MAP pricing means minimum advertised price: a manufacturer’s policy sets the lowest price a seller may publicly advertise for a covered product. It does not necessarily set the price the seller may actually charge. Whether a particular policy is enforceable, and what kinds of advertising it covers, depends on its wording and applicable law.
What MAP pricing means—and what it does not
A minimum advertised price (MAP) is a price floor in a manufacturer’s policy for advertising a covered product. It governs the price shown or promoted to the public as defined by that policy; it should not automatically be treated as a minimum resale price.
For example, OtterBox’s policy says it applies to advertised prices, not actual resale prices. That is a specific policy example, not a rule for every brand. A seller considering an offer below the advertised threshold should read the policy rather than assume a particular checkout method, private quote, bundle, or post-click price is permitted.
In practical terms, the displayed price and the transaction price may be distinct. The policy’s exact language determines what counts as an advertisement, what exceptions exist, and what conduct may trigger enforcement.

How a MAP policy works in practice
A manufacturer’s policy may identify the covered products and sellers, the minimum advertised price, which channels count as advertising, exceptions, and possible consequences for violations. Those details vary. OtterBox, for example, publishes a policy for the United States and Canada, covers advertised prices, and sets a default advertised-price rule for a covered product without a published MAP. - Coverage: Which products, sellers, and jurisdictions are covered?
- Advertising channels: Does the policy cover retailer-funded ads, in-store signs, marketplaces, email, or other promotions?
- Price presentation: How does it distinguish an advertised price from the transaction price? Does it specify what may appear after a shopper clicks, adds an item to a cart, or requests a quote?
- Exceptions: Are there permitted promotions, bundles, or other circumstances? Do not assume an exception exists unless the policy says so.
- Enforcement: What steps may the manufacturer take, and how are they described?
Can a retailer sell below MAP?
Possibly, but the answer depends on the policy’s wording and applicable law. A MAP policy concerns advertised prices; it does not, by definition alone, establish that the seller cannot complete a sale at a lower price. OtterBox expressly distinguishes advertised prices from actual resale prices in its policy. That distinction does not establish that every brand allows below-MAP sales or that a particular method of presenting a lower price complies with a policy.
Do not treat “add to cart,” private quotes, bundles, or checkout displays as automatic workarounds. Check the policy’s text for its treatment of those practices, and get legal advice when the consequences matter.

What U.S. federal antitrust guidance says
The Federal Trade Commission (FTC) says that after the Supreme Court’s 2007 decision, manufacturer-imposed vertical price programs are evaluated under a rule-of-reason approach. The FTC also describes latitude for a manufacturer acting unilaterally to set dealer policies, including declining to deal with a retailer that will not follow the policy. The agency’s guidance states: “If a manufacturer, on its own, adopts a policy regarding a desired level of prices, the law allows the manufacturer to deal only with retailers who agree to that policy.” Read this as the FTC’s general account of federal antitrust treatment—not a conclusion that every MAP policy is lawful in every circumstance.

Why businesses use MAP—and why its effects are debated
A common business rationale is that retailers may invest in advertising, demonstrations, or other services that help a brand compete with other brands. The FTC notes that dealer services can support competition between brands, while also recognizing that restraints can reduce competition between sellers of the same brand. Those are competing considerations, not proof that every MAP policy benefits consumers.
The FTC’s 2016 policy paper examines potential procompetitive and anticompetitive effects of minimum advertised price restrictions. The FTC also recounts a historical challenge involving music distributors’ MAP policies. In that episode, the policies extended to retailer-funded advertising, included in-store advertising, and could impose broad forfeitures after a violation; the FTC said they prevented retailers from telling consumers about discounts. The agency’s account says the policies covered more than 85 percent of market sales in that historical episode—not a current market statistic. The example illustrates why a policy’s scope and effects matter; it does not mean every MAP policy is unlawful.
