Instagram’s music picker is not a blanket music licence. A track available for a Reel may be usable under conditions that depend on the post’s purpose, where it appears, the relevant rights and the applicable territory. GEMA, a German collecting society, describes Instagram-library use as limited to Instagram and non-commercial content; commercial video use may require permission from the relevant rightsholders. Check the terms that apply to your specific use rather than assuming that adding a track in Instagram clears it.
Can I use Instagram’s music library for a Reel?
GEMA says private individuals can generally use tracks from Instagram’s music library in Stories, Reels and videos when the content is non-commercial and stays on Instagram. That is GEMA’s guidance, not a universal statement of law or a guarantee that every track is available to every account in every country. Meta’s current catalogue eligibility and detailed rules for each account type and format can vary.

The practical distinction is the purpose and scope of the post, not simply whether you selected the song inside Instagram:

| Use | What the cited guidance says | What to check |
|---|---|---|
| Personal, non-commercial Reel using Instagram’s library | GEMA describes this use as generally permitted for private individuals on Instagram. | Whether the track is available for your account and use, and whether the post is genuinely non-commercial. |
| Promotional, sponsored or other commercial video | GEMA says commercial users may need rightsholder authorization or a licence to pair music with moving images. | Permission for the particular music, video, placement, territory and commercial purpose. |
| Reposting the Reel on another platform | GEMA describes the library permission it discusses as exclusive to Instagram. | Separate rights or terms for the other platform and intended use. |
For its explanation of Instagram-library use, see GEMA’s guidance on using music in Instagram Stories and Reels. Its guidance is useful, but it does not settle every country’s law or every licence and account arrangement.

Can I use a trending song in a business or sponsored post?
Do not assume that a popular song available in the picker is cleared for an advertisement, sponsored post, product promotion or other commercial video. GEMA advises businesses and other commercial users to consider the synchronization right: permission to pair music with moving images. Depending on the rights and use, that may mean obtaining authorization or a licence from the relevant rightsholder, such as a creator or publisher.
Nor does an account label settle the question. GEMA notes that activity on an account described as private can still be considered commercial depending on its purpose and context—for example, if it promotes a product or forms part of influencer activity. It also cautions that rightsholders may have a view on whether a use is commercial. Meta’s detailed rules for every account type, region and paid-placement format are not established by the guidance cited here.
GEMA’s page quotes Meta’s Music Guidelines as saying: “Use of music for commercial or non-personal purposes in particular is prohibited unless you have obtained appropriate licences.” The quotation is reported by GEMA; it should not be taken as direct confirmation here of the current text of Meta’s guidelines. For commercial video, identify the relevant rightsholders and confirm that any permission covers the intended use before publishing.

Does crediting the artist make it okay?
No. Credit can acknowledge the artist, but it does not by itself grant copyright permission. Meta’s copyright guidance lists several facts that do not automatically make a use permissible:
- You bought or downloaded the track.
- You recorded it yourself at a public event.
- You credited the owner, added a disclaimer or did not intend to make money.
- You modified the work, found it online or saw other people post it.
- You believe the use is fair use.
Meta’s list is a warning against treating any one of these facts as permission; it does not decide whether a particular use qualifies for fair use or another copyright exception. Exceptions depend on jurisdiction and the facts of the use. See Meta’s copyright guidance for Instagram and Threads.

Can I use the same Reel on another platform?
Do not treat permission to use a track through Instagram’s library as clearance to upload the same music-and-video combination elsewhere. GEMA describes the library use it discusses as limited to Instagram. Another service, a downloaded copy of the Reel or a separately edited version may require different permissions under that service’s terms and the relevant rights.
Before cross-posting, check the terms for the destination platform and whether you have permission for the music in that version of the video. A track being available in Instagram’s picker does not establish permission for use outside Instagram.

What if it’s my own song?
Check what you actually control before assuming that “my song” means you can use every version of it however you want. The underlying composition and a particular sound recording can have different owners or controllers. Co-writing, a label or publishing deal, samples, and distribution agreements may also affect what you can authorize.
- Identify who controls the composition and who controls the recording you plan to use.
- Review relevant label, publishing, co-writer, sample and distribution agreements or settings.
- Confirm that your permission covers the post’s purpose, platform, territory and any paid or sponsored placement.
These are checks to make against your own agreements; the available guidance does not establish who owns an individual musician’s rights.

How can musicians respond when their work is used?
Keep records that help establish what you own or control, and use Meta’s current reporting instructions if you believe your rights have been infringed. In a January 24, 2023 newsroom post, Meta described a global intellectual-property notice-and-takedown team, specialized reporting tools, a repeat-infringer policy and Rights Manager, which it said helps copyright holders manage when, how and where their content is shared.
That post said Facebook Page holders could apply for Rights Manager access at the time. It is a dated eligibility statement, not a guarantee of current availability. Check Meta’s Rights Manager announcement alongside Meta’s current reporting and eligibility instructions.

Meta’s June 22, 2022 announcement described #1MinMusic as an initiative for Reels and Stories, with music from 200 artists across India. That is a description of the announcement-era initiative, not a current count of Instagram’s music catalogue or proof that any particular track is cleared for commercial use. Meta’s statement explained the feature’s intended role in making music available for Reels, but an announcement about access does not establish permission for every context.
See Meta’s #1MinMusic announcement for its stated scope and date.
