The solicitation and the clauses incorporated into the contract determine which requirements bind the contractor, which systems and information are in scope, and what exceptions apply.
What does a federal cybersecurity contract cover?
It can set requirements for protecting information and systems used to perform the work, reporting cyber incidents, demonstrating security status, protecting privacy, and managing restricted products or suppliers. These are related but distinct kinds of contract obligations: an assessment or certification requirement does not automatically satisfy every safeguard, reporting, privacy, or supply-chain term.

FAR 40.000(a) states, “This part addresses broad security requirements that apply to acquisitions of products and services.” FAR Part 40 covers information-security and supply-chain-security policy, including but not limited to information and communications technology. Related requirements also appear in FAR Parts 4, 24, and 46. The specific solicitation and executed contract—not the general policy alone—show which clauses apply to a particular contractor.

What baseline safeguards apply to FCI?
FAR 52.204-21 applies to a covered contractor information system that is owned or operated by a contractor and processes, stores, or transmits FCI. The clause defines FCI as information not intended for public release that the Government provides, or that a contractor generates for the Government, under a contract to develop or deliver a product or service. It excludes public information and simple transactional information, such as information needed to process payments.

- HIGH SPEED CONNECTIVITY: Supports an aggregate throughput of up-to 4.3 Gbps, maintaining high-speed browsing and streaming performance for up to 128 devices.
The clause specifies basic safeguards that include access control, authentication, media protection, system monitoring, malicious-code safeguards, and scanning. It does not displace other agency or CUI safeguarding requirements that may also apply.
When a subcontractor may have FCI in or transiting through its system, the prime contractor must flow down the substance of the clause as specified in FAR 52.204-21. The clause states a COTS exclusion for that flowdown. Check the actual clause and subcontract circumstances rather than assuming that every supplier has the same obligations.

What extra requirements can apply to DoD contracts?
DoD solicitations and contracts may include requirements beyond the general FCI baseline. DFARS 204.7304 prescribes use of provisions and clauses addressing covered defense information safeguards, cyber incident reporting, and NIST SP 800-171 DoD assessments, subject to stated applicability rules and exceptions. For example, the prescribed use of DFARS 252.204-7012 excludes contracts solely for commercial off-the-shelf (COTS) items. Other related provisions and the assessment clause have their own applicability and COTS exceptions, so review each clause rather than extending one exception to the whole award.

The contract’s incorporated text determines the concrete duties. DFARS assessment rules also state that a current assessment score is to be posted in the Supplier Performance Risk System (SPRS) before award or exercise of an option for contractors required to implement NIST SP 800-171. Confirm the clause version and its conditions in the solicitation and current official DFARS text.

When does CMMC apply, and what does it cover?
CMMC is a DoD framework, not a universal label for federal cybersecurity requirements. Where DFARS 252.204-7021 applies, the contractor must maintain the level or higher specified by the contracting officer for information systems used in contract performance that process, store, or transmit FCI or CUI. The required level is the one specified for the solicitation or contract; there is no single level that applies to every DoD award.
The clause also addresses annual affirmations in SPRS, system identifiers, subcontractor affirmations, and flowdown of the appropriate CMMC level to relevant subcontractors. A conditional status may involve completing a plan of action and milestones to reach final status. Use the solicitation and clause to identify the required status and the systems it covers; a CMMC status alone does not establish that every other contract obligation has been met.

Can a contract include privacy and system-of-records safeguards?
Yes. FAR 39.103 directs agencies acquiring IT to include appropriate IT security policies and requirements, with contracting officers consulting the requiring official to determine suitable standards. For described contracts to design, develop, or operate a system of records using commercial IT or IT support services, FAR 39.105 calls for agency conduct rules, anticipated threats and hazards, a description of safeguards, and a Government inspection program to check that safeguards remain effective and address new threats and hazards. FAR 39.106 provides for a Privacy or Security Safeguards clause in specified IT contracts.

These terms concern privacy and the handling of systems of records as well as technical security. Their applicability depends on the type of IT work and the contract terms, not simply on whether a contractor handles federal information.

How can supply-chain orders affect performance?
FAR 52.204-28 addresses applicable Federal Acquisition Supply Chain Security Act (FASCSA) orders. The contract identifies applicable orders in the relevant request or notice. During performance, if the contracting officer notifies the contractor that an applicable order applies, the contractor must promptly make necessary changes to remove a covered article or a product or service produced or provided by a source subject to that order. This requirement can affect components and suppliers as well as information-handling practices.
Quick Recap
How should you review a cybersecurity solicitation?
- Read the solicitation and the contract’s clause list. Record the applicable FAR clauses, agency-supplement clauses, incorporated provisions, stated exceptions, and any clause versions identified in the documents.
- Map information to systems. Identify whether the work involves FCI, CUI, covered defense information, or a system of records, then identify which contractor systems process, store, or transmit it and whether any system is operated on the Government’s behalf.
- Check status and evidence requirements. Determine whether the documents require a NIST SP 800-171 DoD assessment, an SPRS record, a specified CMMC level, or an affirmation, and note when each must be in place.
- Trace the obligations to subcontractors and suppliers. Review what information each party may handle, which clauses must flow down, and whether applicable supply-chain orders affect a source or component.
- Confirm the final terms with the contracting officer. If the solicitation, clause list, system scope, or an exception is unclear, resolve it before relying on a general checklist or treating an assessment as proof that all contract terms are satisfied.
