1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsAI-assisted policing should operate only under a clear legal basis and strict limits on permitted uses. Before deployment, agencies should test systems in the context where they will be used, assess effects on rights and the consequences of errors, and establish ongoing monitoring, audit, documentation, meaningful human review, and public-facing disclosure. The rules depend on the jurisdiction and application: the EU AI Act contains binding prohibitions and high-risk requirements with staged application dates, while the U.S. Department of Justice’s December 2024 report offers recommendations rather than a universal law for police departments.
Start by defining the decision the system may influence
“AI-assisted policing” covers tools with very different purposes and consequences. A system that helps organize information for an investigator is not the same as one that identifies a person, assesses a risk, or influences whether someone is arrested. A sound safeguard regime begins by specifying the task, the people affected, and the decisions an output can influence—not by treating “AI” as one uniform category.

For each proposed use, an agency should document what the system does, what information it receives, what output it produces, who can see that output, and what action may follow. It should state both permitted and prohibited uses. For example, a tool approved to generate investigative leads should not quietly become a basis for an arrest decision or be repurposed for another task without a fresh legal and rights assessment.

The stakes matter because errors have different consequences. A false lead may waste investigative time; a mistaken identification or risk score can affect liberty, privacy, or access to a fair process. An agency’s safeguards should therefore scale with the severity and likelihood of harm, and should address both false positives and false negatives.

Establish legal authority before procurement or use
Before acquiring or deploying a system, an agency should identify the law that authorizes the particular use and the rules governing the data and decision involved. It should also check applicable constitutional, statutory, administrative, and local requirements. A vendor’s capabilities or a system’s regulatory classification do not themselves create legal authority.
The European Union’s AI Act illustrates the distinction between prohibited practices and applications that may be allowed subject to controls. Under the European Commission’s enforcement summary, last updated 6 October 2026, prohibitions on practices deemed unacceptable apply from 2 August 2026. Among the prohibited practices is individual criminal-offence risk assessment or prediction based solely on profiling. This is not a blanket prohibition on every form of predictive policing; the legal status depends on the precise practice and other applicable law.
The Act also classifies certain law-enforcement applications as high-risk insofar as their use is permitted by relevant EU or Member State law. Examples include certain systems assessing the risk that a person will become a crime victim, evaluating the reliability of evidence in criminal proceedings, and specified profiling in detecting, investigating, or prosecuting crime. High-risk classification does not authorize a use that other law forbids.
The Act separately prohibits AI systems that create or expand facial-recognition databases by untargeted scraping of facial images from the internet or CCTV. For law-enforcement biometric identification, the Act points to the Law Enforcement Directive’s requirement that processing be strictly necessary, protected by appropriate safeguards, and authorized by EU or Member State law. The directive’s principles include lawfulness, fairness and transparency, purpose limitation, accuracy, and storage limitation.
These dates are not interchangeable. The Commission summary states that the general rules for high-risk systems listed in Annex III apply from 2 December 2027, later than the August 2026 start for the cited prohibitions. Agencies operating in the EU should check the operative legal text and any amendments for the specific system and date rather than assume every AI Act obligation started at once.
In the United States, the Department of Justice’s Artificial Intelligence and Criminal Justice, Final Report, dated 3 December 2024, is an official set of recommendations for criminal-justice entities. It is not a universal statute governing every police department. Agencies should determine which federal, state, and local laws and policies bind them, and treat DOJ’s recommendations as guidance unless incorporated into an applicable rule or policy.

Assess the system before it affects real cases
A pre-deployment review should establish whether the system is suitable for the actual task, operating environment, and affected population. General claims about a model or performance in another setting are not enough to show that it works reliably for a particular agency’s data and workflow.
Inspect inputs and data quality
Document where training, reference, and operational data came from, what population and period they represent, and what important information may be missing. Check whether labels or records reflect historical practices that could distort the system’s output. Determine whether data are current and relevant to the intended task, and whether the system is likely to encounter people or conditions unlike those represented in its development or validation data.
Data quality is not only a technical concern. If the input is incomplete, outdated, incorrectly matched, or collected for a different purpose, a polished-looking output can still mislead. The agency should set rules for data access, correction, retention, and permitted reuse, consistent with governing law.
Validate performance in context
Before deployment, document the evaluation method and metrics, the conditions under which testing occurred, and the system’s limitations and known failure modes. Test the system in the intended operational setting, not just on an aggregate benchmark. Where relevant, examine how results vary across affected groups and circumstances, while recognizing that a single summary measure may conceal uneven errors.
There is no general accuracy, bias, or crime-reduction figure established for AI-assisted policing as a whole. Results depend on the tool, data, task, population, and conditions. Agencies should publish or disclose the evidence applicable to their own system rather than imply that one statistic proves the system safe or effective everywhere.

A rights-impact assessment should ask what happens when the output is wrong, who bears that cost, whether the affected person can understand or challenge a consequential use, and whether a less intrusive method could achieve the legitimate purpose. It should consider privacy and civil-rights impacts alongside operational effectiveness. The review should also identify what evidence would justify stopping, restricting, or redesigning the system.

These assessments should not be one-time paperwork. Material changes to the model, data, purpose, user group, or workflow can change risks and performance. They should trigger review before the changed use proceeds.
Keep a trained human responsible for consequential decisions
An AI output should be treated as information for a responsible decision-maker, not as a decision in its own right. The DOJ report recommends that a human review and verify system outputs. For high-impact decisions, it says an AI output should not be the sole basis for the decision, citing cause for arrest and sentence length as examples.
Human review is meaningful only if the reviewer can do more than click approval. As an implementation safeguard, an agency should ensure reviewers have relevant training, access to the information needed to assess the output, enough time to examine it, and authority to reject or escalate it. Reviewers should understand known limitations and should not be pressured to defer to a score or match they cannot independently assess.
Policies should distinguish a lead from evidence and from legal grounds for action. A match, score, or recommendation should prompt appropriate verification using independent evidence; it should not by itself establish that a person committed an offence. The agency should define what verification is required for each use and what happens when the output conflicts with other information.
Make use auditable and decisions contestable
For oversight to be real, the agency must be able to reconstruct how a system influenced a case. Record system versions and settings, dates and users, relevant inputs and outputs, the human reviewer’s assessment, and the role the output played in any consequential decision. Records should be protected and retained under clear rules, rather than kept indefinitely by default.
Documentation should explain the system’s purpose, permitted uses, validation approach, known limitations, monitoring arrangements, and the identity of the unit responsible for it. Where a decision affects a person’s rights or liberty, the record should make it possible for legitimate oversight bodies and, where required by law, the affected person or their representative to understand and challenge the use.

Some operational information may require protection, but confidentiality should be narrowly tailored. It should not erase the records needed for internal audit, independent oversight, legal process, or an effective remedy. Agencies should define who can access sensitive records and under what conditions, and should ensure vendor contracts do not prevent legally required review.

Monitor, audit, and act on problems after deployment
Performance and risk can change when data, practices, or operating conditions change. A deployment plan should specify what will be monitored, how often it will be reviewed, who is responsible, and what findings require corrective action. The DOJ report recommends policies that identify monitoring frequency and system-specific risks, alongside validation metrics and processes.
Monitoring should look beyond whether the system is being used as intended. It should check for error patterns, changing input quality, unexpected reliance by staff, and drift between the tested and real-world settings. Audits should compare documented policy with actual use, including whether outputs influenced decisions in ways the agency did not authorize.
Agencies should set response thresholds before a problem occurs. Depending on the severity, a response could include additional validation, restricted use, retraining or workflow changes, suspension, or termination. Serious incidents and material changes should be recorded and reported through established oversight channels. A system should not remain in service merely because it has already been purchased or integrated.
Tell the public what can be disclosed and invite scrutiny
Where feasible and consistent with law, agencies should provide plain-language information about why a system is used, the kinds of decisions it may inform, relevant data practices, and the safeguards and oversight in place. The DOJ report recommends public and stakeholder engagement where feasible, and disclosures that avoid revealing sensitive operational or law-enforcement information.

Public engagement is more useful before a high-impact system becomes a settled practice. Agencies can invite questions from affected communities and relevant stakeholders, explain the intended purpose and limits, and describe how concerns can be raised. Disclosure should be specific enough to permit meaningful scrutiny without exposing details that would compromise a sensitive operation.
Best Value
Transparency also requires clarity about limits: what the system cannot establish, who is accountable for decisions, and how a person may seek review where law provides for it. A generic statement that an agency uses “AI” does not tell the public whether a tool identifies people, ranks leads, or influences a decision about liberty.
Apply safeguards proportionate to the use
The same controls do not fit every application. The following framework helps an agency identify the questions that need answers before use; it does not replace jurisdiction-specific legal review.
| Application type | Primary safeguard question | Practical control |
|---|---|---|
| Lead generation or information organization | Could an unverified lead be mistaken for evidence or grounds for action? | Label outputs as leads, require independent corroboration, and document how investigators used them. |
| Victim-risk assessment | Could an inaccurate assessment deny support, expose someone to additional risk, or misdirect services? | Validate for the intended population and setting; retain a human decision-maker able to consider context and alternatives. |
| Biometric identification | Is the use legally authorized and strictly necessary, and how will a potential match be verified? | Set purpose and access limits, assess identification errors in context, and require independent verification before consequential action. |
| Evidence reliability assessment | Can the system’s limits and role be examined in the proceeding where the evidence is used? | Keep records sufficient for oversight and any legally required disclosure or challenge; do not treat a model output as self-validating proof. |
| Individual risk assessment or profiling | Is the practice prohibited, otherwise restricted, or permitted only under specified conditions? | Obtain a use-specific legal determination first; in the EU, account for the AI Act’s specific prohibition on individual criminal-offence prediction based solely on profiling. |
The table is a decision aid, not a statement that every application in a row is lawful or unlawful. A system’s exact function, the decision it informs, and the applicable jurisdiction determine the legal result.

A practical governance process can make the safeguards concrete. Before the system is used, an agency should be able to answer each of these questions with documented evidence:
- Authority: What specific legal basis permits this purpose, and what uses are out of bounds?
- Need: What problem is the system intended to address, and why is this approach appropriate compared with a less intrusive alternative?
- Evidence: What data, validation metrics, limitations, and failure modes support use in this setting?
- Rights: Who could be harmed by errors, and what assessment and safeguards address privacy, fairness, and the ability to challenge consequential use?
- Human accountability: Who reviews each output, what verification is required, and who has authority to reject or escalate it?
- Traceability: What records will make it possible to audit the system’s role in an individual case?
- Monitoring: How often will performance and policy compliance be reviewed, and what findings trigger restriction or suspension?
- Public explanation: What can the agency disclose about purpose and data practices, and how can affected communities raise concerns?
Approval should have a defined scope and review conditions. If an agency cannot explain the legal basis, the system’s limits, the human role, and the route for oversight, it is not ready for use in a consequential policing workflow.
