It does not, by itself, prove that the ITC is allowable, cancel the demand, or authorize the officer to reopen every issue in the case.
Your next steps depend on the signed remand order, the original show-cause notice, the applicable version of the Central Goods and Services Tax Act (CGST Act), and the date on which the direction was communicated. Read those documents together before filing anything or assuming a deadline.

What a remand actually changes
A remand is a procedural direction, not a final ruling on the credit. The appellate authority, tribunal, or court has identified something that must be reconsidered and returned the matter to the authority that must make the fresh determination. The order may require a reply, a personal hearing, verification of particular records, or a new reasoned order.

The remand may leave some findings untouched while reopening others. For example, an order could require reconsideration of whether invoices and receipt evidence support a disputed credit but leave an unrelated period or allegation finally decided. The officer’s authority is therefore measured by the operative directions, the original notice, and the statutory provisions governing the proceeding—not by the fact that the case has come back.

What remand does not mean
- It is not an automatic allowance of the disputed ITC.
- It is not an automatic confirmation of the original demand.
- It does not necessarily create a completely new proceeding on every tax period or allegation.
- It does not, by itself, extend every limitation period or remove the boundaries in the original notice.
Start with the operative part of the remand order
Obtain the signed order and mark the paragraphs that contain directions, not merely the background narrative. Make a working schedule with four columns: issue remitted, issue decided or excluded, material the authority must examine, and action or deadline stated in the order.
Questions to extract from the order
- Which authority must pass the fresh order?
- Which tax periods, invoices, returns, suppliers, or legal grounds are within the remand?
- Did the court or appellate body direct a reply, personal hearing, verification, or a speaking order?
- Is a particular finding final, or was the entire earlier order set aside?
- Does the order prescribe a date, sequence, or method for communicating with the taxpayer?
Do not treat observations in the reasoning as broader than the operative direction. If the wording is unclear, preserve the ambiguity in your written response and ask the jurisdictional officer to identify the issue and date on which a response is required. A tax adviser can review the order before you make substantive admissions.
Calculate the possible deadline from communication of the direction
Section 75(3) of the CGST Act states that an order required to be issued pursuant to a direction of an appellate authority, appellate tribunal, or court is to be issued within two years from communication of that direction. The trigger is communication of the direction, not a date you estimate from the judgment or the date on which you happened to download a document.
That two-year rule must still be checked against the type of order, the procedural route, the relevant tax period, and the statutory version that applies to the case. Record evidence of when the direction reached the department or was formally communicated, such as a portal entry, covering letter, acknowledged email, or other official record. Also record when the order was communicated to you; those are different events and can matter for a later appeal.
Build a deadline log
- Write down the date on the judgment or appellate order.
- Identify the date and method by which the direction was communicated for section 75(3) purposes.
- Note the date on which the remand was assigned or served on you, if shown.
- Enter every reply, hearing, document-production, and fresh-order date stated in subsequent notices.
- Set an independent reminder well before the earliest date, and preserve the source for each entry.
Do not describe the two-year period as a universal deadline for every remand. If the underlying notice, statutory provision, or tax period changes the route, a professional should calculate the limitation from the complete file.

Use the original show-cause notice as a boundary
The remand order must be read with the show-cause notice (SCN) that started the demand. Section 75(7) caps the amount confirmed at the amount stated in the notice and bars confirmation on grounds other than those in the notice. The notice therefore supplies a second boundary even when the case has been sent back for a fresh decision.
Compare the notice and remand line by line
| Document element | What to check | Why it matters |
|---|---|---|
| Tax period and registration | Whether the fresh proceeding concerns the same taxpayer, registration, and periods | A remand does not automatically add a different period or registration |
| Amount | Tax, interest, and penalty amounts stated in the SCN | Section 75(7) prevents confirmation above the amount in the notice |
| Grounds | Each allegation relied on to deny or recover ITC | A fresh order should not confirm a demand on a ground outside the notice |
| Relief directed | The exact issue the appellate authority sent back | The officer should decide the remitted question rather than substitute an unrelated inquiry |
If the fresh notice or hearing letter introduces a new ground, identify it in writing and explain how it differs from the SCN. The legal response will depend on the documents and any later statutory amendment; do not assume that a change in wording is harmless or automatically invalid.

Understand the special section 75(2) conversion
Section 75(2) creates a specific conversion route. It applies when an appellate authority, appellate tribunal, or court concludes that a notice issued under section 74(1) is not sustainable because fraud, wilful misstatement, or suppression of facts to evade tax was not established. In that defined situation, the proper officer must determine the tax as if the notice had been issued under section 73(1).
This is not the automatic result of an ITC remand. First identify whether the appellate decision actually makes the section 74 finding described in section 75(2). If it does, compare the section 73 conditions and limitation rules with the tax period and the original notice. GST Council explanatory materials state that the section 73 route and its time limits constrain what may be redetermined and that proceedings may have to be dropped when the relevant section 73 limitation has already expired.
Because the CGST Act has been amended and limitation provisions can differ by period and proceeding, calculate the result against the text in force for the relevant tax period. Do not convert a general direction to reconsider ITC into a section 75(2) case without the required finding.

Prepare a focused reply and evidence bundle
A remand response should answer only the open issues, but it should do so document by document. Start with an index that mirrors the remand order and SCN. For each allegation, state the position, identify the evidence, and explain the conclusion you want the officer to reach.

The following is a practical preparation list, not a universal statutory document list. Include only material that relates to the disputed ground and period:
- Copies of the remand order, SCN, earlier adjudication order, appeal papers, and prior replies.
- Return extracts and an invoice-level ITC reconciliation for the relevant tax periods.
- Tax invoices, debit or credit notes, purchase orders, delivery records, and goods-receipt or service-completion evidence.
- Proof of payment and accounting entries where payment or consideration is disputed.
- Supplier details and available supplier-return or registration information relevant to the allegation.
- Reconciliations explaining differences between books, returns, and auto-populated statements.
- A schedule identifying documents already filed and documents filed for the first time.
Number files consistently and explain any missing record. If a document is unavailable, say who controls it, what steps were taken to obtain it, and what alternative evidence supports the same fact. Avoid sending an unindexed data dump that makes it difficult to identify the evidence for each invoice.
Hearing rights and how to preserve participation
Section 75(4) provides an opportunity of hearing when the proper officer contemplates an adverse decision and also when the person chargeable requests a hearing in writing. The remand order or subsequent notice may set out a particular process, so follow that process and make a written hearing request if you want to ensure the request is recorded.
Before and during the hearing
- Submit the indexed reply and evidence before the stated deadline, using the prescribed portal or delivery method.
- Request a hearing in writing where appropriate and keep the acknowledgment.
- Prepare a short issue list so each remitted question is addressed in sequence.
- Ask for a reasonable opportunity to answer any new document or allegation that appears during the proceeding.
- After the hearing, send a concise written note recording the submissions made and documents handed over.
Keep portal acknowledgments, emails, hearing notices, attendance details, uploaded files, and written follow-ups. If the portal fails, preserve screenshots or error messages and use the alternate method permitted by the notice. A complete participation record is important if the fresh order says that evidence was not filed or that an opportunity was not used.

What the fresh order must contain
Section 75(6) requires the proper officer’s order to set out the relevant facts and the basis of the decision. The statutory wording is: “The proper officer shall, in his order, set out the relevant facts and the basis of his decision.” A remand order may also require a speaking order, and the fresh decision should address the directions rather than merely reproduce the earlier order.
Audit the order against four documents
| Comparison | Questions |
|---|---|
| Remand order versus fresh order | Did the officer decide every issue actually remitted, follow mandatory directions, and avoid deciding issues expressly excluded? |
| SCN versus fresh order | Are the confirmed grounds and amount within the notice’s allegations and ceiling? |
| Reply and evidence versus findings | Does the order identify and answer material submissions and explain why relied-on evidence was accepted or rejected? |
| Dates and statutory route | Was the order issued within the applicable period calculated from communication of the direction, and was the correct section 73, 74, or other route used? |
A conclusion that simply repeats “ITC is inadmissible” without addressing the remitted issue, the evidence, and the reasons may be difficult to reconcile with the statutory requirement for relevant facts and the basis of decision. Whether that defect supports a remedy depends on the order’s wording and the applicable appeal or judicial-review route.
If the fresh order still appears defective
Do not rely on a general objection that the case was remanded. Identify the precise mismatch and preserve it promptly:
- The officer decided an issue outside the remand or ignored an issue the order required.
- The demand exceeds the amount in the SCN or rests on a ground not stated there.
- A material document or written submission is not considered.
- The order gives conclusions without relevant facts or a discernible basis.
- The order was made after the applicable statutory period, measured from the correct communication date.
- The section 75(2) conversion was used without the required finding, or section 73 limitation rules were not applied.
Request the complete order and its communication record, then check the available appeal deadline and any pre-deposit or filing requirements under the applicable law. A GST tax adviser or counsel can compare the four documents and calculate limitation from the actual record; do not wait until the appeal period is nearly over.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsCommon mistakes after an ITC remand
Assuming the original demand has disappeared
A remand usually leaves the dispute alive until the fresh order is passed. Continue to monitor notices, hearings, recovery communications, and appeal dates unless a specific stay or final disposal changes that position.
Best Value
Filing the old reply unchanged
The earlier reply may not answer the precise question remitted. Rework it around the operative directions and identify new evidence or clarifications separately.
Missing the communication date
Using the judgment date instead of the date the direction was communicated can produce the wrong section 75(3) calculation. Keep documentary proof of both communication and service.
Turning the remand into a new case
Do not volunteer unrelated periods, allegations, or admissions. Respond to the SCN and remand scope while reserving your position on anything outside them.

Failing to preserve a hearing request
An oral request that is not recorded is hard to prove. Make the request in writing and retain the acknowledgment.
A practical timeline
- Day 1–7: Obtain the signed remand order, SCN, prior order, appeal record, and communication proof. Mark open and closed issues.
- Day 8–14: Build the deadline log, request missing records, and prepare an invoice-level reconciliation limited to the remitted period and grounds.
- Before the notice deadline: File an indexed reply, request a hearing where appropriate, and list every annexure.
- At the hearing: Address each issue in order, respond to new material, and preserve attendance and submission records.
- After the hearing: Send a short written confirmation of submissions and retain portal or delivery proof.
- On receipt of the fresh order: Compare it with the remand order, SCN, reply, evidence, dates, and statutory route; then calculate any appeal deadline immediately.
Bottom line for taxpayers
The remand order is the starting map, not the answer to the ITC dispute. Read its operative directions with the original SCN, calculate the applicable period from the documented communication date, file evidence matched to each open allegation, request and attend the hearing when the law and notice provide for it, and test the fresh order for scope, notice limits, reasons, and limitation. Only the resulting order—and any further appeal—determines whether the disputed ITC or demand ultimately survives.
