What Students Need to Know About Copyright When Using Images, Music, and Fonts in Digital Projects

A practical U.S.-focused workflow for students who want to use images, music or fonts legally in presentations, videos, portfolios and other digital projects.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: You cannot assume an image, song, or font is free to reuse just because you can view or download it. Before putting an asset in a presentation, video, portfolio, or other digital project, identify its creator, read the item-specific rights statement or license, compare the license with your audience and planned edits, and keep a record of what you found. U.S. copyright law provides some exceptions for teaching and fair use, but none is a blanket permission for every student project or public upload.

This guide explains a practical, asset-by-asset process under U.S. law. It is educational information, not a legal determination of a particular dispute. A school policy, license, or law in another country may produce a different result.

Start with the use, not the download button

Copyright analysis begins with what you plan to do, not with where a file was found. A work can be easy to copy and still be protected. Write down the exact asset and the intended distribution before you decide that it is acceptable.

For every photograph, illustration, recording, composition, font file, video clip, or other borrowed material, record:

  • Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
  • 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.

  • the creator, performer, photographer, type designer, or rights holder when available;
  • the page or collection where you found it;
  • the rights statement, license name and version, or permission message;
  • what you will do with it, including cropping, color changes, editing, remixing, or synchronization with video; and
  • who will see the finished project and how it will be shared.

Save a screenshot, downloaded license text, or PDF of the terms as they appeared when you selected the asset. Web pages and license details can change, and your project files should show the basis for your decision.

Classify the audience

“For school” can describe very different situations. A file submitted privately to an instructor, displayed in a nonprofit classroom, posted to a password-protected school platform, placed in a public portfolio, and uploaded to an unrestricted video site do not necessarily have the same legal analysis. A change in audience can change which permission, exception, or license condition matters.

Planned distribution Questions to answer
Private submission Who receives it, and does the assignment require a particular license or source?
In-class presentation Is it part of qualifying face-to-face teaching at a nonprofit educational institution?
School platform Who can log in, how long will it remain available, and does the school impose additional rules?
Portfolio or public post Can anyone access it, and will it promote you, a service, or a monetized channel?

If you cannot describe the audience and access level, pause before publishing. “Educational” is a purpose, not a universal permission.

Can I use this picture for my school project?

Usually, treat a photograph, illustration, scan, or other original visual work as protected unless reliable information establishes a license, permission, or public-domain status that covers your use. The U.S. Copyright Office explains that an original work fixed in a tangible medium is protected when created. Owning a print, a book, or a downloaded copy does not normally give you the copyright in the photograph or illustration.

Check the item-level rights statement

Search the page for terms such as “rights,” “copyright,” “license,” “permissions,” or “reproduction.” A library, museum, or archive may host an item without owning its copyright. The U.S. Copyright Office notes that the Library of Congress generally does not own copyright in collection materials and puts responsibility for an independent rights assessment on users. A hosting institution’s logo or a download button is not a license by itself.

Compare the permission with your project

A license may allow classroom display but prohibit commercial use, require a credit line, or forbid modifications. Cropping a photo, adding text, removing a background, or combining it with another image can count as an adaptation under the license. If the terms do not clearly cover the audience and edits you need, find another asset or ask the rights holder.

Can I use copyrighted music in a school video?

Adding music to moving images raises separate questions about the underlying musical work, the particular recording, and the way the two are combined. A recording you bought or can stream is not automatically licensed for insertion into a video.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check both composition and recording rights

A song can have different owners for the composition and the sound recording. A permission or license for one does not necessarily cover the other. Use music with a clear license that addresses video use, obtain permission from the relevant rights holders, or choose a work whose public-domain or open-license status is verified.

Synchronization can be an adaptation

Creative Commons’ BY-NC-SA 4.0 legal code treats synchronization of a musical work, performance, or sound recording with moving images as producing adapted material. That means the license’s rules about adaptations and ShareAlike can apply when you publish the resulting video. Read the exact license version, not just the words “Creative Commons.”

How much of a song can I use without permission?

There is no universal number of seconds, musical notes, words, or percentage that is automatically safe. The U.S. Copyright Office states that no legal rule sets a specific amount that may always be used without permission. A short excerpt can still be significant if it takes the memorable “heart” of a work, while a longer use might be justified in a particular teaching or commentary context. The answer depends on all the circumstances.

Do not rely on claims such as “under 10 percent is fair use.” Instead, document why the excerpt is needed, how it is used, who will see it, and whether a practical licensed alternative exists. Public posting, promotion, or monetization generally creates a more demanding risk assessment than a limited classroom demonstration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does fair use apply to students?

Students can rely on fair use in appropriate circumstances, but student status does not decide the issue. Section 107 identifies four considerations:

  1. Purpose and character: nonprofit educational, critical, commentary, or transformative purposes may weigh differently from commercial or merely entertainment uses.
  2. Nature of the work: factual works may receive different consideration from highly creative photographs, songs, or films.
  3. Amount and substantiality: examine both the quantity and the qualitative importance of what you copied.
  4. Effect on the potential market or value: consider whether your use substitutes for a licensed use or harms a realistic market.

Courts balance these considerations case by case. The Copyright Office summarizes the rule this way: “Whether a particular use qualifies as fair use depends on all the circumstances.” No single factor, classroom label, or percentage decides every case.

Apply the four considerations honestly

Ask whether your project adds analysis, criticism, teaching, or a new purpose, or whether it simply republishes the work. Explain why the amount copied is necessary rather than convenient. Consider whether the work is highly creative and whether your public version could replace a purchase, stream, or license. Write down your reasoning; a record cannot guarantee fair use, but it prevents decisions based on myths.

What classroom exceptions actually cover

Section 110(1) provides a limited exemption for performance or display by instructors or pupils during face-to-face teaching activities at a nonprofit educational institution, in a classroom or similar instructional place, subject to statutory conditions. Section 110(2) addresses qualifying mediated instructional transmissions under its own requirements. These provisions are narrower than “anything made for class.”

An instructor showing a lawful excerpt during a qualifying lesson is not the same as a student leaving the same material on an unrestricted public page. The audience, access controls, institution, instructional setting, and other statutory conditions matter. Ask your instructor or school whether its platform and assignment fit the applicable policy; do not generalize a classroom exception to public distribution.

Using Creative Commons material correctly

“Creative Commons” names a family of licenses, not one permission. Identify the exact license and version attached to the item and follow every condition.

License element What it means for a student
BY (Attribution) Give the required credit. All current Creative Commons licenses require attribution.
NC (NonCommercial) Commercial use is restricted. A public portfolio, sponsored project, or monetized channel may require closer analysis.
ND (NoDerivatives) Sharing adaptations is restricted. Cropping, remixing, translating, or synchronizing may create an adaptation.
SA (ShareAlike) Adaptations must be offered under the specified ShareAlike license condition when shared.

A useful credit normally identifies the creator, title, source, license name and version, and any changes you made. Put the credit where viewers can find it: a slide, caption, end card, description, or credits page as appropriate. Attribution satisfies a license condition when required; it does not create permission where the license does not cover your use.

Can I use a font I downloaded for my project?

Typeface design and font software are related but distinct issues. U.S. Copyright Office regulation 37 CFR 202.1(e) lists “Typeface as typeface” among material not subject to copyright, and Circular 33 explains that copyright generally does not protect typeface or mere variations of typographic ornamentation or lettering. The same guidance discusses limited situations involving some typeface, typefont, lettering, or calligraphy and separately protectable surface decoration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That distinction does not mean every font file is free. A font file is software distributed under terms that can control installation, embedding in documents or websites, modification, and redistribution. There is no universal font-file permission that covers every provider and use. Read the license supplied with the exact file. A license allowing you to design a poster may not allow you to redistribute the file itself or embed it in a public website.

Font checklist

  • Locate the file’s license or read-me document.
  • Check whether student, personal, commercial, web, app, or broadcast use is distinguished.
  • Look for rules on embedding, converting, modifying, and sharing the font file.
  • Keep the license with your project and provide any required credit.
  • If no license is supplied, choose a font with clear terms or ask the provider before distributing your project.

Public-domain material: useful, but verify it

Public-domain works are not protected by an active copyright restriction, but you still need to verify that the particular item is the work you think it is and that no separate rights or contractual terms apply. The U.S. Copyright Office’s current overview states that works published in the United States before January 1, 1931 are currently in the public domain because their copyright protection expired. That is a dated U.S. cutoff, not a worldwide rule or a shortcut for every edition, translation, photograph, or recording.

Record the item’s publication information and the source’s public-domain statement. A modern scan, restoration, arrangement, or recording may involve separate rights even when an older underlying work is public domain.

A decision workflow for every digital project

  1. Inventory assets. List every image, music recording, composition, font, clip, and template you did not create.
  2. Define distribution. Mark the project as private submission, in-class display, school-only access, portfolio use, or unrestricted public sharing. Note whether it is promotional or monetized.
  3. Find a permission route. Prefer a clear license, verified public-domain status, direct permission, or a statutory exception that fits the facts.
  4. Read the exact terms. Check audience, duration, geography, commercial status, adaptations, synchronization, attribution, and redistribution.
  5. Adjust the project. Replace an unclear asset, reduce an unnecessary excerpt, remove an adaptation, or limit access when that solves the rights problem.
  6. Prepare credit. Include creator, title, source, license and version, and a modification note where required.
  7. Save evidence. Keep the license or permission record, your asset list, and your fair-use reasoning with the project files.
  8. Recheck before publishing. A later public upload, portfolio use, contest entry, or sponsor can change the analysis.

Compare candidate assets before you commit

When two images, tracks, or fonts look similar, compare them on the same axes rather than choosing only by quality or convenience.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Intended use Class submission, in-class display, portfolio, or public online release.

“It was on a search engine, so it is free.”

Search results locate files; they do not grant rights. Trace the image or audio to the original source and read its terms. If you cannot verify them, replace the asset or request permission.

“I gave credit, so I am covered.”

Credit is required by many licenses, but attribution alone does not create permission. Confirm that the license allows your audience, edits, and purpose first.

“It is only for school.”

Educational purpose is one fact among many. A public portfolio or monetized channel is not the same as a closed classroom. Reassess whenever distribution changes.

“The excerpt is short.”

No fixed seconds or percentage is a safe harbor. Explain necessity, consider the work’s qualitative importance, and look for a licensed alternative.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The museum or library owns it.”

The host may not own copyright. Read the item-level restrictions and investigate the creator or rights holder.

“The font has no copyright, so I can share the file.”

Typeface protection and font-software licensing are separate. Follow the exact file license for embedding, modification, and redistribution.

When to ask for help

Ask the rights holder, instructor, school library, or designated copyright office when the license is missing, the project will be public or promotional, the work is central to the project, or you need to distribute an adaptation. For a high-stakes publication, commercial release, or dispute, consult a qualified attorney. Keep the question specific: identify the asset, audience, edits, dates, and proposed platform, and attach the license or rights statement you found.

Bottom line for students

Use an asset only after you can explain why your planned use is permitted. The safest path is a clear license, verified public-domain status, or written permission that covers the actual audience and edits. Fair use and classroom exceptions can matter, but they are fact-specific and do not create a universal student exemption. Document the decision, give the required credit, and revisit it before a private class project becomes a public one.
