Withdrawals can be frozen while the company, its customers and a court determine who owns which assets, which legal entity owes the customer, and how claims should be paid. You may need to file or confirm a claim in an insolvency case, but a claim is not a promise of prompt, full or even partial recovery.
The result depends on the exchange’s terms of use, the account product, custody records, governing law and the specific court proceeding. This is a U.S.-focused explanation; another country’s insolvency and property rules can produce a different result.

What usually happens first
A failed exchange commonly suspends withdrawals, trading or both. The bitcoin balance remains visible in an app or website, but that display does not guarantee that you can transfer the coins. The company may be trying to secure wallets, reconcile customer records, obtain financing or comply with a court order.

In an insolvency, a court-supervised process determines what the company owns, what it owes and how assets will be distributed. Customers may receive notices from the court, a trustee, a claims administrator or the debtor. Those notices can require proof of identity, account ownership, transaction history or the amount claimed.

Access and legal recovery are separate questions. Even if a court ultimately decides that particular bitcoin belongs to customers rather than the exchange’s estate, withdrawals can remain unavailable while ownership, wallet balances and distribution procedures are resolved.
Three outcomes are possible
- Return of identifiable customer assets: If records and the legal structure support a customer-property treatment, some assets may be returned, subject to court orders and operational limits.
- Payment as an unsecured claim: If the assets are treated as estate property, the customer may receive a share of whatever remains after higher-priority claims and administration costs.
- Disputed or reduced recovery: Missing records, contract disputes, valuation questions, fees, or insufficient assets can delay or reduce payment. A total loss is possible in some cases.
There is no general recovery percentage or standard timetable that applies to every exchange failure.
Why an account balance is not the same as direct ownership
Exchange custody is a contractual and operational arrangement, not a universal legal category. The account agreement may say that the platform holds bitcoin for you, lends it, pools it with other customers’ assets, or has rights to use it. The company named in the agreement may also differ from an affiliate that operates a wallet, lending product or payment service.

A 2026 SEC-filed company disclosure warns that, in an insolvency, digital assets held in custody could be treated as property of the custodian’s estate. Customers could then be treated as general unsecured creditors and face a markdown or total loss. The disclosure also emphasizes that the issue is relatively untested and depends on the contracts and facts in the particular case.
Questions that determine the legal analysis
- What account did you use? Ordinary spot custody may have different terms from lending, yield, staking, margin or derivatives accounts.
- Which entity contracted with you? Read the terms for the company that accepted your account and the entity identified in account statements or notices.
- How were the assets held? Segregated wallets, omnibus wallets and internal ledger entries create different record and tracing issues. A marketing description alone does not establish legal protection.
- What law governs? The contract’s governing-law clause, the location of the company and the court handling the proceeding can all affect the result.
- What does the court order? A judge may set valuation dates, claim procedures, withdrawal rules and distribution priorities that control the case.
How a bankruptcy claim works
If an exchange enters bankruptcy or another insolvency process, you may have to submit a proof of claim or confirm information supplied by the company. The procedure, deadline and required documents are case-specific. Use notices from the court, the appointed claims agent or the official debtor website rather than social-media instructions.
- Locate the official case information. Confirm the court, case number, debtor entities and the authorized claims or noticing agent.
- Read the account-specific instructions. Determine whether your product is covered and whether the case uses a claim form, an online portal or a scheduled claim that can be amended.
- Collect supporting records. Save statements, trade history, deposits, withdrawals, wallet addresses, tax records, customer-support correspondence and the terms in force when you opened or used the account.
- Identify the correct legal entity. A claim against one debtor may not automatically apply to an affiliate. The entity named in your contract can matter.
- Record the valuation rules. The case may value bitcoin at a specified date or use a court-approved method rather than the price on the day withdrawals stopped.
- Submit before the deadline and keep confirmation. Retain the claim number, submitted form, attachments and any later requests for information.
- Monitor objections and distributions. A claim can be challenged, estimated, amended or paid in stages. Court notices—not informal promises—control.
Filing a claim establishes that you are asking for a distribution; it does not establish the amount or guarantee when you will be paid.

What the FTX and Celsius proceedings show
FTX: valuing digital-asset claims is unusual
In a June 26, 2024 opinion, the U.S. Bankruptcy Court for the District of Delaware addressed estimation of digital-asset claims in the FTX bankruptcy. The court wrote: “No bankruptcy court has ever estimated the value of cryptocurrency-based claims, nor, as far as I can determine, has any court ever conducted a valuation of crypto type assets.” That statement describes the novelty of the issue in that proceeding; it is not a universal valuation rule for every exchange.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesThe practical lesson is that the amount displayed in an app, the amount requested on a claim form and the amount ultimately allowed can differ. A court may need to decide the relevant date, asset valuation method and evidence supporting the customer’s balance.
Celsius: the named contracting entity mattered
In a March 9, 2023 opinion, the U.S. Bankruptcy Court for the Southern District of New York found Celsius Network LLC contractually liable under the relevant terms of use, rather than treating other debtor or non-debtor affiliates as automatically responsible. That finding is specific to those terms, entities and facts.

Do not assume that bitcoin on a crypto exchange has the same protection as money in a bank account or securities at a covered brokerage. The available U.S. materials do not establish blanket deposit insurance or Securities Investor Protection Act coverage for ordinary exchange-held bitcoin.
SIPA is a separate liquidation framework for eligible securities brokerage firms. The Administrative Office of the U.S. Courts explains how customer property and Securities Investor Protection Corporation advances may be distributed in a brokerage liquidation, and that customers can become unsecured creditors if customer property and advances are insufficient. That framework should not be presented as a guarantee for bitcoin held at a crypto exchange.

Protection questions to verify
| Arrangement | What to verify | Why it matters |
|---|---|---|
| Spot exchange custody | Terms, contracting entity, wallet structure and withdrawal rights | Determines whether the balance is treated as customer property or a contractual claim |
| Lending, yield or staking | Use-of-asset clauses, borrower or counterparty rights and liquidation terms | These products may transfer or encumber rights differently from spot custody |
| Margin or derivatives | Collateral rules, close-out provisions and liquidation procedures | Losses and contractual netting can affect what remains claimable |
| Brokerage account | Whether the firm and product qualify under the applicable securities regime | SIPA rules are distinct from ordinary crypto-exchange custody |
| Bank-linked service | The actual bank, crypto entity, account type and insurance language | A banking relationship does not automatically insure every digital asset |
What to do if withdrawals still work
If an exchange has announced trouble but withdrawals remain available, you can consider moving assets to a wallet or another arrangement you understand. Verify the destination address, network and memo or tag before confirming. A successful transfer is not guaranteed, and sending to a wrong address or unsupported network can make recovery impossible.
Do not treat a withdrawal as proof that the platform is solvent or as a guarantee against a later dispute. Keep the transaction hash, timestamp and destination details as part of your records.
What to do after withdrawals stop
- Capture account statements and balances, including downloadable CSV or PDF files.
- Export trade history, deposits, withdrawals and fee records.
- Save the terms of use and privacy or custody disclosures that applied to your account. Web pages can change after a failure.
- Keep emails, support tickets, tax forms and identity-verification records that connect you to the account.
- Follow only official court, debtor or claims-agent notices for deadlines and required evidence.
- Be skeptical of anyone promising guaranteed recovery for an upfront fee. No cited U.S. court or regulatory material authorizes a private recovery service.
- Consult a qualified attorney or tax professional for advice about your jurisdiction and circumstances.
Self-custody changes the risk rather than eliminating it
Keeping bitcoin in a wallet whose keys you control can reduce dependence on an exchange’s solvency and withdrawal system. A hardware wallet is one category of physical device used for self-custody, but the device itself does not guarantee recovery.
Self-custody makes the owner responsible for the seed phrase, backup procedure, device security, passphrase and transaction checks. Losing recovery information, exposing it to an attacker or sending funds to the wrong address can cause a permanent loss without an exchange insolvency being involved. The choice is therefore a trade-off: platform custody adds counterparty and contract risk, while self-custody adds key-management risk.
How to compare custody arrangements before depositing
| Check | Questions to ask |
|---|---|
| Product scope | Is this spot custody, lending, yield, staking, margin or another service? |
| Contract | Does the agreement describe ownership, lending, reuse, liens, setoff or withdrawal limits? |
| Legal entity | Which company signs the agreement, holds records and would be named in a claim? |
| Custody records | Are customer balances recorded individually, and are assets segregated or pooled? |
| Jurisdiction | Which law and court govern disputes and insolvency? |
| Exit capability | Can you withdraw promptly, and what network, identity or minimum-balance restrictions apply? |
| Evidence | Can you download statements and transaction history whenever you need them? |
Limits of any prediction
No one can determine a customer’s recovery from the account balance alone. The exchange, product, contracting entity, custody arrangement, governing law, court orders, asset records and case status all matter. The FTX and Celsius decisions illustrate specific disputes; neither predicts the result for another platform or customer.
This article does not state a recovery amount, deadline or outcome for any particular case. Check current official notices before acting, because claim procedures and court orders can change.
