For recurring subscriptions, a VAT-number check at signup should not be treated as permanent proof for every later charge. Recheck or review the customer’s VAT status at renewal when your tax treatment depends on it, and retain the result. This is a prudent control—not a universal legal requirement to make a fresh VIES request on every renewal.
Should you validate a VAT number on every subscription renewal?
When a service involves successive statements or payments, the EU VAT Directive generally treats each period as completed at the end of the period to which its statement or payment relates. That makes each renewal a sensible point to revisit the facts supporting the tax treatment. Article 64 sets chargeability timing; it does not itself require a fresh VAT-ID lookup at every renewal. See the consolidated VAT Directive, Article 64.

The implementing regulation says that when a supplier relies on a customer’s VAT number to establish taxable-person status for place-of-supply purposes, the supplier should confirm its validity and the associated name and address through the relevant administrative-cooperation process. It also provides for other evidence and reasonable verification circumstances. It does not set a general renewal-by-renewal lookup frequency. See the consolidated Implementing Regulation (EU) No 282/2011.

Is one check at checkout enough?
A successful signup check records a validity signal at that time; it does not establish that the number will remain valid indefinitely. If later renewal invoices continue to rely on the customer’s VAT-ID status, a one-time result can become stale. A renewal-time recheck or review gives you fresher evidence aligned with the recurring billing period.

VIES is the European Commission’s online service for checking VAT-number validity for EU Member States and Northern Ireland. The Commission explains that VAT identification numbers help identify a customer’s tax status and place of taxation. A valid number is not, on its own, a complete tax determination: the applicable treatment also depends on the service, customer status and location, and the relevant place-of-supply and liability rules. See the Commission’s VIES validation service and guidance on VAT identification numbers.
One-time validation versus renewal-time review
| Approach | Evidence freshness | Operational trade-off |
|---|---|---|
| Check once at signup | Records validity when the customer enters the number, but may be stale by later renewals. | Lower operational complexity, but less ability to detect a changed status before a later invoice. |
| Recheck or review at renewal | Creates fresher evidence when the merchant still relies on the VAT-ID status. | Requires an integration or manual workflow, plus an exception path for unavailable or inconclusive checks. |
Whichever approach you use, consider whether a changed result can be applied before the renewal invoice is finalized. Systems vary, and an already-finalized invoice may not be changed automatically.
What if the VAT number becomes invalid after signup?
Treat a later invalid result as a change in the evidence supporting the tax treatment, not as an automatic answer to every tax question. Route it through your tax process to reassess the customer’s status and the applicable transaction rules. Keep the customer and invoice information accurate, and record the decision made for the renewal.

- At signup: validate the VAT number when entered, and store the check timestamp and result with the customer record.
- Before renewal invoicing: trigger a fresh check or a review if the renewal’s tax treatment relies on the VAT-ID status.
- Handle the response: distinguish a confirmed valid result, an invalid result, and an unavailable or inconclusive response. Do not equate a timeout with either outcome.
- Apply tax review: send changed or unresolved cases through the merchant’s tax process before finalizing the renewal invoice where feasible.
- Retain the decision record: keep the result and the tax-treatment decision together so the evidence for that renewal can be understood later.
Check how your billing platform handles revalidation
Implementations differ, so verify when your platform calls VIES, how it reports changes, and what evidence it stores. As one vendor-specific example, Stripe says EU VAT numbers in Invoicing are validated against VIES asynchronously; the result confirms number validity but does not match the customer’s name and address in the dashboard. Stripe also says a tax ID is not automatically validated again after it has been confirmed. Review Stripe’s tax-ID documentation for those product details. Stripe Tax separately advertises VAT-ID validation and tax calculation on its product page; this is an implementation example, not a description of all billing platforms.
