A State GST Special Commissioner is a senior officer in a particular state’s tax administration, but the title alone does not define a standard nationwide job or set of powers. The officer’s actual portfolio, reporting line, jurisdiction and delegated authority depend on that state’s laws and current government orders. The distinction from a “GST Commissioner” therefore turns on which administration and legal authority the title refers to—not simply on the word “Special.”
What the title means
“State GST Special Commissioner” is an administrative designation used within a state’s GST organization. It generally signals a senior role, but it does not, by itself, establish a uniform statutory rank or a fixed list of responsibilities across India.

Depending on the state and the officer’s assignment, the role may involve supervising a unit, coordinating administration or enforcement, or exercising specified powers. These are possibilities to verify against that state’s organization chart and orders, not duties that can be assumed for every Special Commissioner.
Why state and central GST administration are distinct
India’s GST framework divides legislative authority between the Union and the states. Article 246A(1) of the Constitution provides: “Parliament, and, subject to clause (2), the Legislature of every State, have power to make laws with respect to goods and services tax imposed by the Union or by such State.” Article 246A(2) gives Parliament exclusive power to legislate on GST where a supply takes place in the course of inter-State trade or commerce. These provisions appear in the Constitution (One Hundred and First Amendment) Act, 2016, dated 8 September 2016, in the CBIC-hosted amendment text.

In broad terms, SGST accrues to the relevant State Government, while IGST applies to inter-State supplies under the central framework, as described in CBIC’s Know About GST overview. The distinction matters because a state officer’s title does not automatically make that officer responsible for every central GST matter.
How a Special Commissioner differs from a GST Commissioner
“GST Commissioner” is not specific enough on its own to identify one office. It may mean a Commissioner in the central tax administration or a Commissioner designated within a particular state’s GST structure. The relevant comparison is the office, administration and legal authority attached to each post.
| Comparison | State GST Special Commissioner | GST Commissioner |
|---|---|---|
| Administration | A role within a particular State GST administration. | May refer to a central-tax Commissioner or to a Commissioner in a state structure; identify the administration before comparing. |
| Legal framework | The relevant State GST Act and rules, state notifications, and government or departmental orders. | For a central-tax Commissioner, the CGST Act and applicable central orders; for a state Commissioner, the relevant state instruments. |
| Powers | Depend on applicable law and any specific assignment or delegation. | Depend on the applicable law and orders; the title alone does not establish the powers in a particular case. |
| Portfolio and reporting line | Set by the state’s current posting and administrative arrangements; not stated for an unnamed state. | Depend on the administration and post being discussed; not stated for an unnamed office. |
It is therefore not accurate to say, based only on these titles, that every State GST Special Commissioner is above, below or equivalent to every GST Commissioner. A meaningful comparison requires the state, the specific posts and the current instruments governing them.

How the law treats appointment and delegated powers
The CGST Act sets out classes of central tax officers and provisions governing their powers. Section 5(3) states: “The Commissioner may, subject to such conditions and limitations as may be specified in this behalf by him, delegate his powers to any other officer who is subordinate to him.” This describes delegation under the central statute; it does not, by itself, define the authority of a state Special Commissioner. See the CBIC-hosted CGST Act text.
The Act also provides for state GST officers to be authorized as proper officers for CGST purposes, subject to conditions specified by government notification. That is not automatic authority over every central GST matter. The Act also limits overlapping proceedings on the same subject matter. The relevant authorization and circumstances must be checked in the applicable legal provisions and notifications.

For a reliable answer about a named state or officeholder, check the instruments that establish the post and assign its work. The title alone is not enough.
Quick Recap
Rank #4
- Identify the state and the exact post. Confirm whether the comparison concerns a state officer, a central-tax officer, or two posts within the same state department.
- Check the state’s current organization chart and posting order. These can identify the officer’s portfolio, reporting line and territorial responsibilities.
- Find the legal source for each claimed power. Consult the applicable State GST Act and rules, relevant notifications, and any delegation or government order assigning that power.
- For a claimed CGST function, check the central authorization. Confirm the notification and conditions that authorize state officers to act as proper officers for that purpose, along with any limits relevant to the matter.
- Confirm that the documents are current. Amendments and administrative postings can change the applicable position; use current official legislation and orders rather than relying on the designation alone.
