What Air Permits Do Data Centers Need for Backup Generators?

U.S. data-center generator requirements depend on location, emissions, engine type, and intended use. Understand the permit programs, federal rules, and operating-hour distinctions to discuss with the relevant air agency.

In the United States, a data center may need a state or local air permit before it builds or modifies backup generators, and it may need a Title V operating permit depending on the site’s emissions and source status. Federal rules for stationary engines can apply separately, whether or not either permit is required. The answer depends on the project location, the full generator inventory, emissions, and planned operating uses; there is no single nationwide checklist or permit threshold for every data center.

Which authority and permit programs may apply?

Start with the air agency for the project site

Most U.S. data-center air permits are issued by state or local agencies through Clean Air Act programs approved to meet federal requirements. The U.S. Environmental Protection Agency (EPA) says that “State and local air agencies issue most air permits for data centers, under programs approved as meeting minimum requirements established by the CAA and EPA regulations.” Depending on the location, an EPA regional office or tribal authority may also have a role. Ask the air agency that covers the site which application process and thresholds apply.

New Source Review is a preconstruction question

New Source Review (NSR) applies to qualifying new stationary sources and modifications when emissions meet the relevant program’s applicability criteria. It is a preconstruction permitting program, so determine whether approval is required before beginning covered construction or modification. The applicable thresholds and permit details depend on the jurisdiction and project.

Title V is an operating permit

Title V consolidates applicable Clean Air Act requirements and supports compliance oversight. It applies to major stationary sources and certain minor sources. A data center does not need a Title V permit simply because it is a data center or has backup generators; the site’s source status and applicable thresholds determine whether one is required.

Which federal rules apply to the generators?

Air permits and engine standards are related but distinct. NSR and Title V are permitting programs. Federal engine standards set emissions and operating requirements for covered equipment and may apply even if the project does not trigger a particular NSR or Title V permit.

First determine whether each unit is a stationary reciprocating internal combustion engine (RICE), a stationary combustion turbine, or another type of equipment. For RICE, EPA identifies these principal federal rule families:

These are rule families to screen, not a conclusion that every listed standard applies to every unit. EPA’s stationary-engine compliance material organizes requirements by engine category. Classification can turn on whether the unit is stationary or nonroad, new or existing, its hazardous-air-pollutant source category, ignition and fuel type, subtype, power rating, and emergency designation.

How many hours can an emergency generator run?

There is no single operating-hour number that answers every use case. Keep emissions estimates, maintenance and testing, emergency operation, and non-emergency grid support separate.

Potential-to-emit estimates: 500 hours is not permission to operate

EPA’s Clean Air Act Resources for Data Centers page, last updated September 28, 2026, describes 500 hours per year as an appropriate default assumption for estimating worst-case annual operation when calculating emergency-generator potential to emit (PTE). An owner or permitting authority may support a different estimate case by case, for example using local outage history. This is an emissions-estimation assumption, not blanket authorization to run an engine for 500 hours.

Maintenance and testing have rule-specific conditions

Federal stationary-engine standards provide defined allowances for maintenance and testing, but the conditions vary by applicable rule and engine category. Check the requirements for each classified unit and any permit conditions rather than applying one general limit to the entire generator fleet. EPA’s compliance summaries identify hour-meter and operating-hour recordkeeping requirements for emergency engines.

Non-emergency grid-reliability operation is conditional

In a May 1, 2025 clarification, EPA said certain emergency engines may operate for up to 50 hours per year in specified non-emergency circumstances to prevent local power interruption, if the regulatory criteria are met. The clarification addressed qualifying financial arrangements. It is not general authority for routine energy-market dispatch or unrestricted data-center generation; confirm that the engine, arrangement, and proposed use meet the applicable rule.

EPA’s 2026 emergency-order interpretation is time-specific

EPA’s data-center page describes spring and summer 2026 Department of Energy emergency orders under section 202(c) of the Federal Power Act. For emergency stationary engines covered by the identified RICE NESHAP and CI/SI NSPS provisions, EPA considers operation under those orders an emergency situation; the page says those hours do not count toward the specified 50-hour non-emergency allowance. This interpretation is tied to the relevant orders and identified rule provisions, so check current EPA guidance and the order applicable to the project before relying on it.

What information should a developer take to the air agency?

Bring one facility-wide inventory and operating description. The agency’s application instructions control, but these details help it assess permit applicability and engine-rule coverage:

  • Site and schedule: project address, county, state, any relevant tribal jurisdiction, and intended construction and operation dates.
  • Every generator or turbine: manufacturer and model, fuel, rated horsepower or capacity, serial number and model year, stationary or portable status, and certified emissions family where available.
  • Unit status and use: whether each unit is new, existing, modified, or relocated, and whether it is designated emergency, limited-use, or non-emergency.
  • Hours by purpose: maximum planned annual hours for outage response, maintenance and testing, demand response, grid reliability, commissioning, and any other operation.
  • Emissions and assumptions: potential emissions by pollutant for individual units and the site as a whole, including assumed operating hours and any proposed enforceable limits.
  • Controls and compliance plan: proposed controls, stack and exhaust configuration, monitoring, recordkeeping, and reporting.
  • Other site sources and permits: existing permits and other emissions sources, since facility-wide emissions and source aggregation may affect applicability.

How should backup-power options be compared?

Compare equipment and operating plans before fixing a permit strategy. A design intended for emergencies only raises different questions from one that also anticipates grid support or demand response.
