What Rights Do Employees Have on Fixed-Term Contracts? (UK Guide)

A UK-focused guide to fixed-term employee rights, including equal treatment, contract expiry, non-renewal, notice and the four-year permanent-status rule.

Fixed-term employees in the UK are generally entitled to equal treatment with comparable permanent employees, protection against dismissal and redundancy, and information about permanent vacancies. What applies when a contract ends or is not renewed can depend on service length, continuity, the contract terms and any collective agreement. Employment law differs by country, so the UK rules below should not be applied elsewhere without checking local law.

Who counts as a fixed-term employee in the UK?

GOV.UK describes a fixed-term employee as someone employed directly by an organisation under a contract that ends on a particular date or when a specific task, such as a project, is completed. The definition is about the employment relationship, not simply whether someone is described as “temporary.” GOV.UK: Fixed-term employment contracts.

An agency worker usually has a contract with the agency rather than the organisation where they work, so they are not covered by this fixed-term employee guidance on that basis. The guidance also excludes students or trainees on work-experience placements, apprentices and members of the armed forces. Seasonal or casual workers hired for up to six months during a peak period, project specialists and people covering maternity leave may qualify if they meet the definition.

What equal-treatment rights apply?

An employer must not treat a fixed-term employee less favourably than a permanent employee doing the same or largely the same job unless there is objective justification—a good business reason for the difference. The comparison is with permanent employees of the same employer, not an associated employer. Whether a particular person is a suitable comparator depends on the work and circumstances. GOV.UK: Employees’ rights.

  • Pay and conditions: Fixed-term employees should receive the same pay and conditions as comparable permanent staff, unless a difference is objectively justified.
  • Benefits: They should receive the same or an equivalent benefits package, subject to the same justification test.
  • Permanent vacancies: The employer must tell fixed-term employees about permanent vacancies.
  • Redundancy and dismissal protection: Fixed-term status alone does not remove these protections; eligibility for particular rights can depend on service and the reason for the employer’s decision.

What happens when a fixed-term contract ends?

Expiry and non-renewal

A fixed-term contract will normally end automatically on its agreed end date, and the employer does not have to give notice of that expiry. If the employer does not renew it, GOV.UK treats that as a dismissal. The service thresholds stated in the guidance are:

Right described in GOV.UK guidance Service threshold What it means
Written reasons for not renewing At least one year You can request a written statement of the reasons.
Ordinary unfair-dismissal protection Two years The guidance says a fair reason is needed for non-renewal. It gives a one-year threshold for employees already employed before 6 April 2012.
Statutory redundancy pay At least two years It may be due if the reason for non-renewal is redundancy.

These are thresholds stated on GOV.UK; the guidance page does not state a publication date. Check the current rules and your individual dates before relying on a threshold. GOV.UK: Renewing or ending a fixed-term contract.

Ending the contract early

Early termination is different from expiry on the agreed date. Check the contract for an early-termination clause. If it allows early termination, the employer must give proper notice. If it says nothing about early termination, ending the contract early may put the employer in breach. GOV.UK states a minimum employer notice of one week after at least one month’s continuous service, increasing to one week for each year worked after two years; the contract may provide more notice. Because the clause and dates matter, check the wording and service history in an individual case.

Can repeated fixed-term contracts become permanent?

Under the GOV.UK guidance, an employee who has been on fixed-term contracts for four or more years will automatically become permanent unless the employer can show a good business reason otherwise. A collective agreement with a union or staff association may remove that automatic right in the circumstances described by the guidance. Continuity of employment and any applicable agreement need to be checked; four years on a series of contracts should not be treated as an automatic answer without those details.

If an employee continues working after the end date without a formal renewal, GOV.UK says this may create an implied agreement that the end date has changed. GOV.UK: Renewing or ending a fixed-term contract.

How do EU rules differ from the UK-specific details?

At EU level, the framework seeks to prevent unjustified less favourable treatment compared with comparable permanent workers and abuse of successive fixed-term contracts between the same employer and employee for the same work. Member states must provide at least one safeguard against abuse of successive contracts: objective reasons for renewal, a maximum total duration, or a maximum number of renewals. The framework does not set one uniform renewal limit for every country; national law supplies the applicable details. European Commission: Fixed-term work.

Your Europe summarizes equal conditions as including pay, leave, notice periods and other employment rights and benefits, as well as notice of permanent vacancies. Its page was last checked on 3 April 2026. This is an EU-framework summary, not a substitute for the law in a particular country. Your Europe: Fixed-term work.

What to check if you think your rights were breached

  • Country: Identify the law governing your employment; the rules above describe the UK guidance.
  • Status: Check whether you are employed directly by the organisation, rather than engaged through an agency or another arrangement.
  • Comparator: Identify a permanent employee of the same employer doing the same or largely the same work, and the specific treatment that differs.
  • Dates and continuity: Record start dates, breaks, contract end dates, and how long you have worked for the employer.
  • Contract wording: Review the end date, early-termination and notice clauses, and any renewal documents.
  • Renewal history and agreements: Keep copies of successive contracts and check whether a collective agreement applies.

For a dispute, seek advice from an appropriate employment-law service in your country. In the UK, the relevant route and available rights depend on the facts of the case.
