While it is engaged, the human driver does not have to supervise continuously; the driver must remain available to take over when the system requests it or can no longer operate.
What does Level 3 driving mean?
SAE International calls Level 3 conditional driving automation. The system performs the driving task within its defined conditions. If it reaches a point where it cannot continue, it requests that the human take over. NHTSA describes the role as “System Drives, You Must Be Available To Take Over Upon Request.” NHTSA’s Automated Vehicle Safety page explains that a prompted driver must resume all aspects of the driving task.

Level 3 is not a promise that a vehicle can drive on every road or in every situation. SAE’s 2021 explanatory chart says these features “can drive the vehicle under limited conditions and will not operate unless all required conditions are met.” Its “traffic jam chauffeur” example illustrates the category; it does not establish that a particular product is available today. Not in the same way as with Level 2 assistance: while a Level 3 feature is engaged and operating as intended, the human does not continuously supervise the driving task. But the driver remains the fallback. You must be available to respond when the system requests a takeover or an evident malfunction prevents it from operating. Level 3 therefore does not mean you can sleep, leave the driver’s seat, or disregard the vehicle’s instructions or applicable laws.
How is Level 3 different from Levels 2 and 4?
| Level | What the system does | Human role |
|---|---|---|
| Level 2 | Supports steering and speed control together. | Continually supervises and intervenes when needed. |
| Level 3 | Performs the driving task under defined conditions. | Remains available to take over after a request or system failure. |
| Level 4 | Performs automated driving under defined conditions. | Not needed to mitigate risk within those conditions. |
These levels describe the division of driving responsibilities, not a guarantee about a specific vehicle or feature. SAE’s Level 3 topic summary presents Level 3 as automated driving under defined conditions and distinguishes it from the surrounding levels.
Does the Level 3 label apply to the whole vehicle?
No. The level describes the feature that is active, not the vehicle in every situation. A vehicle may have different automation features, and its level can depend on which one is engaged. A car with a Level 3 feature does not therefore operate at Level 3 on every trip or in every driving mode.

SAE’s levels are a technical, descriptive taxonomy—not a legal classification or operating permission. The label alone does not establish where a feature may be used, what local rules require, or whether a given vehicle is approved for a particular road. SAE’s summary explains this distinction in Automated Driving: Summary of SAE International’s Levels of Driving Automation for On-Road Vehicles. Follow the vehicle’s instructions and the laws that apply where you drive.
