What Are Abortion Shield Laws, and How Do They Work?

Abortion shield laws can limit how a state’s officials and courts assist out-of-state actions involving reproductive care lawful there. Their protections vary and are not blanket immunity.

Abortion shield laws are state laws or executive orders that limit how a state’s own officials and courts can help another state investigate or penalize reproductive care that is lawful where it was provided. Depending on the law, they may restrict cooperation with investigations, extradition, subpoenas, professional discipline, civil claims, or disclosure of sensitive information. They are not blanket immunity: their coverage varies, and they do not automatically bind another state’s officials or courts.

How an abortion shield law works

A shield law works through the legal system of the state that enacted it. It can direct that state’s police, agencies, courts, or other public entities not assist with specified proceedings tied to care protected under state law. The exact restrictions depend on the law and the facts of a particular case.

Common tools include:

  • Limits on cooperation: State or local officials may be restricted from sharing information, using public resources, or otherwise helping with another jurisdiction’s investigation or prosecution.
  • Limits on arrest or extradition: Some protections address whether local officials may arrest or extradite a person sought by another state.
  • Limits on subpoenas and other process: A state court may be restricted from issuing, enforcing, or recognizing certain legal demands connected to an out-of-state case.
  • Protections against professional or civil consequences: Some laws address licensing discipline or civil claims based on covered care.
  • Limits on disclosure: Some protections cover medical, location, or other sensitive data.

These tools do different jobs. A restriction on sharing information, for example, is not the same as immunity from a lawsuit; protection in one category does not establish protection in all the others.

Why the details of a case matter

Whether a protection applies can depend on the wording of the state law, the type of care and proceeding, where the care was provided, where the provider was physically located, what legal process is being requested, and whether an exception applies. A shield law is a state’s response within its own legal system. It does not change the law of the state where a patient is located, guarantee immunity from every claim, or settle conflicts between state and federal law.

Telehealth and provider location

Telehealth can make the provider’s location legally important. New York Attorney General guidance says New York’s protections can apply when a provider physically located in New York gives reproductive health care by telehealth to a patient out of state. That is a statement about New York’s law and its conditions, not a rule that automatically applies in every state.

Subpoenas and civil cases

Oregon’s Department of Justice describes 2023’s HB 2002 as a shield law. Oregon guidance says state courts generally will not issue certain subpoenas for out-of-state cases involving reproductive care permitted in Oregon, subject to specified exceptions involving patient claims and contracts. The guidance also describes protections in certain civil cases concerning care provided in Oregon, with an exception for contract-based cases.

Warrants and extradition requests

California Attorney General guidance issued February 19, 2026, after Louisiana indicted a California physician, reminded law enforcement that California law restricts cooperation with other states’ investigations and prosecutions involving abortions legal in California. The bulletin says an out-of-state warrant does not by itself require California to make an arrest or begin extradition proceedings. That does not mean every request is barred; the applicable law and circumstances still matter.

How protections differ from state to state

UCLA School of Law’s guide, updated in July 2026, reported reproductive-health shield-law protections in 23 states and Washington, D.C., through legislation or executive order. The same guide counted eight states with enacted laws expressly protecting provision of care regardless of the patient’s location, including telehealth. These are different measures: a state may have some shield protections without expressly covering care regardless of where the patient is located. Four states in the guide provided certain protections through executive order rather than legislation.

The examples below illustrate different legal tools; they are not a comprehensive comparison of each state’s law.

New York Attorney General guidance describes restrictions concerning arrests and extradition, information sharing and cooperation, and certain subpoenas. It also addresses telehealth for an out-of-state patient. The telehealth example involves a provider physically located in New York; the guidance identifies conditions and exceptions. Oregon Department of Justice guidance describes limits on certain subpoenas for out-of-state cases and protections in certain civil cases involving reproductive care provided in Oregon. The guidance identifies exceptions, including specified patient-claim and contract circumstances. Source: Oregon Department of Justice guidance on HB 2002, enacted in 2023.
California Attorney General guidance describes restrictions on cooperation with certain out-of-state investigations and prosecutions involving abortions legal in California. To assess a particular law, check what proceedings it covers (criminal, civil, or professional discipline), who and what care it protects, where the provider and care are located, which public actors are restricted, how legal process and information sharing are handled, and what exceptions apply. UCLA’s guide distinguishes among these categories because protections in one area do not necessarily extend to another.

What shield laws do not settle

A state can limit assistance by its own officials, but its law does not itself control another state’s agencies or courts. That leaves unresolved questions about how protections work across state lines, especially when one state seeks information or legal process concerning care provided in another. Litigation is testing these issues, and the status of individual cases can change.

The most recent procedural marker in the sources here is a Supreme Court docket entry. Louisiana and other states filed a motion on September 30, 2026, seeking permission to bring an original action against New York and other states. The request was docketed October 2, 2026, as No. 22O165. As of October 4, 2026, the docket showed the request had been filed but no ruling on whether the Court would allow the case to proceed. It is a pending request, not a decision on the merits.

Shield laws also coexist with federal law. The U.S. Department of Justice describes the federal FACE Act as prohibiting violence, threats, physical obstruction, and property damage interfering with reproductive health services. The FACE Act is not a shield law; it is a separate federal framework.

Why data protections are part of the issue

Some shield laws address disclosure of health information and other data because investigations can involve records beyond the procedure itself, including medical or location information. The laws differ in what data they cover and which officials or courts they constrain. A privacy provision should therefore be read as part of the specific state law, not as a general promise that all records are confidential or inaccessible to every government authority.

For someone trying to understand a real subpoena, investigation, licensing matter, or extradition request, the relevant state’s current statute and official guidance matter more than a general description of shield laws. The UCLA guide’s case tracker was last updated in April 2026, so its descriptions of litigation should not be treated as current court status without checking the relevant docket. Individual legal questions call for a qualified lawyer.
