It is shorthand for using a hosting or cloud service to handle electronic protected health information (ePHI) in a way that meets applicable HIPAA requirements. That generally means the provider is properly engaged as a business associate, the parties have a business associate agreement (BAA), and both have safeguards suited to the risks of their actual setup.
A BAA or a provider’s security features do not make a customer compliant by themselves. The regulated organization remains responsible for understanding its environment, conducting risk analysis, configuring its systems, and managing its share of the safeguards.

What does “HIPAA-compliant hosting” mean?
The phrase describes a hosting arrangement intended to support compliance with applicable HIPAA Rules. It does not describe a product category that the U.S. Department of Health and Human Services (HHS) certifies. HHS’s Office for Civil Rights (OCR) states: “OCR does not endorse, certify, or recommend specific technology or products.” That means a provider should not be called “HHS-certified,” and buying a particular hosting plan does not automatically make an organization compliant.
The key questions are what information is involved, what the provider does with it, whether the provider is a business associate, what the BAA covers, and how the customer and provider divide and implement safeguards. HHS OCR’s Guidance on HIPAA & Cloud Computing, last reviewed December 23, 2022, addresses these issues.

When is a hosting provider a business associate?
A provider may be a business associate when it creates, receives, maintains, or transmits ePHI on behalf of a covered entity or another business associate. The service’s marketing label does not determine its status; what it actually does with ePHI matters.
In particular, a cloud provider can still be a business associate if it stores only encrypted ePHI and does not hold the decryption key. HHS states: “Lacking an encryption key does not exempt a CSP from business associate status and obligations under the HIPAA Rules.” A narrow conduit exception may apply to a provider that only transmits ePHI and has no storage other than temporary storage incident to transmission. That exception should not be treated as a general exemption for ordinary hosting or storage.

What does the BAA need to do?
Before a covered entity or business associate uses a cloud service to maintain ePHI, it should execute a HIPAA-compliant BAA with the provider. HHS says using a cloud service provider to maintain ePHI without first executing a BAA violates the HIPAA Rules. A BAA sets the terms of the business-associate relationship; it is not a certification of the hosting environment or a substitute for the customer’s own compliance work.

- Permitted and required uses and disclosures of ePHI.
- Safeguards the provider must implement and incident reporting responsibilities.
- Subcontractor obligations where subcontractors handle ePHI.
- How the provider will support the customer’s applicable HIPAA obligations.
- Whether the customer can access and retrieve its ePHI, including when the service ends.
What must the customer do after signing?
The covered entity or business associate must understand the specific service and conduct its own risk analysis and risk management. HHS’s Guidance on Risk Analysis describes risk analysis as foundational and advises organizations to assess and document their security measures, whether required measures are in place, and whether they are configured and used properly.
Make the assessment specific to the real architecture rather than relying on a generic “HIPAA-ready” claim. Relevant questions include where ePHI is stored and transmitted, who controls identities and encryption keys, who can administer the environment, how configuration and patching are handled, what backup and recovery depend on, how incidents are managed, and whether data location creates additional risks. These are practical assessment prompts, not a prescribed HIPAA architecture or a list of products the law requires.

Which security features and responsibilities matter?
HIPAA safeguards are flexible and scalable to the services and risks involved. The parties should document in the BAA or other written materials who implements each relevant administrative, physical, and technical safeguard. Then the customer should verify that the controls assigned to it are enabled and maintained.
For example, in a no-view arrangement, the customer might authenticate the users allowed to access ePHI while the provider implements encryption. The provider still needs to consider appropriate internal controls for administrative systems that manage infrastructure and can affect ePHI’s confidentiality, integrity, or availability. The precise division depends on the service and risk; neither party should assume the other is handling a control without confirming it.

Encryption can reduce the risk of unauthorized viewing, but it is not a complete compliance program. HHS notes that encryption alone does not ensure data integrity or availability, prevent corruption, provide disaster recovery, or replace administrative and physical safeguards. Access management, risk management, incident response, backup and recovery, availability, physical protections, and clear responsibility allocation all need consideration according to the circumstances.
What should you compare between hosting options?
Public, private, and hybrid cloud arrangements are not automatically compliant or noncompliant based on their labels. HHS says each configuration may be used when the regulated organization has the required BAA and otherwise complies with the HIPAA Rules. The configuration affects the risks to assess and how responsibilities should be handled.

- Whether the exact service and intended use are included in the provider’s BAA.
- Which party handles each relevant safeguard, including access, encryption, and administrative access.
- Availability commitments, backup and recovery arrangements, and incident reporting terms.
- How data can be exported, returned, or deleted when the relationship ends.
- What security documentation, audit rights, or other assurance materials are available under contract.
- Where data is located and whether jurisdiction or other location-related factors add risk.
- The customer’s configuration and operational workload, and whether it can manage its responsibilities.
What should SLAs, audits, and assurance terms cover?
HHS identifies several potential SLA topics: system availability and reliability; backup and data recovery, including for ransomware or other emergencies; return of data after service termination; security responsibilities; and limits on use, retention, and disclosure. In evaluating these terms, ask how long restoration may take, whether backups are protected and tested, and how data can be exported. HIPAA does not establish one universal recovery-time target or backup design in the cited guidance; assess commitments against your organization’s risk and needs.
The HIPAA Rules do not expressly require a cloud provider to supply security-practice documentation or allow customer audits. A customer may seek documentation, audit rights, or other assurances by contract based on its risk analysis and compliance needs. The absence of a specific audit clause does not by itself mean the provider has no HIPAA obligations: HHS notes that a cloud provider is directly liable for applicable HIPAA requirements when acting as a business associate.
