A de jure standard is generally a standard established or approved through a recognized standards body’s formal process. That describes how the standard gained status—not, by itself, whether the law requires anyone to follow it. In broader legal usage, de jure means “in law,” a related but distinct meaning.
What does “de jure standard” mean?
In standards terminology, a de jure standard is one developed or approved through a recognized standards organization’s prescribed procedures. The Office québécois de la langue française describes the term as a way to distinguish a formal standard from one that gains recognition in practice; it also notes that the word “standard” can refer to either kind in ordinary usage. OQLF’s terminology entry was updated in 2023.

INCITS characterizes formal standards development as based on openness and due process. In this sense, “de jure” points to the method and institutional route by which a standard is established, rather than to its popularity or legal force.

How is a de jure standard different from a de facto standard?
The central difference is how each gains recognition. A de jure standard follows a formal standards-body process; a de facto standard becomes widely accepted through use, implementation, or market dominance. NISO makes a similar distinction between formal standards from accredited bodies and specifications or practices that gain standing through adoption. NISO’s standards overview dates to 2007, so its taxonomy is useful here as a general distinction, not as a current status check for any particular specification.

| Question | De jure standard | De facto standard |
|---|---|---|
| How does it gain recognition? | Through a formal process of a recognized standards organization. | Through practical acceptance, widespread implementation, or market adoption. |
| Does the label establish legal force? | No. Formal approval alone does not make compliance legally mandatory. | No. Adoption in practice alone does not establish a legal requirement. |
People sometimes use these labels loosely, and a practice may be widely used while formal standardization is also under way or later occurs. When precision matters, explain whether you mean the approval process, the pattern of use, or a legal obligation.
Does a de jure standard have to be followed?
Not automatically. A standard can be formally developed and still be voluntary. It becomes legally required only if a separate legal or regulatory action makes it binding—for example, if legislation adopts it or a regulation requires compliance. The Government of Canada explains this distinction in its publication on standards and regulation: Standards and Regulations (1990). That source supports the general distinction between formal status and legal effect; it does not establish current requirements for any specific jurisdiction or standard.

To determine whether a particular standard applies to you, identify the relevant jurisdiction and check the law, regulation, contract, or procurement rule that refers to it. The standard’s approval by a standards organization is not enough to answer that question.

What does “de jure” mean in law?
Outside standards terminology, de jure is Latin for “in law”: something exists or is recognized as a matter of law. The U.S. Courts glossary uses this general legal sense. U.S. Courts glossary. That broader meaning should not be confused with the standards-specific use, where the phrase commonly describes a formal route of development or approval.

Examples cited in the Telecommunications Technology Association’s terminology entry include ITU recommendations, ISO/IEC international standards, European EN standards, and national systems or examples such as ANSI, BS, and KS.
