Strong developers outside the United States can be passed over for reasons that have little to do with code—but silence or rejection alone does not reveal the reason. Many US companies limit remote hiring to countries where they can employ people legally and handle payroll, benefits, and tax. Others prefer time-zone overlap or rely on screening that includes subjective judgments. These are different barriers, and none explains every hiring decision.
Why a remote US job may not be open worldwide
“Remote” describes where work happens, not necessarily where an employer can hire. A company may accept remote employees only in countries where it has a legal entity or another workable employment arrangement. Before applying, distinguish three things: whether the job accepts applicants in your country, whether the company can employ you there, and whether its team has practical preferences about working hours.

Hiring eligibility and local employment arrangements
Employing someone across a border can require a company to account for local labor rules, payroll, benefits, and taxes. In a 2022 survey of more than 1,400 hiring managers across Germany, the Netherlands, France, Sweden, the United Kingdom, and the United States, Remote reported that 38% found it challenging to learn local legal requirements in new regions, and 33% said they would not hire globally without a local legal entity. That operational constraint can rule out a qualified applicant before a technical interview. It does not establish why a particular company has a location restriction, and it should not be confused with a judgment about the applicant’s engineering ability.
Employment type and legal coverage
Some employers hire abroad as employees; others may consider contractors, depending on their arrangements and the role. Ask which applies and whether the company can hire in your country rather than assuming “remote” includes it.

Legal protections also depend on the situation. The US Equal Employment Opportunity Commission says US equal employment opportunity laws do not apply to non-US citizens working outside US territory; coverage in other multinational-employment situations depends on factors including the employer and the facts. Covered employers are prohibited from discrimination in recruitment and hiring. This is not a blanket rule that all overseas workers are covered—or that employers can discriminate freely abroad. Why time zones and team practices can matter
Some teams want substantial hours of overlap for meetings, quick decisions, or customer support. That preference can narrow a search even when a company is able to hire in your country. It is not proof that every remote role requires US working hours.

Deel reported that domestic hiring on its platform grew 104% in 2024, compared with 42% for cross-border hiring. In the same platform data, 50% of cross-border hires in Great Britain were in the same time zone as their employer, while 41% of Germany’s were within one hour. Overlap is a preference teams can make explicit
When a role does not state its hours, ask how much overlap is expected and whether the team can work with documented handoffs. Boston Consulting Group’s 2021 report discusses tax, labor-law, cultural-integration, and meeting-coordination challenges in global work. It identifies asynchronous written communication and explicit handoffs as ways to reduce dependence on shared meeting hours—not as a requirement that every overseas hire work US time. Onboarding is a separate concern from applicant quality
A study of 267 Microsoft developers who onboarded remotely during the COVID-19 pandemic found reported challenges involving technology, documentation, communication and collaboration, and team connection. It examined onboarding experiences, not applicant screening or rejection rates. It helps explain why an employer may ask how a remote hire will get context and coordinate with colleagues, but it does not show that overseas candidates are less capable. When “it’s not your code” is—and is not—a fair conclusion
Technical evidence is only one part of some hiring processes. A Federal Reserve working paper examined personnel data from elite US and European multinational employers recruiting at an elite Indian college. It found that caste disparities emerged in final non-technical interviews assessing family background, neighborhood, and “cultural fit,” rather than in several earlier stages, including application reading and written aptitude tests. The finding concerns that particular population and recruiting setting; it does not estimate how often US companies overlook developers abroad, establish that location caused a disparity, or prove that code is irrelevant in other hiring decisions. That distinction matters: a location restriction may be an employment-operations limit, an overlap preference may reflect team practice, and a subjective interview may create a different kind of barrier. The available evidence does not assign a share of rejected overseas applications to any one cause. A rejection or a lack of response, by itself, cannot tell you which explanation applies.

Check eligibility before investing time
- Look for wording such as “US only,” “must be authorized to work in the US,” named eligible countries, or an explicit statement that hiring is global.
- Ask whether the company can hire in your country and whether the role is employee or contractor.
- Do not treat a US-based company’s remote label as confirmation that it accepts applicants in your location.
Show your engineering work in context
Use a concise portfolio or project case study that explains the problem, your contribution, important trade-offs, and the result. Include measurable outcomes when you can substantiate them. Make it easy to distinguish what you personally built from what the team delivered. This is practical advice, not a proven method for increasing interview rates.

Describe how you will coordinate across distance
State your location and the hours of overlap you can reliably offer. Explain how you document decisions, share progress, and hand off work asynchronously. Be accurate about availability rather than promising US-hour coverage you cannot sustain. These details address coordination questions without presenting time-zone preference as a measure of technical merit.
Ask for clarification without guessing at the motive
If a posting is unclear, ask whether your country is eligible and what hiring arrangement the company uses. If you receive a location-based rejection, seek clarification where appropriate; the stated reason may answer the eligibility question. Do not assume that one rejection proves discrimination. If you have concrete evidence of discriminatory conduct, the relevant laws and possible remedies depend on jurisdiction and employment facts, so seek advice suited to your situation.
