What Are the Risks of Holding Stablecoins With a Custodian?

Custody adds counterparty, access and legal-claim risks that are separate from a stablecoin issuer’s reserve and redemption risks. Learn what to check in agreements, records and sub-custody terms.

Holding stablecoins with a custodian adds risks tied to the intermediary: a failure can delay access, complicate proof of ownership, or leave the customer uncertain about recovery. The outcome depends on the custody agreement, asset records, wallet arrangements, applicable law and whether another firm holds the tokens or keys. These are distinct from the stablecoin issuer’s reserve and redemption risks: a reliable custodian cannot guarantee an issuer can redeem tokens, and a sound issuer cannot guarantee access through a failing custodian.

How custody creates a separate risk from the stablecoin itself

A stablecoin has at least two relevant relationships. The issuer is responsible for the token’s backing and redemption arrangements. A custodian holds or controls the customer’s tokens, keys or both. A problem with either party can affect the holder differently:

  • Custodian trouble: account access or transfers may be interrupted, and it may take time or legal process to identify and return customer assets.
  • Issuer trouble: the token may face reserve, liquidity or redemption problems even if the custodian continues operating normally.

Neither a “custody” label nor a stablecoin’s name establishes what rights a customer has. The customer agreement and the law governing the specific entity and service matter.

What happens if the custodian fails?

If a custodian becomes insolvent, the practical questions are whether customer assets were kept apart from company property, whether records show each customer’s beneficial interest, and how the relevant law treats those assets. Poor or incomplete records can make it harder to identify balances and resolve claims; even where customer property is legally protected, access may be delayed.

In the United States, the enacted GENIUS Act includes a custody provision for specified payment-stablecoin reserves, collateral or issuance keys held by specified regulated custodians. It requires customer property to be treated as belonging to the customer and calls for separate accounting and segregation, subject to the Act’s terms and exceptions. It also provides for customer claims against a covered custodian to receive statutory priority as described in the Act. The statute separately addresses issuer insolvency. These provisions do not automatically apply to every token, provider, account or jurisdiction; applicability and implementing rules matter. Read the GENIUS Act text.

For covered virtual-currency entities, New York State Department of Financial Services guidance dated September 30, 2025 calls for customer virtual currency to be separately accounted for and segregated from corporate assets, both on-chain and in internal ledgers. It says customer currency may be held in individual wallets and ledger accounts, or in omnibus wallets and accounts that contain only customer virtual currency and make each customer’s beneficial interest evident. The guidance applies within its stated regulatory scope, not to every custodian. Read the DFS guidance.

How pooling and recordkeeping affect your claim

An omnibus wallet is a shared wallet; it is not, by itself, proof that customer assets have been mixed with the custodian’s own assets. The important distinction is whether the wallet contains only customer property and whether the custodian’s records reliably identify each customer’s share. New York DFS’s September 30, 2025 guidance describes both customer-specific wallets and customer-only omnibus wallets as possible structures, with corresponding ledger records and a clear audit trail.

Ask the provider these questions and look for answers in the agreement or disclosures:

  • Are customer tokens kept separate from company assets on-chain and in the custodian’s internal ledger?
  • Does the wallet hold only customer assets, or also the custodian’s own assets?
  • How often are internal balances reconciled against on-chain activity, and how are discrepancies handled?
  • What records would establish your beneficial interest if the custodian or another service provider failed?

Why sub-custody adds another counterparty

A custodian may rely on another firm to hold tokens or keys. That firm’s systems, controls, contract and insolvency can affect your access even if your direct provider remains solvent. New York DFS guidance expects covered custodians to conduct and document due diligence, assess risks and controls, and disclose relevant sub-custody terms and material risks to customers.

Find out which entity actually holds the assets or keys, where it operates and is regulated, and how the agreements allocate responsibility. Check whether the sub-custodian can assert a lien or set-off, and what happens if its records do not reconcile with the primary custodian’s records. An app balance alone does not answer these questions.

Can the custodian lend, pledge or otherwise use your tokens?

A safekeeping arrangement can differ substantially from a product that permits lending, pledging or reuse. Read the agreement for permission to transfer or use assets, any security interest or right of set-off, and the conditions under which withdrawals can be delayed or restricted. Do not assume that a product is custody in the legal sense just because its interface calls it a wallet or custody service.

New York DFS guidance says covered custodians should preserve customers’ equitable and beneficial interests and should not use customer virtual currency for their own purposes. It also addresses customer disclosures and sub-custody terms, including liens and set-off, with a limited qualification for ordinary fees and expenses. Those statements are specific to the guidance’s scope; they are not a universal rule for every provider or contract.

What operational and access failures should you consider?

Even without insolvency, access can be affected by service outages, account restrictions, compromised credentials or keys, transaction controls, or other operational failures. The Federal Reserve, FDIC and OCC’s joint statement of July 14, 2025 discusses existing risk-management principles for banks engaged in crypto-asset safekeeping. It says it creates no new supervisory expectations and reminds banks to operate safely and comply with applicable law. It does not quantify the likelihood of incidents or guarantee that customers will recover assets. Read the joint statement.

Self-custody changes, rather than removes, these risks. A hardware or software wallet that facilitates a customer’s own custody is treated differently under the GENIUS Act provision described above, but the user then has responsibility for protecting private keys, backups and recovery. Self-custody does not remove the stablecoin issuer’s reserve or redemption risk.

How issuer reserve rules fit into the picture

Some jurisdictions impose reserve and redemption requirements on certain stablecoin issuers. Those requirements concern the issuer and do not, by themselves, determine a customer’s rights against a custodian or resolve custodian insolvency.

MiCA Article 36 covers reserve requirements for issuers of asset-referenced tokens, including liquidity risk, legal and operational segregation of reserves, reserve disclosures and redemption procedures. It also requires independent reserve audits every six months. The article specifies that deposits in credit institutions in each referenced official currency cannot be less than 30% of the amount referenced in that currency; this is a regulatory threshold for the covered framework, not a measure of safety or loss rates. Do not assume every stablecoin falls into the asset-referenced-token category. Read MiCA Article 36.

Canada’s Department of Finance describes legislation introduced through the 2025 Budget Implementation Act that would require covered issuers to maintain reserves at least equal to tokens issued, hold them in cash or high-quality cash-like assets with a qualified custodian, segregate them and publish redemption policies. The page also describes a prohibition on representing stablecoins as deposits or as insured under a public deposit insurance system. These are requirements of the framework as described on that page, not universal properties of stablecoins; check its current legal status and effective dates. Read the Department of Finance overview.

United Kingdom

The FCA page for CP25/14 reports final rules and guidance published June 30, 2026, with application to cryptoasset firms authorised under FSMA on or after October 25, 2027. That future application date is jurisdiction- and time-specific; it does not establish the rights of a customer in another jurisdiction or under a different arrangement. Read the FCA page for CP25/14.

How to compare custody arrangements

What to examine What to establish
Customer’s legal interest Does the agreement say the tokens remain customer property? Does it describe custody, or a debtor-creditor relationship?
Segregation and accounting Are customer assets separated from company property? Are they held individually or in a customer-only omnibus wallet? How are ledger balances reconciled with on-chain activity?
Sub-custody Does another firm hold assets or keys? Is it identified, and are its terms, controls and risks disclosed?
Use and encumbrances Can assets be lent, pledged or reused? Are liens, set-off rights or other claims permitted?
Access and withdrawal What conditions, controls or delays can affect transfers or withdrawals?
Issuer and token What reserve and redemption disclosures apply? Is the customer eligible to redeem directly with the issuer?
Law and supervision Which legal entity, jurisdiction and rules govern this service and asset?

What to verify before depositing stablecoins

  1. Identify the legal entity. Check the agreement for the counterparty’s full legal name and governing law, rather than relying on an app or brand name.
  2. Read the property and use terms. Look for the stated ownership interest, any right to lend, pledge or transfer tokens, and any liens, set-off or withdrawal conditions.
  3. Check the custody structure. Determine whether assets are held in individual wallets or customer-only omnibus wallets, and how customer balances are recorded and reconciled.
  4. Trace sub-custody. Find out whether another firm holds tokens or keys, and review the disclosed responsibilities and failure arrangements.
  5. Assess issuer-level redemption separately. Read the stablecoin issuer’s reserve and redemption disclosures, including who may redeem directly and under what conditions.
