What Super PACs Can and Cannot Do in U.S. Elections

Super PACs can raise unlimited contributions from eligible sources for independent political activity, but federal rules bar candidate contributions and coordinated spending.

Under federal rules, a Super PAC can raise unlimited money from many kinds of donors and spend without an amount limit on qualifying independent expenditures. It cannot use that money to contribute directly to federal candidates, and its spending must remain independent of candidates, their campaigns and party committees. “Unlimited” describes the amount a Super PAC may raise for independent activity—not permission to accept every source or to fund candidates.

What a Super PAC is—and what makes it different

The Federal Election Commission (FEC) describes a Super PAC as a political committee that makes only independent expenditures. Its defining feature is not simply that it can raise large sums. It is the pairing of broad fundraising permission with a boundary: the committee’s spending must be independent of the candidates and party committees it seeks to influence.

As an Amazon Associate I earn from qualifying purchases.

That structure permits a Super PAC to pay for political communications supporting or opposing a clearly identified federal candidate, provided the communication meets the legal definition of an independent expenditure and is not coordinated with the candidate, campaign or party committee. A Super PAC’s independent expenditures are not subject to an amount limit, although reporting requirements may apply.

Not every political communication automatically qualifies as an independent expenditure. The FEC definition centers on a communication that expressly advocates the election or defeat of a clearly identified candidate and is not coordinated with the candidate or party. Its content and the circumstances around its creation and distribution matter; the committee’s label or intention alone does not settle the question.

What can a Super PAC do?

Raise unlimited contributions for independent activity

Under the FEC’s guidance, Super PACs may solicit and accept unlimited contributions from individuals, corporations, labor organizations and other political committees for independent political activity. This is the answer to what a Super PAC can do that a traditional PAC generally cannot: it may accept contributions without the contribution limits that apply to ordinary PAC accounts, but only within the Super PAC model of independent spending.

The permission concerns contributions to a Super PAC for its independent activity. It does not make all sources eligible, eliminate disclosure duties or turn the committee into a vehicle for giving unlimited sums to candidates. “Unlimited” is about the amount eligible sources may give to this kind of committee; source restrictions and the independent-spending boundary still apply.

Spend without an amount limit on qualifying independent expenditures

An independent expenditure is a communication that expressly advocates the election or defeat of a clearly identified candidate and is not made in consultation or cooperation with, or at the request or suggestion of, a candidate, authorized committee, agent or political party committee. The FEC summarizes the definition as a communication that expressly advocates a candidate’s election or defeat and is not made in coordination with the candidate, campaign or political party.

If a communication qualifies as independent, there is no amount limit on what the Super PAC may spend on it under the federal framework described by the FEC. That does not mean the expenditure is exempt from reporting, or that every political expense automatically qualifies. Whether a particular communication meets the definition depends on its content and the facts surrounding its creation and distribution.

What can’t a Super PAC do?

Contribute its funds to federal candidates or committees

A Super PAC cannot use its funds to make direct contributions to federal candidates or committees. The FEC’s Super PAC registration guidance describes the committee as one that will not use its funds to make direct, in-kind or coordinated-communication contributions to federal candidates or committees. The unlimited fundraising permission belongs to the independent-expenditure model; it is not a way to bypass candidate-contribution rules.

That restriction also helps explain why a Super PAC and a traditional PAC are not interchangeable. A traditional PAC can make candidate contributions subject to applicable rules and limits; a Super PAC’s defining activity is independent spending, not candidate contributions. The FEC materials described here do not establish current dollar caps for traditional PAC contributions, so this article does not give a figure.

Spend in coordination with a candidate, campaign or party committee

A Super PAC’s expenditure must be independent. A communication that meets the applicable coordination test may be treated as an in-kind contribution rather than an independent expenditure. If the payer is a corporation or labor organization, coordination can result in a prohibited contribution.

Coordination is not determined by a single shortcut such as whether campaign staff talked to the committee, or whether they discussed the exact advertisement. The FEC framework evaluates three elements: who paid for the communication, what it says or concerns, and the conduct or interaction between the payer and the candidate, campaign or party committee. The test is fact-specific; a conversation alone does not settle the legal question, and the absence of a conversation about an ad does not by itself establish independence.

In other words, “we did not discuss this particular ad” is not a complete compliance analysis. The applicable rules look at the communication as well as relevant interactions. A committee assessing a real communication needs to apply the regulation to its actual facts rather than rely on a slogan or a single detail.

Who can donate to a Super PAC?

The FEC says Super PACs may accept unlimited contributions from individuals, corporations, labor organizations and other political committees, subject to source prohibitions. Among the sources identified as barred from contributing to Super PACs are:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Foreign nationals
  • Federal contractors
  • National banks
  • Federally chartered corporations

So “unlimited” refers to the amount permitted from eligible sources for the Super PAC’s independent activity. It does not mean every person or organization may contribute, or that every corporation or union may fund every kind of political committee. The relevant permission applies to Super PACs and to the non-contribution accounts of Hybrid PACs; source restrictions still matter.

Super PAC vs. traditional PAC vs. Hybrid PAC

The names can be confusing because a Hybrid PAC has both an independent-spending account and an account that may make candidate contributions. The key is to ask which account is receiving or spending the money.

Committee or account May make federal candidate contributions? Contribution limits and sources Must spending be independent?
Super PAC No. The FEC registration guidance says it does not use its funds for direct, in-kind or coordinated-communication contributions to federal candidates or committees. May accept unlimited contributions for independent activity from eligible individuals, corporations, labor organizations and other political committees. Prohibited sources still apply. Yes. Its defining expenditures must qualify as independent expenditures.
Traditional PAC Yes, subject to applicable federal rules. Contribution limits and specific source rules apply. Current dollar caps are not stated in the FEC materials summarized here. Not stated as a defining requirement in the cited materials summarized here; the Super PAC rule is the independent-expenditure-only model.
Hybrid PAC: non-contribution account No candidate contributions from this account; it is for independent expenditures and certain other independent activity. May accept unlimited funds, subject to applicable source prohibitions. Yes, for the independent activity this account is used to finance.
Hybrid PAC: separate contribution account Yes, it may make contributions to federal candidates. Subject to contribution limits and source prohibitions; specific dollar caps are not stated in the cited materials summarized here. No; this account is distinct from the non-contribution account and may make candidate contributions under its applicable rules.

The FEC’s Hybrid PAC description is important because it prevents a common misunderstanding: an organization with a non-contribution account that accepts unlimited money does not thereby gain permission to transfer that unlimited money into its candidate-contribution account. The accounts have different purposes and different rules.

The practical comparison is therefore not simply “which committee can raise more?” Ask whether the account may contribute to a federal candidate, whether its incoming contributions are limited, which source restrictions apply, and whether its spending has to remain independent. A Super PAC’s unlimited fundraising and spending authority is tied to that last condition; a Hybrid PAC keeps its independent and candidate-contribution activity in distinct accounts.

How does the FEC decide whether spending is independent?

The coordination framework examines payment, content and conduct together. In practical terms, those questions are:

  1. Who paid? Identify the person or committee financing the communication.
  2. What is the communication about? Consider its content and whether it concerns or expressly advocates the election or defeat of a clearly identified candidate.
  3. What interaction occurred? Consider conduct involving the payer and the candidate, campaign, agent or party committee, including whether the communication was made in consultation or cooperation with, or at the request or suggestion of, one of them.

If the applicable coordination test is met, the spending can count against contribution limits as an in-kind contribution. A corporation- or labor-funded coordinated communication can also create a prohibited contribution. The consequence is why a Super PAC cannot treat coordination as a minor technicality: crossing that boundary can change the legal character of the spending.

The three parts work together; a “yes” or “no” answer to one isolated question is not a substitute for the applicable test. For example, the fact that a committee paid for a communication does not by itself establish that it was independent. Nor does the absence of an explicit request about the finished ad resolve all questions about its content and the parties’ conduct.

Registration, reporting and donor disclosure

When registration is required

According to FEC registration guidance, a committee becomes a political committee when its contributions or expenditures exceed $1,000 in a calendar year. It must register within 10 days after crossing that threshold. The $1,000 figure is a registration trigger, not a contribution cap or a limit on Super PAC spending.

How independent expenditures are reported

Political committees report independent expenditures on Schedule E. Depending on the circumstances, additional 24-hour and 48-hour reports may be required. The FEC summary does not provide the conditions for every such deadline, so a committee should consult the current reporting instructions and applicable rules rather than assume that one reporting schedule covers every expenditure.

Registration and reporting mean that Super PAC activity is not simply anonymous spending. The committee must meet applicable disclosure obligations, including reports concerning its independent expenditures and contributions. The exact filings and deadlines depend on the activity and timing; the FEC’s current guidance and forms are the place to check the requirements for a particular reporting period.

For a reader asking whether Super PACs disclose donors, the short answer is that they register and report contributions under the applicable federal rules, as well as report independent expenditures. This overview does not set out every reporting threshold, form detail or deadline; those depend on the committee’s activity and timing. The $1,000 registration threshold should not be confused with a donor-disclosure threshold or contribution limit.

Common misconceptions, corrected

  • “A Super PAC can give unlimited money to a candidate.” No. It may raise unlimited contributions for independent activity, but it cannot use its funds to make direct, in-kind or coordinated-communication contributions to federal candidates or committees.
  • “If the committee and campaign never discussed the ad, the spending is independent.” Not necessarily. Coordination analysis considers payment, content and conduct, and must be applied to the facts.
  • “Any donor can give any amount.” No. The amount may be unlimited for eligible sources, but source prohibitions remain, including the FEC-identified restrictions on foreign nationals, federal contractors, national banks and federally chartered corporations.
  • “Independent expenditures do not have to be reported.” No. The FEC says they may be subject to reporting requirements; political committees report them on Schedule E and may face additional 24-hour or 48-hour filings.
  • “A Hybrid PAC’s unlimited account can fund its candidate contributions.” The Hybrid PAC maintains separate accounts: its non-contribution account accepts unlimited funds for independent activity, while its candidate-contribution account is subject to limits and source prohibitions.

What to check before relying on the rules

The FEC presents its pages as guidance and points readers to the underlying statute, regulations, advisory opinions and applicable court decisions. A committee evaluating a specific donor, communication, interaction or filing deadline should check the controlling authorities in force for that situation and seek qualified legal counsel when needed. The federal rules described here do not resolve requirements imposed by states or local jurisdictions.

Frequently Asked Questions

Can a Super PAC give money directly to a federal candidate?

No. The FEC describes Super PACs as committees that do not use their funds for direct, in-kind or coordinated-communication contributions to federal candidates or committees. They may raise unlimited contributions for independent activity, not candidate contributions.

Can Super PACs coordinate with campaigns?

Their spending must remain independent. The FEC evaluates coordination by looking at who paid, the communication’s content and the conduct or interaction involving the payer and the candidate, campaign or party committee. The answer is fact-specific; neither a conversation alone nor the absence of an ad-specific discussion settles it.

Who can donate to a Super PAC, and are there source restrictions?

The FEC says Super PACs may accept unlimited contributions from individuals, corporations, labor organizations and other political committees for independent activity. The FEC identifies foreign nationals, federal contractors, national banks and federally chartered corporations among prohibited sources.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do Super PACs have to disclose their donors?

Super PACs register and file reports concerning contributions and independent expenditures under applicable federal reporting rules. The filings and deadlines depend on the activity and timing; consult current FEC guidance and forms for specific requirements.

When does a Super PAC have to register?

FEC guidance says a committee becomes a political committee when contributions or expenditures exceed $1,000 in a calendar year and must register within 10 days after crossing that threshold. The $1,000 figure is a registration trigger, not a contribution limit.

How is a Hybrid PAC different from a Super PAC?

A Hybrid PAC may keep a non-contribution account that accepts unlimited funds for independent expenditures and certain other independent activity, alongside a separate account subject to contribution limits and source prohibitions that may make contributions to federal candidates.

The Bottom Line

Under federal rules, a Super PAC may raise unlimited contributions from eligible sources and spend without an amount limit on qualifying independent expenditures. It may not use those funds to contribute to federal candidates, and its spending must remain independent. Registration, contribution and expenditure reporting, source restrictions and fact-specific coordination rules still apply.
