When a GST demand order is set aside and remanded for a fresh hearing, the challenged order is no longer operative, but the tax dispute may continue. The authority named in the remand must follow the court or appellate body’s directions and decide the matter afresh under the applicable GST law. Remand alone does not establish that no tax is payable.
What “set aside and remanded” means
Setting aside removes the challenged order as the operative decision. Remanding sends the matter back for further proceedings or a fresh decision. Those are related but distinct effects: the original demand order is quashed, while the show-cause notice and underlying dispute may remain open, subject to the remand directions and statutory limits.

The result depends on the wording of the order. Check whether it sets aside the whole demand or only part, identifies a particular defect to correct, preserves further proceedings, or directs the authority to take specific steps.

The authority must act within the remand directions and the applicable law. Depending on the case, the next steps may include receiving a reply to the show-cause notice, providing a meaningful hearing, considering the material, and issuing a fresh, reasoned determination. A fresh order is not automatically valid merely because it follows a remand.

For example, in a judgment dated 29 May 2025, the Allahabad High Court quashed a section 73 demand order that lacked reasons and merely incorporated the show-cause notice by reference. The Court directed the taxpayer to be allowed four weeks from the judgment date to respond to the notice, required an opportunity of hearing, and directed a fresh order in accordance with law. The four-week period was specific to that case, not a general GST remand deadline. Read the Allahabad High Court judgment, Neutral Citation No. 2025:AHC:92330-DB.
What to do after receiving a remand order
- Read the operative directions. Start with the final paragraphs of the court or appellate order. Identify what was set aside, which authority must act, what steps are required, and any dates or filing method stated.
- Review the show-cause notice. Prepare a response to its specific allegations and gather relevant supporting records. If the remand sets a reply period, calendar that case-specific deadline rather than relying on a general rule.
- Follow the hearing procedure. Attend or join as directed, or follow the stated process for requesting a hearing. Keep copies of submissions and proof of filing or attendance.
- Assess the fresh order against the directions and law. Compare its findings and amount with the notice, the evidence, the remand order, and the statutory provisions applicable to the proceeding. The CBIC portal publishes the GST Acts, including provisions relevant to determination: GST Acts on the CBIC portal.
- Check the route and deadline for any further challenge. The available remedy depends on who issued the fresh order, the procedural stage, and the governing law. Do not assume that the first order setting aside the demand decides the deadline or procedure for challenging a later order.
Does the process differ for a court remand and an appeal?
Yes. Identify which body made the remand before assuming what procedure applies.
| Situation | What it generally means | What to check |
|---|---|---|
| Court quashes an original demand and remands for fresh adjudication | The original demand order is set aside, but the notice and underlying proceeding may still be considered, subject to the judgment and statutory limits. | The court’s exact directions, the authority named, and any response or hearing dates. |
| Statutory appellate authority decides an appeal | The appeal is governed by the applicable statutory provisions and rules. Section 107 and the appeal rules address appellate orders; the framework limits the Appellate Authority’s power to refer a case back to the adjudicating authority that made the challenged decision. | Whether the challenged order was made by an adjudicating officer or an appellate body, what was set aside, and what the appellate order directs. CBIC’s appeal rules describe Form GST APL-04 for communicating the final amount of demand confirmed: CBIC appeal rules. |
The applicable version of the Act and rules, the stage of the proceeding, and the facts can affect the procedure. A court remand should not be treated as interchangeable with an appellate decision under section 107.
What a fresh order should be checked for
Section 75 of the GST framework contains general provisions for tax determination, including hearing and the form of the determination order. The Allahabad High Court example illustrates why reasons matter: the order was quashed because it did not state reasons and merely referred back to the notice. When reviewing a fresh decision, check whether it addresses the relevant material, gives reasons, follows the required hearing process, and stays within the remand directions and applicable law.
