, power infrastructure, or particular construction-related purchases. The program’s definitions control: an item being used at a data center does not by itself make it eligible. Local sales/use taxes may also remain due even when a state exemption applies.

Property-tax abatements
A locality may reduce property taxes on qualifying project property for a limited period or under a negotiated economic-development arrangement. These benefits commonly depend on project size and local action. The relevant offer may apply to only specified property or years, and its terms can include performance requirements or consequences if commitments are missed.
Credits and other development incentives
Some programs offer credits tied to construction wages or another defined activity, alongside or instead of tax exemptions. Their availability may depend on project location, qualifying costs, application status, and statutory conditions. A credit advertised in an older project announcement is not proof that a new applicant can still claim it.
How selected state programs illustrate the differences
The examples below show why thresholds and eligible purchases should not be treated as national standards. They are program-specific descriptions, not a complete state-by-state inventory or a determination that a particular project qualifies.

| Jurisdiction and source | Potential benefit | Key conditions or status described |
|---|---|---|
| Texas Comptroller of Public Accounts | Temporary state sales/use tax exemption for certain items the program defines as necessary and essential to operating a qualifying data center. | The Comptroller’s example eligibility path calls for at least $200 million in capital investment over five years and 20 qualifying jobs in the county, plus certification and other conditions. Local sales/use taxes remain due. These thresholds are Texas-specific. |
| Washington Department of Revenue | Exemptions described for eligible server equipment and installation, qualifying power infrastructure, and specified related services. | Rules include location and employment conditions, advance application, and certificate limits in some programs. The described program also requires green-building certification for newly constructed facilities. A refurbishment provision was identified as repealed July 1, 2026. |
| Illinois Department of Commerce and Economic Opportunity | The state described tax exemptions and a credit equal to 20% of construction-worker wages for qualifying projects in underserved areas. | The agency states it stopped processing applications on July 1, 2026. The described credit should not be treated as available to a new applicant after that date without confirmation of a current program. |
| Alabama Department of Revenue | Chapter 9B allows local-authority abatements for qualifying projects, including data-processing centers. | Eligibility is subject to investment amounts, duration limits, and local action. The agency says amendments apply to specified abatements granted on or after January 1, 2027. |
| Iowa Department of Revenue | A data-center sales/use tax incentive described in the department’s bulletin. | The bulletin describes minimum investment, registration, and annual-reporting requirements; annual reporting began in January 2026. Check the current statute and program requirements for a project. |
Does the federal government offer a construction tax credit?
The available federal material does not establish a general tax credit for an ordinary data-center building. A July 23, 2025 White House fact sheet said an executive order directed the Secretary of Commerce to launch an initiative offering financial support—including loans, grants, and tax incentives—for defined qualifying projects. Its description included certain data centers requiring more than 100 MW of new load and related infrastructure projects selected by designated officials. That policy announcement is not, by itself, proof that every data-center project can claim a particular tax incentive.
A separate federal route may be relevant when a project includes a qualifying electricity-generation or energy-storage asset. The clean-electricity investment credit in 26 U.S.C. § 48E applies to facilities and storage technology meeting statutory definitions. Assess the generation or storage asset under those requirements; do not assume the data-center building, servers, or ordinary IT equipment qualify. Check the current law against the project’s dates and facts.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Who may apply, and what purchases may qualify?
The applicant, facility, and purchase rules are set by each program. Some incentives require certification before purchases; others may require registration, a minimum investment, specified jobs or wages, a qualifying location, or local approval. A tenant, owner, developer, or equipment purchaser should not assume it can claim a benefit merely because another party at the site qualifies.

Review the program’s eligible-property definitions and ask whether the specific cost is included: building shell, construction materials, servers, installation, electrical or power infrastructure, or separate generation and storage. For example, Texas limits relief to certain items it defines as necessary and essential and leaves local sales/use tax due; Washington expressly describes eligible equipment, installation, and power infrastructure under its own conditions. Those state examples do not establish eligibility elsewhere.

How to compare incentives before choosing a site
- Identify the taxing jurisdiction. Determine the state, county, city, and any special district that will tax the property or purchases; identify which agency administers each proposed benefit.
- Map each benefit to its tax base. Separate sales/use tax relief, property-tax abatements, income or wage credits, and incentives for energy assets. List the exact project costs each program covers.
- Check entry requirements. Confirm investment minimums, job or wage commitments, geographic restrictions, ownership or tenant rules, building standards, and local approval requirements.
- Confirm timing and current status. Ask whether applications are being accepted, whether approval must precede construction or purchases, and whether the program has a sunset, repeal, quota, or pending rule change.
- Price the obligations as well as the benefit. Review reporting, job-retention, certification, and other ongoing requirements, along with recapture provisions or penalties for failing to meet commitments.
- Model realized savings against project costs. Compare the eligible tax base and purchase schedule with local taxes that remain payable, utility and infrastructure costs, and compliance costs. A stated exemption or abatement is not the same as net project savings.
Because local agreements, statutes, and application status can change, verify the current rules with the responsible agency and qualified tax or legal advisers before including an incentive in a project pro forma. A reliable estimate requires the proposed site, design, investment, jobs, purchase schedule, and ownership structure.
