What Happens to Your iPhone Photos When You Die?

Apple photos do not automatically transfer to family after death. A Legacy Contact can request certain account data with an access key and death documentation.

Your iPhone photos do not automatically transfer to family when you die. If you set up an Apple Legacy Contact, that person can request access to certain Apple Account data—which may include photos—using an access key and required death documentation. Without a Legacy Contact, family can still ask Apple about access or account deletion, but approval and documents depend on the country or region.

Where the photos are stored matters

Photos on an iPhone may also be stored in iCloud, depending on the account’s settings. Apple’s Legacy Contact guidance says the data made available may include photos, messages, notes, files and device backups. It does not promise that every photo will be available, or that a relative can access them simply because the account holder has died.

Access to the Apple Account and access to the physical iPhone are separate matters. A phone’s passcode is not a substitute for the Legacy Contact process, and account access does not automatically mean the device can be reused.

How a Legacy Contact can request access

Apple describes a Legacy Contact as someone chosen to access certain data in an Apple Account after the account holder’s death. To make a request, the contact needs the access key created when they were designated and the required proof of death. Apple’s current guidance, published September 14, 2026, explains the process and notes that requirements can vary by country or region: Apple Legacy Contact setup and access.

Set one up before it is needed

  1. On a supported iPhone or iPad, open Settings and tap your name.
  2. Tap Sign-In & Security, then Legacy Contact.
  3. Tap Add Legacy Contact and follow the prompts to designate someone you trust.
  4. Share the generated access key through iMessage or print it and keep it with estate-planning documents. Confirm the person received it.

Apple also supports setup on Mac. The chosen contact does not need an Apple Account or an Apple device, but they will need the access key when requesting access.

Know what the contact cannot access

Legacy Contact access is limited. It does not include purchased movies, music or books, subscriptions, or iCloud Keychain data such as payment information, passwords and passkeys. Apple’s Platform Security explanation, published May 7, 2024, describes the access-key arrangement; after the required checks, Apple issues a new account login for the Legacy Contact.

If no Legacy Contact was set up

Family can submit a request to Apple for access to or deletion of a deceased person’s account. Apple says it requires and verifies legal documentation before assisting. A death certificate is generally needed, and Apple may also require a court order or other documents; the requirements depend on the country or region. The current process, published August 24, 2026, is described at Apple’s deceased-account support page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Apple may be unable to provide some data that is end-to-end encrypted, because it cannot decrypt it. A request without a Legacy Contact is therefore not a guarantee that the family can recover the photos.

Choose carefully between access and deletion

Route What is needed Scope and limitation
Legacy Contact Previously generated access key and required death documentation May provide certain Apple Account data, including photos; purchases, subscriptions and iCloud Keychain data are excluded. Apple’s Legacy Contact guidance.
Request access without a Legacy Contact Apple Account details and documentation accepted in the relevant region; this may include a death certificate, court order or other documents Apple may grant access to certain data. Requirements vary, and some encrypted data may be inaccessible. Apple’s deceased-account process.
Request account deletion The requester’s own Apple Account, the deceased person’s account details and locally required legal documentation Permanently deletes the deceased person’s account and its data. This is not a way to preserve or recover photos. Apple’s deceased-account process.

Read the local requirements carefully before choosing deletion if preserving photos matters. Account deletion and an access request have different outcomes.

Recovering photos is not the same as reusing the iPhone

Apple says that after an approved Legacy Contact or account-deletion request, Activation Lock is automatically removed. The iPhone still needs to be erased and restored before another Apple Account can use it. Apple cannot remove a forgotten passcode lock without erasing the device, so resetting it is not a photo-recovery method. If photos may exist only on the phone, check for the access key and review Apple’s account process before attempting a reset.
