Seth Green’s Bored Ape NFT, #8398, was reportedly stolen in a phishing incident just days before it was due to feature in his planned television project, White Horse Tavern. Green called the ape Fred. Later in 2022, reports said it had been returned to him, but the available coverage does not establish whether the show was ultimately released.
What was stolen from Seth Green?
In May 2022, Green said he had been phished and that four NFTs were taken: Bored Ape Yacht Club (BAYC) #8398, two Mutant Apes, and a Doodle. The Bored Ape was the one tied to his television plans. It was a digital artwork associated with a blockchain token—not a physical ape, and not an image file that was erased.

Green had named BAYC #8398 Fred. At VeeCon, he described buying the ape in July 2021 and spending months developing it as the star of a show. Futurism relayed his account that Fred was taken days before his planned debut. Futurism’s May 2022 report also reproduced Green’s contemporaneous post saying he had been phished and four NFTs stolen.

Green planned to make Fred a character in White Horse Tavern. The reported theft therefore raised a practical question beyond who controlled the token: who could use the ape’s artwork under the NFT project’s license while the token had changed hands?

- NFT Crypto Fashion design. Bitcoin, crypto, and blockchain technology markets are NOT the same thing as tulip-mania. NFT's though...they kind of are. So why blow 50 ETH on a JPEG when you can just buy a tulip adorned piece of clothing. Think about it.
- NFT inspired items to wear. All items are non-transferable to the Metaverse.
- Lightweight, Classic fit, Double-needle sleeve and bottom hem
Yuga Labs’ BAYC terms say that, subject to continued compliance, Yuga grants the owner of a purchased Bored Ape artwork an unlimited, worldwide license to use, copy, and display it to create derivative works. The terms also reserve Yuga’s other trademarks and intellectual-property rights. That language helps explain why control of the token mattered to Green’s project, but it does not itself resolve the legal consequences of a theft or a transfer to a downstream buyer.
In particular, the license should not be reduced to the claim that whoever held the token automatically owned all copyright in the art. The license is defined by Yuga’s terms, including its conditions and limits; the terms page is not a court ruling on Green’s dispute. An SEC filing excerpt describing then-current BAYC terms and NFT phishing campaigns offers background on the ecosystem, not an SEC finding about the merits of this incident: SEC filing excerpt.

Was Fred returned, and did the show come out?
Futurism reported that the ape was later bought by a pseudonymous collector known as DarkWing83. In June 2022 coverage, Green said he had connected with the buyer. By August, The Block reported that the ape had been returned and that Green was launching the project. The Block’s August 2022 report documents that reported return and launch plan.
Those reports establish a 2022 recovery and launch announcement, not a verified final release. The available coverage does not establish whether White Horse Tavern was completed, canceled, or ultimately released.
