What Copyright and Modding Rules Apply to Decompiled Video Games?

Decompiling a game does not create a blanket right to mod it. Copyright, anti-circumvention rules and the game’s terms must be considered separately.

There is no blanket rule that makes decompiling or modding a video game lawful or unlawful. The answer depends on three separate questions: whether the mod copies protected expression, whether the method used to inspect or access the game bypasses a technological protection, and whether the game’s licence or platform terms permit the activity. Jurisdiction, the particular game, the material used, the purpose and the way the mod is shared all matter.

Which rules can apply to a decompiled game?

Question What it concerns Why it is separate
Copyright Copying or adapting protected code or other expressive material, such as artwork, music, dialogue or text. A mod can raise copyright questions even if it was made without bypassing an access control.
Anti-circumvention Bypassing a technological measure that controls access to a copyrighted work. In the United States, DMCA section 1201 can apply separately from copyright infringement. A use that is not infringing is not automatically exempt from every anti-circumvention restriction.
Licence and platform terms The rules for the particular game, account, service or platform. Terms may address reverse engineering, modifications, online play or distribution. Their content and enforceability depend on the specific terms and applicable law.

These are different legal questions, not steps in a single test. A conclusion about one does not resolve the others.

What parts of a game can a mod implicate?

In the United States, 17 U.S.C. § 106 gives copyright owners exclusive rights that include reproducing a work and preparing derivative works, subject to statutory limitations. A mod that incorporates or adapts protected game expression may therefore raise a copyright issue. The relevant facts include what was copied or changed and how much protected material the mod uses; not every modification necessarily involves the same material or use.

Games are not just program code. A mod could involve code, graphics, music, text, characters or other expressive content. Owning a copy of a game does not, by itself, establish permission to extract, reuse or distribute its code or assets.

For software, Article 1(2) of EU Directive 2009/24/EC distinguishes protected expression from ideas and principles underlying program elements, including interfaces. That software-specific rule should not be read as saying that game artwork, music, audiovisual material or other game content is unprotected. It also does not settle the rules for every country: EU directive provisions are implemented through national law.

When does EU law allow decompilation?

Article 6 of Directive 2009/24/EC provides a narrow exception to rightsholder authorization. It concerns reproduction of code and translation of its form when those acts are indispensable to obtain information needed for interoperability of an independently created program, and only if the directive’s conditions are met. It is not a general permission to decompile a game for any modding purpose.

The conditions include that the person is entitled to use a copy of the program, the necessary interoperability information is not already readily available, and the decompilation is limited to the parts necessary for that purpose. Information obtained under the exception cannot be used for other purposes, improperly disclosed, or used to develop a program substantially similar in expression or to commit another copyright infringement.

Article 5(3) separately allows a person entitled to use a copy to observe, study or test the program’s functioning, while performing acts they are entitled to perform, to determine the ideas and principles underlying its elements. The directive also addresses necessary use and backup copies. These provisions do not establish that any particular decompilation, mod or distribution is permitted under national law.

How do U.S. anti-circumvention rules affect modding?

DMCA section 1201 generally prohibits circumventing technological measures used to prevent unauthorized access to copyrighted works, including video games and software, as described by the U.S. Copyright Office. Circumvention is a distinct issue from whether copying the game or making a particular mod infringes copyright.

Section 1201 has exceptions and a recurring process for adopting limited exemptions for particular classes of noninfringing use. An exemption applies only within its stated scope: the covered users, purpose, work and conditions matter. Do not assume that a general claim of fair use or noninfringement permits bypassing a game’s access controls.

The limited U.S. exemption for certain games with discontinued authentication

The current U.S. video-game exemption described in the applicable regulation is limited to specified conduct involving lawfully acquired complete games that require an external server for authentication when the copyright owner or its representative has stopped providing access to that server. It covers certain personal, local gameplay-restoration uses and qualifying preservation by libraries, archives or museums, subject to conditions such as limits on commercial advantage and external distribution for the institutional provision.

This is not a general exemption for ordinary modding, bypassing online services, or distributing game copies. Whether a specific activity fits the exemption depends on its exact circumstances and the regulation’s conditions.

Does fair use make a U.S. mod lawful?

Not automatically. Under 17 U.S.C. § 107, fair use is assessed case by case using four factors. The statute gives examples such as criticism, comment, news reporting, teaching, scholarship and research, but no label alone decides whether a mod is fair use.

Factor Questions to consider for a mod
Purpose and character What does the mod add or change, and is the use commercial or nonprofit and educational? A transformative purpose can matter, but calling a mod transformative or noncommercial does not decide the outcome.
Nature of the work What kind of copyrighted material is used? Consider the nature of the particular game material incorporated.
Amount and substantiality How much material was used, and how important is the portion taken in relation to the copyrighted work?
Market effect Could the mod substitute for the game or an authorized product, or affect a market for the work?

The factors are weighed together in the context of the particular use. Free distribution, personal use or educational intent alone does not establish fair use.

How to assess a specific mod before making or sharing it

  1. Identify the governing law. Establish where you are acting and which jurisdiction’s law may apply. The EU directive and U.S. statutes discussed here are examples, not a complete survey of national laws.
  2. Read the game’s rules. Check the game’s EULA or licence, its mod policy, and relevant platform terms for provisions about reverse engineering, mods, online play and sharing.
  3. Describe the conduct precisely. Separate inspecting or decompiling code from creating a mod, and separate private use from uploading, sharing or selling it.
  4. Inventory the material used. Identify whether the mod includes or adapts code, graphics, music, text, characters or other game expression, and how much it uses.
  5. Check for access controls. Determine whether your method bypasses a technological measure, and whether a specific legal exception actually covers your users, purpose and circumstances.
  6. Assess the intended distribution and impact. Consider whether the mod affects online services or could substitute for the game or another market, alongside the applicable copyright rules.
  7. Get advice for a consequential decision. If you plan to distribute or sell a mod, bypass a protection, or need a reliable answer about a particular game, consult a lawyer familiar with the relevant jurisdiction and the game’s terms.

These checks help identify the issues; they do not by themselves determine whether a particular project is lawful.
