Many use a simple yes/no payoff, but “event contract” describes the subject matter and outcome design—not one mandatory legal form. Depending on its terms, an event contract can be structured as a swap, futures contract, or option.
A swap is a specific legal category under the Commodity Exchange Act (CEA). The decisive question is therefore not whether a contract concerns an event, but how it is legally structured, what the underlying event is, how settlement works, and whether a statutory exclusion applies.

What is an event contract?
Event contracts are derivatives tied to an occurrence, contingency, index, or other event. The CFTC says the term is not defined in the CEA or in CFTC regulations. In a March 16, 2026 proposed rule, the agency said it has used “event contract” since at least 2008 for derivative contracts “typically with a binary payoff structure, based on the outcome of an underlying occurrence or event.”
“Typically” matters. A binary contract pays according to two possible outcomes, such as yes or no, but not every event contract must be binary. The payout may instead vary with a measured result, use a range of outcomes, or follow another structure stated in the contract rules.

The underlying subject can be financial, economic, physical, political, scientific, cultural, current-affairs, weather-related, or sporting. The event itself does not determine the legal classification. The contract’s wording and trading arrangement do.
How does a yes/no event contract pay out?
The basic example
The CFTC uses the question “Will it rain tomorrow?” as an illustration. Suppose the “yes” side trades for 70 cents and the “no” side for 30 cents. Those prices reflect the market’s expectations at that moment; they are not a guaranteed probability or prediction of what will happen.
- A trader buys a “yes” position for $0.70.
- If the contract’s rules determine that it did rain, the winning position receives the stated settlement amount, often $1.00 in a fully collateralized binary design.
- The trader’s gross profit is the settlement payout minus the purchase cost: $1.00 – $0.70 = $0.30, before fees and any other costs.
- If the event does not occur, the “yes” position generally settles at zero and the trader loses the purchase amount, subject to the contract’s rules.
The opposing “no” position in the illustration costs 30 cents. If “no” wins, its holder receives the settlement amount and earns the difference between that payout and the 30-cent purchase price. Actual contracts can use different prices, payouts, fees, settlement windows, or nonbinary formulas, so the listing rules control.

Who decides whether the event happened?
Every contract should identify the authoritative data source, observation period, geographic area, threshold, and settlement time. It should also explain what happens if data are delayed, revised, unavailable, contradictory, or ambiguous. A weather contract might specify a particular station and a defined measurement; a political contract might name the official authority whose certification controls. Never infer these details from the headline question alone.
Are event contracts swaps?
Sometimes, but not always. “Event contract” describes what a derivative is based on. “Swap” describes one possible legal structure. The CEA’s swap definition includes certain payments that depend on an event or contingency associated with a potential financial, economic, or commercial consequence. Some event-dependent payments and binary options can therefore fall within the swap definition.

Other event contracts are listed as futures contracts or options. The CEA excludes futures contracts, and options on futures contracts, from the statutory definition of “swap.” CFTC Staff Letter No. 26-14 likewise emphasizes that the contract’s structure and terms—including the underlying event—determine whether it is a swap, future, or option.
It is inaccurate to say that every event contract is a swap, and equally inaccurate to say event contracts can never be swaps. Classification requires reading the legal terms and the applicable statute, not relying on the marketing label.
How is an event contract different from a swap?
| Comparison point | Event contract | Swap |
|---|---|---|
| What the term describes | A derivative based on an occurrence, contingency, index, or other event. | A legal category defined by the CEA and related rules. |
| Possible legal form | May be a swap, future, option, or another form permitted by the governing framework. | Must satisfy the statutory definition, unless an exclusion or other rule applies. |
| Underlying | Often a discrete event, such as weather, an economic release, an election result, or a sporting outcome. | Can reference rates, currencies, commodities, securities, indexes, events, or other interests, depending on the swap. |
| Payoff | Often binary, but not necessarily; the contract rules determine the formula. | May involve exchanges of cash flows, a contingent payment, or another negotiated or standardized formula. |
| Trading venue | Could be listed on a designated contract market (DCM) or traded through another permitted facility, depending on classification. | Swaps may be traded bilaterally or through a swap execution facility (SEF), where applicable. |
| Offset and fungibility | Some exchange-listed contracts have standardized terms, fungibility, and the ability to offset before settlement. | Many swaps are customized, although standardized swaps can also be centrally traded or cleared. |
The table shows why legal classification and trading experience can point in different directions. CFTC staff has noted that certain fully collateralized, binary-payout contracts listed on DCMs may meet the swap definition while operating with standardized terms, exchange protocols, fungibility, and offset features familiar from futures and options on futures.
What determines an event contract’s classification?
1. The statutory structure
Start with the contract’s legal language. Ask whether it creates a payment dependent on an event or contingency covered by the CEA’s swap definition, or whether it is written and listed as a futures contract or option. A statutory exclusion can change the answer even when two products have similar-looking payouts.
2. The underlying event or interest
Identify exactly what controls value or settlement: a weather measurement, a published economic indicator, a financial index, an official election certification, a scientific milestone, or another specified interest. The event’s connection to a financial, economic, or commercial consequence can matter to the legal analysis.

3. The payoff formula
Determine whether the payout is binary, variable, tiered, or calculated from a continuous measure. Check the maximum loss, maximum payout, collateral requirements, and whether fees are deducted from settlement.
4. Trading and settlement mechanics
Review whether the contract is listed on a DCM, executed through an SEF, or offered through another arrangement. Check whether terms are standardized, whether positions can be offset before expiration, and whether the market is centrally cleared. These features affect liquidity, counterparty exposure, and the practical ability to exit.
How do event contracts trade in practice?
A listed event contract can resemble a small, standardized futures or options market even when its legal classification is different. Traders submit orders, prices change as expectations change, and an open position can sometimes be offset before the event is resolved. A contract held to settlement follows the venue’s official determination rather than a trader’s personal interpretation of the event.
Venue terminology matters. A DCM is the regulated exchange category commonly associated with futures and options. An SEF is a swap execution facility, a regulated platform for executing swaps that meet applicable requirements. The venue, registration status, clearing arrangements, and access rules should be stated in the contract documentation.
What the CFTC’s March 2026 proposal says
The CFTC’s March 16, 2026 document is a proposed rule, not a final rule that permanently resolves the classification of every event contract. It describes event contracts as potentially swaps or futures and requests comment on how they should be classified and regulated.

The proposal says a prediction market offering swaps or futures to the general public must register with the CFTC as a DCM. It also discusses SEFs and the distinction between their access model and DCM markets. Those statements describe the agency’s proposal and existing statutory framework; they do not mean every venue or product has been approved, nor do they guarantee a particular outcome.
Registered venues have general obligations when listing derivatives, including a requirement that listed contracts not be readily susceptible to manipulation. The CEA also gives the Commission authority to prohibit certain event contracts if it determines that they are contrary to the public interest. Because the document is a proposal and legal challenges or later rules can change the framework, readers should check the current CFTC rulemaking record and any applicable court decisions before relying on it.

The CFTC’s proposal reports a sharp increase in the number of event contracts certified for listing:
| Period | Figure reported by the CFTC | What it measures |
|---|---|---|
| 2006–2020 | About five event contracts per year on average | Average annual listings described by the CFTC. |
| 2021 | 131 newly listed event contracts | New listings during that year. |
| 2025 | About 1,600 event contracts certified for listing | Contracts certified for listing, not trading volume or active users. |
The figures include contracts referencing financial indexes, economic indicators, weather, political and international events, scientific and cultural events, current events, and sports. A listing count does not show how many contracts traded, how much money changed hands, or whether a product remained active.
What should a trader check before entering an event contract?
- Read the contract rules. Confirm the event definition, measurement source, location, deadline, payout formula, and treatment of ambiguous or revised information.
- Verify the venue and legal form. Find out whether the product is a swap, future, or option; whether it is listed on a DCM or executed through an SEF; and whether clearing or collateral rules apply.
- Calculate the full downside. Include the purchase price, commissions, exchange fees, bid-ask spread, financing or collateral costs, and the possibility that an early exit is unavailable.
- Check liquidity and offset rules. A contract may be standardized yet still have a thin market. Learn how orders are matched and whether you can close a position before settlement.
- Understand settlement authority. Identify who makes the final determination, what evidence is used, and what appeal or correction process exists.
- Use only risk capital. The CFTC advises trading only money that can be risked after living expenses and savings needs are met.
- Monitor open positions. The CFTC recommends monitoring positions or using stop-loss orders where appropriate, while recognizing that a stop order cannot guarantee a particular execution price in a fast or illiquid market.
Common misconceptions
“The price is a guaranteed probability.”
No. A 70-cent “yes” price in the CFTC’s illustration reflects current market expectations and can change. It does not guarantee that the event has a 70 percent chance of occurring or that the event will occur.
Best Value
“Every event contract pays $1 or $0.”
No. Binary settlement is common, but the CFTC describes it as typical rather than universal. Read the formula for the specific listing.
“If it trades like a future, it legally is a future.”
No. Standardization, exchange trading, fungibility, and offset can make a contract feel like a future while the statutory analysis points to a swap or option.
“CFTC oversight means the contract is endorsed.”
No. Registration, listing requirements, and anti-manipulation standards are forms of market oversight. They are not a promise that a contract will be profitable, that an event will be easy to verify, or that every listed product serves the public interest.

Use “event contract” as a broad description of an event-linked derivative, then determine the legal category from the actual terms. Compare the underlying event, payoff, settlement authority, venue, standardization, offset rights, collateral, fees, and maximum loss. Only after those checks can you say whether the particular event contract is a swap, a future, or an option.
