These are separate entitlements. Which apply depends on your route, whether the flight was cancelled or delayed, how late you reached your final destination, and the cause of the disruption.
Does EU passenger-rights law cover my flight?
Regulation (EC) No 261/2004 generally covers a flight departing from an airport in the EU, regardless of the operating airline. It also covers a flight arriving in the EU from outside the EU when that flight is operated by an EU-licensed airline. The applicable rules can depend on the route and carrier, so an inbound flight on a non-EU airline is not automatically covered by this regulation.

For a code-share or a ticket sold by one airline but flown by another, contact the operating airline—the carrier that operated or was due to operate the flight. The European Commission’s Your Europe passenger-rights FAQ, last checked on 14 September 2026, identifies the operating carrier as responsible even when another airline sold the ticket, subject to the applicable arrangement.
What are my rights if my flight is cancelled?
If the regulation applies, the operating airline must offer you a choice among three options. Choose the one that best fits your plans; a refund and rerouting are alternatives, not payments you automatically receive together.

- Reimbursement: Get a refund for the part of the journey not made. If the cancellation makes the trip pointless, you may also be entitled to a return flight to your first point of departure at the earliest opportunity.
- Rerouting as soon as possible: Travel to your final destination on an alternative flight under comparable transport conditions.
- Rerouting later at your convenience: Travel on a later date that suits you, subject to seat availability.
If you choose reimbursement, the ticket refund is due within seven days under the current rules. If you choose rerouting and must wait, the airline may also owe care while you wait; that assistance is separate from any fixed compensation claim.
My flight was delayed: when do care and a refund apply?
For a delay, the departure-delay thresholds for care depend on flight distance. The airline must provide meals and refreshments proportionate to the wait, and a way to communicate, once the relevant threshold is reached. If an overnight stay becomes necessary, care includes hotel accommodation and transport between the airport and accommodation.

If departure is delayed by at least five hours, you may choose reimbursement for the journey not made and, where relevant, a return flight to your first point of departure. That five-hour threshold concerns departure; it is not the test for fixed compensation after a long delay.

My flight was delayed and I arrived 4 hours late. Am I entitled to financial compensation?
Possibly. For compensation after a long delay, the key time is when you arrive at your final destination, not just how late the flight departed. The European Commission’s Your Europe FAQ puts it this way: “YES – if you arrive at your final destination with a delay of 3 hours or more, you may be entitled to financial compensation, as long as the delay was not caused by extraordinary circumstances.” A four-hour arrival delay clears that time threshold, but does not by itself establish that compensation is due: the route must be covered, and the applicable cause and eligibility rules still matter.
The standard statutory amounts in Regulation (EC) No 261/2004 are:

These are the regulation’s amounts, not a general promise that every passenger receives the listed sum. Where the airline offers rerouting and you reach your final destination within specified time windows, the regulation allows compensation to be reduced by 50 percent. The European Commission’s Q&A on the adopted revision says the three-hour threshold and these amounts are maintained in that revision.

Can I get compensation for a delayed flight, or only for a cancellation?
Compensation is not limited to cancellations. A long arrival delay can qualify under the three-hour test described above, subject to the same coverage, cause and eligibility considerations. For a cancellation, compensation is a separate question from your choice of reimbursement or rerouting: whether you were told about the cancellation in time and whether extraordinary circumstances caused it can affect whether fixed compensation is payable.

When can extraordinary circumstances prevent compensation?
The operating airline must establish that extraordinary circumstances caused the disruption and could not have been avoided even if it had taken all reasonable measures. The label the airline gives an event is not decisive; the circumstances and their causal connection to the delay or cancellation matter.
- Weather incompatible with safe operation, air-traffic-management decisions and some strikes by people outside the airline may qualify, depending on the facts.
- A strike by the airline’s own staff over employment demands is not treated in the same way as an external air-traffic-control or airport-staff strike in the Commission FAQ.
- A technical issue is not automatically extraordinary. A defect found during normal maintenance or caused by inadequate maintenance does not qualify merely because it is technical. A hidden manufacturing defect identified by the manufacturer or a competent authority, or damage caused by sabotage, may be different.
An extraordinary circumstance may defeat a claim for fixed compensation; it does not, by itself, erase an otherwise applicable choice of reimbursement or rerouting, or the right to care while waiting.

If I am travelling from outside the EU, do I have any rights if my flight is cancelled?
You may have rights under Regulation 261/2004 if your flight arrives in the EU from outside the EU and is operated by an EU-licensed airline. If it is operated by a non-EU airline, this regulation generally does not cover that inbound flight. A departure from an EU airport is generally covered even when the operating airline is not EU-licensed. Check the operating airline and the flight’s departure and arrival points before relying on the regulation.
How do I claim, and is there a time limit for legal action?
- Keep your records: Save the booking confirmation, boarding pass, disruption notice and receipts for necessary expenses.
- Write to the operating airline: Explain whether you are claiming reimbursement, rerouting, care expenses or fixed compensation, and ask the airline to state the disruption’s cause. These are distinct requests; identify which remedy you are seeking.
- Escalate if needed: If the airline’s explanation or response is unsatisfactory, contact the relevant national enforcement body.
- Check the national deadline: EU law does not set one uniform time limit for bringing a compensation case to court. The limitation period depends on national law and differs between EU countries; ask the relevant national enforcement body or consumer centre.
The Commission FAQ says EU law does not set a deadline for the airline to pay compensation. That is distinct from the seven-day deadline for a ticket refund when you choose reimbursement.
Have the revised EU rules taken effect?
The Council of the European Union gave final clearance to revised air-passenger rules on 13 July 2026. Its notice says the update enters into force “12 months and 20 days after the publication in the Official Journal.” The application date therefore depends on that publication; the Council’s clearance alone does not make the revised provisions applicable.
The European Commission’s explanatory Q&A describes future changes including self-rerouting reimbursement if the airline fails to provide rerouting within three hours, reimbursement capped at up to 400% of the ticket price, and new information and claims procedures. Do not treat those provisions as current rights unless the revised rules’ actual application date has arrived. For a particular disruption, use the rules applicable on the travel date.
