In the United States, the answer depends on the kind of use, the production and publication context, your contract, and the relevant state law; lack of consent does not automatically make every use unlawful.
What can I do if a production used my image without permission?
Start by documenting what happened and comparing the actual use with the permission you gave. A photograph, existing performance, advertisement, and AI-generated replica may raise different contractual and legal questions. Avoid assuming that a broad-sounding release permits every later use—or that no signed release means the production has no possible defense.

Preserve the evidence
Save the material in the form in which you found it, along with its URL, the date you accessed it, and screenshots or recordings showing the relevant context. Keep related emails, messages, call sheets, contracts, releases, vouchers, and any description of the intended use. If the material changes or disappears, your saved copy may help an attorney assess what was published and when.

Read the permission and identify the use
Check what the agreement authorizes: the person or performance covered, project, medium, purpose, duration, territory, and any rights to edit, reuse, or create digital replicas. Compare those terms with what the production actually did. A release for one project or described use may not answer whether a later project, advertisement, or materially different use was authorized. The contract’s wording and applicable law matter.

Ask for a specific remedy
After preserving evidence, an actor or their representative may contact the production in writing to identify the disputed use and request a defined outcome—such as an explanation, correction, payment required by an agreement, cessation of a particular use, or removal. Keep the request factual and retain the response. Whether a demand is legally enforceable depends on the agreement and law; consider having an entertainment lawyer review it before making threats or signing a settlement.
Can a production use my voice without my consent?
There is no single U.S. rule that resolves every use of an actor’s voice. The voice might be part of an authorized recording, a new edit of an existing performance, an imitation, or a generated replica. The contract, context, and jurisdiction can change the analysis. For instance, California Civil Code § 3344 addresses knowing, unauthorized use of a person’s voice, among other identity attributes, on products or for advertising or selling goods or services, subject to statutory qualifications. It is a California example, not a nationwide rule or an automatic answer to every film or recording dispute.

Uses in expressive works can also raise First Amendment considerations. SAG-AFTRA’s overview identifies contexts such as satire, parody, commentary, criticism, biography, documentaries, newsworthy material, and educational uses as potentially relevant. Whether a particular use is protected is fact-specific: being in a film does not automatically exempt a use, and a commercial context does not by itself establish liability.

Find out how the replica was made, what source material was used, how it was used, and what agreement governs the work. A digital replica created from covered work may be treated differently from an independently created replica based on public material. Neither distinction, by itself, resolves every legal claim; contract terms and state law still matter.

Check the agreement that covers the production
SAG-AFTRA’s TV/theatrical AI guidance describes contract definitions that cover voice and likeness, with consent and payment requirements varying by agreement and performer category. The guidance also explains that use in another project or in a way different from the initially approved use may require new consent. Those protections should be checked against the actual agreement; they are not a universal rule that every use requires consent under every contract.
A February 2026 SAG-AFTRA Interactive Media Agreement bulletin describes a specific process for that agreement: covered consent must be in writing, separately signed, checked, or initialed, and tied to a reasonably specific description of intended use. The bulletin distinguishes a replica created from covered work from one independently created using public data or material. These details apply to the agreement it covers, not automatically to all actors or productions.

SAG-AFTRA’s 2025 audio-commercial contract material likewise describes agreement-specific safeguards, including clear, conspicuous written consent and a reasonably specific description of intended use. It provides for additional consent when a commercial use exceeds the original description and includes compensation terms. If you are covered by a union agreement, ask SAG-AFTRA which agreement and provisions apply to your work rather than relying on a summary of another category’s rules.
Account for deceased performers
Some laws and agreements address digital replicas of deceased performers, but their reach is limited by jurisdiction and statutory conditions. New York Civil Rights Law § 50-f concerns post-mortem publicity rights and digital replicas of deceased performers; it is not a general rule for living actors everywhere. On March 20, 2026, SAG-AFTRA said in a statement about the reported Val Kilmer digital replica: “The applicable SAG-AFTRA collective bargaining agreement, as well as state law, requires consent from the estate to use a digital replica of a deceased performer in a motion picture.” That is the union’s statement about the reported matter, not a court ruling or a universal legal rule. Can I make them take it down?
Possibly, but there is no general federal takedown process for every unauthorized image, voice, or performance. A production may agree to remove or correct material, an applicable contract or law may support a demand, or a court process may be considered. Whether any of these options is available depends on the facts and jurisdiction; a platform report alone does not establish a legal right to removal.
The federal TAKE IT DOWN Act is narrower. The FTC says platform notice-and-removal obligations under the Act became effective May 19, 2026, for covered nonconsensual intimate photos or videos. That process does not cover every unauthorized performance or voice clone simply because it appears online. If the material is covered intimate imagery, use the platform’s reporting process and consider legal advice; for other material, do not present the Act as a general remedy.
When should I contact a union or lawyer?
If you are covered by SAG-AFTRA, contact the union promptly so it can help identify the relevant agreement and its consent and payment provisions. Protections can vary by agreement and category, so specify the project, work, and disputed use when seeking help.
For an actual dispute, consult a qualified entertainment lawyer familiar with the relevant jurisdiction. The actor’s location, production location, contract language, consent documents, publication context, and whether the performer is living or deceased can all matter. No universal damages amount, filing deadline, or likelihood of success applies across these situations; a lawyer can assess the facts before you decide whether to pursue a contract demand, payment, correction, platform report, or litigation.
