Those are separate remedies, not an automatic right to force a player onto the court or impose a standard fine in every dispute. The player’s contract status, explanation for the absence, and the negotiated grievance process matter.
Which rules govern a player’s absence?
The controlling framework is the NBA-NBPA Collective Bargaining Agreement (CBA) and the player’s Uniform Player Contract. The NBPA says the current CBA was ratified in April 2023, took effect July 1, 2023, and runs through the 2029–30 NBA season, with an opt-out available after 2028–29. Its term should be rechecked for any later developments. The agreement governs employment terms and the rights and obligations of players, teams, the league, and the union. The NBPA’s CBA page provides the agreement.

The main provisions for this question are CBA Article VI, Section 1(a), Article XXXI, Sections 12–13, and Paragraph 9 of the Uniform Player Contract in Exhibit A. The CBA’s remedies turn on whether the player has a currently effective contract and whether the failure or refusal to provide required services is without “proper and reasonable cause or excuse.” An injury or another asserted explanation may make the facts contested; an absence alone does not establish a breach.
What can a team do if a player refuses to play?
| Possible action | What the agreement provides | Important limit |
|---|---|---|
| Reduce current base compensation | For each covered missed game, reduce that contract year’s base compensation by 1/91.6th. | Applies to a qualifying refusal without proper and reasonable cause or excuse, including a suspension for that refusal. |
| Impose discipline | The Uniform Player Contract permits reasonable fines and/or suspensions for a contract breach or team-rule violation, in accordance with the CBA. | Discipline is not automatic or unlimited; the contract and grievance provisions apply. |
| Seek damages | A team may seek damages in a proceeding before the Grievance Arbitrator for failure or refusal to provide contracted services. | The arbitrator determines any recovery; the agreement does not set a predetermined damages amount. |
| Request expedited arbitration | The NBA or NBPA may request immediate referral for specified disputes, including one under Article XXXI, Section 12 or an alleged breach of Paragraph 9 of the Uniform Player Contract. | This is a defined process available to the specified parties, not an automatic team-only order. |
Reduce compensation under the per-game formula
Under Article VI, Section 1(a), a player who fails or refuses, without proper and reasonable cause or excuse, to render required services—or is suspended for that refusal—has his current base compensation for that contract year reduced by 1/91.6th for each missed exhibition, regular-season, play-in, or playoff game. This is a formula, not a fixed league-wide fine. The dollar effect depends on the player’s base compensation and the number of covered games.

Impose reasonable contract-consistent discipline
The Uniform Player Contract allows a team to reasonably impose fines and/or suspensions for a contract breach or violation of team rules, consistent with the CBA. It also provides for withholding a fine or applicable salary amount from compensation due. If a player timely contests a qualifying withholding through a grievance, the amount is placed in an interest-bearing account while the dispute is resolved. The agreement does not make an arbitrary fine or indefinite suspension automatically permissible.
Bring a damages claim
Under Article XXXI, Section 12, a team may seek damages before the Grievance Arbitrator when a player under a currently effective contract fails or refuses to provide contracted services. The arbitrator may award damages already sustained. If damages continue to accrue, the hearing may remain open for further proof. This is a separate potential claim, not a guaranteed payment or a preset damages figure.

Use the expedited route when it applies
For a dispute under Article XXXI, Section 12 or an alleged breach of Paragraph 9 of the Uniform Player Contract, the NBA or NBPA may request immediate referral to the Grievance Arbitrator. Under Article XXXI, Section 13, the arbitrator must convene a hearing no later than 24 hours after receiving notice, and issue a written award no later than 24 hours after the hearing concludes. These deadlines describe the agreement’s expedited procedure; they do not mean a team can unilaterally obtain an immediate ruling outside that process.
How does the grievance process affect the dispute?
The CBA permits a player, team, the NBA, or the NBPA to initiate a grievance, subject to a special approval condition when the NBPA initiates a player-discipline grievance. Before filing, the parties must first discuss the matter in an attempt to settle it. The agreement’s dispute path is therefore part of the remedy: a team’s view of an absence does not by itself resolve whether the player had a reasonable excuse or what discipline or damages are appropriate.

In a real case, relevant facts may include the player’s stated reason for missing games, medical status, communications, services required by the contract, whether the contract remains effective, notices given, and the games actually missed. Keeping clear records of those matters is practical preparation for a dispute, rather than a separate remedy specified by the CBA.

James Harden: a fine tied to public comments
On August 22, 2023, the NBA announced a $100,000 fine for Philadelphia 76ers guard James Harden. The league said his public comments on August 14 and 17 indicated he would not perform services required by his contract unless he was traded, and said its investigation included an interview with Harden. The NBA’s announcement documents one instance of league discipline tied to statements about nonperformance; it does not establish a standard fine for every holdout or a team damages award for missed games. Milwaukee Bucks and Giannis Antetokounmpo: disputed availability facts
An NBA.com report published April 5, 2026, described a Player Participation Policy investigation involving the Milwaukee Bucks and Giannis Antetokounmpo. An NBA spokesman said the investigation was ongoing and certain facts remained in dispute. That report does not establish a final finding that Antetokounmpo withheld services in breach of contract. Read the report.
Can a team make the player take the court?
The cited CBA provisions establish compensation, discipline, damages, and dispute-resolution options; they do not establish that a team can physically compel a player to take the court. Nor do they predetermine a trade, a particular suspension, a fine, or an arbitration outcome. Whether an absence is an unjustified refusal and which remedy applies depend on the contract and the facts resolved through the agreed process.
