What Local AI Can and Cannot Do With Legal Documents

Local AI can assist with searching and summarizing legal documents without necessarily sending them to an AI provider, but local processing alone does not guarantee security, privilege, or accuracy.

Local AI may let you analyze legal documents without sending their contents to an AI provider for inference—but only if the complete workflow stays local. That can reduce one kind of data exposure. It does not, by itself, guarantee security, preserve attorney-client privilege, make an answer accurate, or replace a lawyer’s judgment.

For lawyers, the relevant questions are separate: where the information goes, whether its use meets professional obligations, and whether a particular disclosure affects a legal protection. The answers depend on the tool, its settings, the matter, and the applicable jurisdiction.

What “local AI” means for legal documents

In a local-AI workflow, a model runs on a computer or other environment controlled by the user, and document processing and inference can happen there rather than on an AI provider’s servers. In principle, that lets a person ask questions about supplied text, request a summary, or compare passages without sending the contents to an external model provider for those operations.

“Local” describes where some processing happens; it is not a complete description of how an application handles data. Prompts, source documents, indexes built from those documents, and generated outputs all matter. A locally run model may be paired with online downloads, optional cloud features, telemetry, operating-system sync, remote backups, or network storage. Check the specific application and configuration instead of relying on a product label.

What to check in the complete workflow

  • Whether prompts, files, indexes, and outputs leave the device, and which services receive them.
  • Whether the software saves inputs, retains them, or uses them to improve a model or affect answers to other users.
  • Whether sync, backups, telemetry, or connected features are enabled and where their data goes.
  • Who can access the computer and its accounts, and whether files are protected against unauthorized access.
  • Whether product terms and client or organizational agreements permit the proposed use.

The American Bar Association’s article on local AI describes local inference as an alternative to sending material to cloud services and notes that speed and performance depend on the model and hardware. These are general descriptions, not specifications for every product or proof that a particular setup is offline.

What local AI can help you do with a file

A local model can be a first-pass assistant for work on text already supplied to it. Depending on the software’s document parsing and retrieval, it may help:

  • Summarize a document or set of documents.
  • Find named people, dates, amounts, or other terms to check.
  • Organize files or prepare a first-pass outline.
  • Compare passages and identify apparent similarities or differences.
  • Answer a narrow question about supplied material and point to passages that may support its response.

These are assisted tasks, not assurances that the system found every relevant passage, understood the full context, or reached a legally correct conclusion. Document handling depends on more than the language model: scanned pages may need optical character recognition, and parsing or retrieval can omit or misread material. Inspect the original files rather than treating an AI-generated summary or answer as the record.

What local AI does not guarantee

It does not establish security or confidentiality on its own

Keeping inference on a device may reduce exposure to an AI provider, but it does not determine who can access the device or its files, whether the storage is protected, or whether connected services copy the data. The Solicitors Regulation Authority (SRA), which regulates solicitors in England and Wales, warns that confidentiality risks can arise with both free and paid AI systems depending on their terms, settings, and architecture. It calls for appropriate contractual, technical, and organizational safeguards.

It does not decide privilege

Confidentiality and privilege are related but distinct questions. Whether a particular disclosure preserves an applicable legal protection can depend on the circumstances and law governing the matter; a local technical architecture cannot answer that question by itself.

The New York City Bar’s report describes the analysis as context-dependent, including the information submitted, outputs, privacy policies, and third-party doctrine. North Carolina Formal Ethics Opinion 2024-1 expressly does not decide whether sharing information with an AI tool violates privilege. Do not treat ethics guidance about secure handling as a ruling on privilege or work product in a particular case.

It does not make generated legal analysis reliable or current

Local models can produce plausible-sounding errors. The National Center for State Courts’ practitioner guide describes hallucinations that include fabricated citations, distorted holdings, and false procedural information. A model may also omit a qualification or context from a supplied document. A local model may lack current internet information, so its answer is not a dependable statement of current law merely because the underlying files were processed locally.

The available evidence does not establish a topic-specific accuracy rate for local models on legal documents, or show that local processing preserves privilege at any particular rate. Do not infer either from general AI benchmarks or from the fact that a model runs on your computer.

It does not replace the lawyer’s responsibility

ABA Formal Opinion 512 addresses lawyers’ duties concerning competence, confidentiality, client communication, and reasonable fees when using generative AI. North Carolina Formal Ethics Opinion 2024-1 says a lawyer remains individually responsible for reviewing and evaluating work produced by an AI process. The ABA Model Rules are not automatically the rule in every jurisdiction: check the rules and guidance that apply to the lawyer and matter.

Local and hosted AI: what changes in practice

Neither arrangement is automatically suitable for legal documents. A local setup may reduce the need to send inference content to an outside model provider, while a hosted or legal-specific service may have different capabilities or data controls. Compare the actual service and workflow, not just the words “local,” “private,” or “secure.”

Question Local workflow Hosted workflow
Where inference happens On the user’s computer or controlled environment if the application is configured to run locally. Connected services may still transmit data. On the provider’s infrastructure in many services; the exact data flow depends on the product and configuration.
Data access, retention, and training Depends on the software, connected services, device access, backups, and settings; “local” alone does not establish these details. Depends on the provider’s terms, settings, architecture, and safeguards.
Hardware and maintenance Performance depends on hardware and model size; setup and document handling also matter. The user’s device may not run the model, but the service’s capabilities and data controls still require review.
Current legal information A local model may not have current internet information; verify law against authoritative sources. Internet or legal-source access varies by service and must be checked; access alone does not establish accuracy.
Accuracy on the actual task Not established by the fact that processing is local; assess outputs against representative documents and sources. Not established by hosting or product category; assess outputs and controls for the intended task.

For either option, assess data access and retention, contractual safeguards, traceability to source material, performance on the actual task, document and context handling, maintenance, and access to current law. No one feature settles whether a workflow is appropriate.

ABA guidance for U.S. lawyers

The American Bar Association’s July 29, 2024 article describing Formal Opinion 512 says lawyers and law firms using generative AI must consider applicable ethical obligations, including competence, client information, communication, and reasonable fees. The opinion discusses Model Rules 1.1 and 1.6; lawyers should check how their jurisdiction has adopted or supplemented the Model Rules.

D.C. Bar guidance

D.C. Bar Ethics Opinion 388 recommends determining whether a generative AI tool saves lawyer inputs or whether interactions affect its answers to future users. It calls for caution where inputs may be saved or affect future answers, and says a lawyer should not disclose client confidential information to a system unless reasonably satisfied it will not be revealed to future users. This is D.C.-specific ethics guidance, not a universal privilege holding.

North Carolina guidance

North Carolina Formal Ethics Opinion 2024-1 says third-party AI use involving client information may be permissible if the lawyer satisfies herself that the service is sufficiently secure against inadvertent disclosure or unauthorized access. It leaves privilege outside the opinion and says that issue should be researched before submitting client-specific information.

England and Wales guidance

The SRA’s warning notice applies to solicitors it regulates in England and Wales. It says client information should only be entered into AI systems where appropriate contractual, technical, and organizational safeguards are in place to protect confidentiality. Lawyers elsewhere should consult the rules and regulator guidance that govern them.

A review loop for document work

Use AI output as a lead to inspect, not as a substitute for the underlying record or current legal authority.

  1. Choose a narrow question. Define what you need from the file rather than asking for an unbounded legal conclusion.
  2. Ask for supporting passages. Request the source page, paragraph, or other location for each material point, where the tool supports it.
  3. Inspect the original. Check the cited passage in the source file and look for surrounding context, omitted qualifications, and parsing errors.
  4. Verify external law independently. Check each citation, quotation, holding, procedural statement, and claim about current law against an authoritative source for the right jurisdiction and date.
  5. Correct and escalate. Record material corrections and refer uncertain or high-stakes issues to qualified counsel before relying on them.

Do not rely on a citation because it looks plausible, or treat an answer as complete because it includes page references. The National Center for State Courts’ guide documents fabricated citations and distorted legal material; ABA and North Carolina guidance place review and professional responsibility with the lawyer.

When a local workflow may be a fit

A local setup may be worth evaluating when reducing transmission to an external model provider is important and the user can verify that the complete workflow—including storage, indexing, backups, and connected features—meets the matter’s requirements. Local tools also require suitable hardware and may need setup or maintenance; performance varies with hardware and model size. No particular computer or configuration is established as suitable for every model or legal workflow.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before using any system with client material, assess its actual data flows and terms, the applicable professional rules and agreements, and whether the task can be reviewed reliably. If those conditions cannot be established, do not assume that local inference alone makes submission appropriate.
