In a dispute, a coast guard may enforce laws or signal a state’s claim to jurisdiction, while a navy may provide military presence or deterrence. Those are common roles, not universal rules: a service’s authority and status depend on its country, and its presence alone does not establish whether an action is lawful.
How their usual roles differ
A coast guard commonly carries out day-to-day maritime functions such as enforcing laws, conducting search and rescue, protecting fisheries and other resources, and promoting safety. The U.S. Coast Guard, for example, describes itself as the lead federal maritime law-enforcement agency, with responsibilities involving contraband, immigration, fisheries, and maritime resources (U.S. Coast Guard, Maritime Law Enforcement).

A navy is primarily organized for national defense and military operations at sea. In a dispute, naval vessels can provide military presence, deterrence, or combat capability. The distinction is about typical purpose and posture—not a guarantee that every coast guard is civilian or that every encounter involving a navy is combat-related.

Why the boundary is not absolute
Countries organize and command their maritime services differently. Some coast guards have armed, military, or wartime roles alongside law-enforcement work, and authority to board, inspect, detain, or enforce a law comes from the relevant national law and command arrangements—not from the words “coast guard” or “navy” alone.

United States
U.S. law assigns the Coast Guard duties that include maritime safety, search and rescue, aids to navigation, environmental protection, law enforcement, and defense readiness (14 U.S.C. § 102). The service describes its work as spanning military operations, law enforcement, border and port security, and humanitarian missions (U.S. Coast Guard, What We Do). Its defense program says forces may operate under Coast Guard control or under a Department of Defense combatant commander (U.S. Coast Guard, Defense Operations Program).
Philippines
Philippine law describes its coast guard as an armed and uniformed service attached to the transportation department and provides for its attachment to the defense department in declared wartime (Republic Act No. 9993, Philippine Coast Guard Law of 2009).

India
The Indian Coast Guard’s stated missions include supporting the navy during war (Indian Coast Guard, Mission and Motto). Together, these examples show why it is inaccurate to treat “coast guard” as a synonym for “civilian service” across all countries.
What determines the legal significance of a presence
A ship’s service label is not enough to decide whether it may lawfully be in a particular place or take a particular action. The analysis depends on the location, the state’s claim, the vessel and its status, the conduct at issue, and the national and international rules that apply.

The United Nations Convention on the Law of the Sea provides a framework for maritime zones, passage, and coastal-state jurisdiction (UNCLOS, Part II). A careful assessment should first identify whether the incident concerns internal waters, the territorial sea, an exclusive economic zone, or the high seas, then establish what claim is being asserted and which treaty rules and domestic laws govern the specific conduct. The applicable rights and limits differ by zone; simply calling an area “disputed” does not settle them.

How to assess a specific maritime incident
- Identify the place. Establish the location as precisely as possible and the maritime zone claimed by each relevant state.
- Identify the vessels. Determine which services operated the ships and, where relevant, their status and command arrangements.
- Describe the conduct. Distinguish presence or patrol from actions such as boarding, inspection, detention, or use of force.
- Check the authority. Identify the national law authorizing the action and the international rules applicable to that location and conduct.
- Separate enforcement from the underlying claim. A coast guard or navy’s presence does not by itself prove sovereignty, settle a maritime boundary, or establish that an action was lawful.
