Protection takes a reliable record of the species and its habitat, a clear understanding of which laws and authorities apply, and measures that address the activities threatening the site. Those measures must be monitored and adjusted as scientists learn more.
Why discovery is only the beginning
A scientific description gives a species a name and a place in the scientific record; it does not, by itself, prevent damage to the animal or its habitat. Nor does discovery alone establish that a species is rare, threatened, or legally protected. Those conclusions depend on evidence about where it lives, how it relates to its environment, what pressures it faces, and which authorities have power over the location.

This is especially important in the deep sea, where a survey may reveal organisms and ecological relationships that were not previously documented. If an activity changes a habitat before scientists have recorded its starting condition, it can become difficult to tell what was lost, how extensive the damage was, or whether recovery is occurring. The practical task is therefore to move from an initial observation to a usable conservation baseline, and then connect that evidence to rules capable of preventing or limiting harm.
What scientists need to document first
Record the species in context
Identification is one part of the work. Researchers also need to describe the conditions in which the animal was found and the boundaries of its habitat: for example, the relevant seafloor features and the organisms or ecological relationships associated with the site. A record tied only to a specimen or a single observation may not show whether the species is confined to that location, occurs across a wider area, or depends on a particular habitat feature.

Surveys should preserve enough information to allow later observations to be compared with the initial record. That means documenting where and how observations were made and what environmental conditions were present. The precise survey design will depend on the site and species; there is no single sampling recipe in the sources cited here that applies to every deep-sea discovery.
Establish a pre-impact baseline
A baseline is a documented account of conditions before a proposed disturbance, or as early as possible when pressures already exist. It gives scientists and decision-makers a reference point for evaluating later change. Without it, a decline or habitat alteration may be hard to attribute to a particular activity, and a finding that no change was detected may reflect inadequate prior knowledge rather than safety.
The need for this foundation is longstanding. In a resolution adopted in 1981, IUCN recommended comprehensive ecological surveys before commercial deep-sea mining and the designation of baseline reference areas. Its May 2022 deep-sea-mining brief likewise calls for rigorous, transparent impact assessments grounded in comprehensive baseline studies. These are IUCN recommendations and policy positions, not proof that every jurisdiction already requires the same survey standard. See IUCN Resolution 15/18 and the IUCN deep-sea-mining brief.

The next question is where the species was found in legal, not just geographic, terms. The relevant distinction may be whether the site lies within a state’s maritime zones, on a continental shelf, or in the international seabed Area beyond national jurisdiction. The water column above a location and the seabed beneath it can have different legal status, so identifying one does not settle the governance of the other.

NOAA describes distinct regimes for seabed areas under coastal-state jurisdiction and the international Area. For the Area, the International Seabed Authority (ISA) facilitates international cooperation in mineral development for parties to the UN Convention on the Law of the Sea. Separately, the United States’ Deep Seabed Hard Mineral Resources Act addresses deep-seabed mining activities by U.S. citizens beyond national jurisdiction. Those examples illustrate why the site, the activity, the states involved, and the applicable legal instrument all matter; they do not establish that one national law applies everywhere. NOAA’s overviews of seabed activities and deep-seabed mineral mining include a January 2026 regulatory update.
For a real discovery, the location should be mapped precisely enough to determine which jurisdictional boundaries and authorities are relevant. That is a necessary legal and administrative step before asking who can authorize an activity, set conditions, establish an area-based measure, or enforce a restriction.
Identify the threats and assess them together
Protection should respond to the pressures that actually reach the species and habitat, not just the activity most visible in a headline. Deep-sea mining is one important concern discussed by IUCN, but the relevant pressures at a particular site may also include fishing, shipping, pollution, noise, light, or climate-related change. Which ones matter, and how they interact, require site-specific evidence.

Suspended sediment can travel as plumes, settle on animals, or affect filter feeders. Noise, vibration, light, and pollution are additional concerns identified in IUCN’s 2022 issue brief. Distance from equipment alone therefore cannot be treated as proof that a habitat or species is unaffected; assessment needs to consider how a disturbance can spread and which organisms may be exposed.

An environmental impact assessment should use the baseline to examine the proposed activity, alternatives, plausible effects, and cumulative pressures. Cumulative assessment matters because multiple activities or disturbances can affect the same ecological features, even where each is considered separately. The process should be transparent and include monitoring plans and public consultation where applicable. IUCN’s brief supports comprehensive risk assessment, effective protection, the precautionary principle, polluter-pays, consultation, and transparent governance. These should be described as IUCN’s advocated conditions, not as universally binding legal duties in every jurisdiction.
When information is incomplete, uncertainty is a reason to make risk visible in the decision, not to silently treat missing observations as evidence of no harm. The assessment should state what has been measured, what remains unknown, what assumptions are being used, and how monitoring could detect a problem in time to respond.
Choose protections by their actual rules, not their label
A marine protected area (MPA) or another area-based management tool can protect a geographic place, but the designation alone does not tell a reader what activities are allowed. NOAA notes that MPAs range from declarations that protect a resource to places with extensive regulation, and that they can have different objectives and legal bases. The practical question is what the measure prohibits, restricts, or permits, and whether those provisions can be enforced. NOAA’s MPA overview explains this range.

When comparing a proposed area-based measure with other options, examine the feature it is meant to protect, the area it covers, permitted activities, ecological connectivity, monitoring, and enforcement. A boundary that omits connected habitat or leaves a damaging pressure untouched may not provide the intended protection. Conversely, the right combination of a protected area and activity-specific rules will depend on the species, site, and responsible authorities; no designation is automatically sufficient for every discovery.

IUCN’s guidance on areas beyond national jurisdiction says fully and highly protected areas provide the most certain benefits, while broader area-based measures may be needed as species, ecosystems, and human uses shift. This points to a real design choice: stricter protection can offer clearer limits, while wider or more adaptable tools may be needed to address mobile ecological features and changing pressures. The appropriate measure must be matched to the conservation objective and implemented by bodies with authority over the relevant activity. See IUCN’s overview of governing areas beyond national jurisdiction.

The Agreement on Marine Biological Diversity of Areas Beyond National Jurisdiction, known as the BBNJ Agreement, entered into force on 17 January 2026. Its subjects include marine genetic resources and benefit sharing, area-based management tools including MPAs, environmental impact assessments, and capacity-building and technology transfer. The United Nations Secretary-General marked the milestone by stating, “The Agreement on Marine Biological Diversity of Areas Beyond National Jurisdiction, the BBNJ Agreement, is now in force.” The official UN BBNJ Agreement portal provides agreement information; the Secretary-General’s dated 17 January 2026 statement records the entry into force.
That date is a legal milestone, not a site-specific conservation decision. It does not mean that every newly found species is automatically covered by an MPA, that every state is a party, or that a particular location has already received new restrictions. The first Conference of the Parties is scheduled for 11–22 January 2027, according to the UN agreement portal. How the agreement’s institutions and party obligations apply to any particular location must be assessed in context, alongside the rules that govern the seabed and relevant sectors.
This distinction matters because international agreements, domestic laws, and sectoral rules do different jobs. A conservation framework can provide processes and tools, but a real protection outcome still depends on the relevant authorities adopting measures, states and other actors meeting applicable obligations, and restrictions being monitored and enforced.

Monitor results and revise measures when evidence changes
Designation or authorization is not the end of conservation work. Monitoring should be designed around the baseline and the risks identified in the assessment, so later observations can show whether the species, habitat, or relevant ecological conditions have changed. A monitoring plan is more useful when it makes clear what will be observed, how findings will be evaluated, and what decision or response could follow if an impact is detected.
New evidence may change the understanding of a species’ range, habitat needs, or exposure to human activity. Area-based measures may need revision as species and ecosystems shift or human use changes, a point reflected in IUCN’s guidance on areas beyond national jurisdiction. Adaptive management is not a substitute for effective initial protection: it is the process of using new observations to maintain, strengthen, or adjust measures rather than assuming the original boundaries and rules will remain suitable indefinitely.
Responsibility also needs to be explicit. For each measure, the relevant authorities should be identifiable, as should the parties responsible for monitoring and compliance. If no institution can adopt or enforce a proposed restriction, a conservation label alone will not deliver it.
Why offsets cannot stand in for protecting an unknown species
Restoring or preserving a different habitat is not an established way to replace a deep-sea species lost through damage to its home. In a 2017 statement, IUCN warned that out-of-kind restoration or preservation cannot compensate for the loss of unknown deep-sea species. The statement also quoted Kristina Gjerde, then identified as a senior advisor on High Seas issues in IUCN’s Global Marine and Polar Programme: “The new rules governing deep sea mining must take its full costs to society and the environment into account,” The quotation reflects a dated IUCN statement, not a current universally binding legal requirement. Read the 7 June 2017 IUCN statement.
The implication is practical: mitigation claims should not be used to imply that an unknown organism or its ecological role can simply be recreated elsewhere. Prevention, impact avoidance, and protections tailored to the actual species and habitat are especially important when replacement cannot be demonstrated.
A practical sequence from discovery to protection
- Document the finding: identify the species as far as the evidence allows, record its habitat and ecological context, and retain location and observation details for future comparison.
- Build the baseline: establish pre-impact ecological information and reference conditions adequate to detect change, while clearly describing remaining gaps.
- Map jurisdiction: determine the precise location and whether relevant seabed, water-column, or activity rules fall under national, international, or sectoral authorities.
- Assess pressures: identify activities affecting the site, examine pathways such as sediment plumes and noise, and consider alternatives and cumulative effects transparently.
- Select enforceable measures: decide whether an MPA, another area-based tool, activity-specific controls, or a combination fits the conservation objective; specify actual restrictions and responsible authorities.
- Monitor and adapt: compare observations with the baseline, make findings available through appropriate processes, and revise measures when evidence or conditions change.
The sequence is not a guarantee that every newly discovered species will require the same legal instrument. It is a way to ensure that scientific uncertainty, location, activity-specific risk, and enforceability are addressed before the opportunity to prevent harm is lost.
