The UK is no longer a member of the European Union and is outside the EU Single Market and Customs Union. EU membership is membership of a political and legal union; Single Market participation is participation in a framework for the free movement of goods, services, capital and people. The UK–EU Trade and Cooperation Agreement (TCA) sets terms for trade and cooperation after membership, but it does not restore Single Market participation.
What is the difference between the EU and the Single Market?
The EU is a political and legal union of member countries. Its Single Market is a framework designed to enable goods, services, capital and people to move freely across participating countries. The two are closely connected, but the terms do not mean the same thing: EU membership includes participation in the EU Single Market, while Single Market participation is not itself the same as EU membership.

The European Commission says the UK left the EU on 31 January 2020, after 47 years of membership, and is now outside both the Single Market and Customs Union. A transition period ran through 31 December 2020; the post-transition relationship began on 1 January 2021.
How does the UK–EU trade deal differ from Single Market participation?
The TCA is the treaty governing parts of the UK–EU relationship after membership. It covers areas including goods and services, digital trade, intellectual property, public procurement, transport, energy, fisheries, security cooperation and participation in some EU programmes. It provides specific rights and obligations, not the broader integration associated with participation in the Single Market.
#1 Best Overall
Goods: zero tariffs are conditional
The TCA provides for zero tariffs and quotas on eligible goods when they meet its rules of origin. Those rules determine whether goods qualify based on where they were made or sufficiently processed. A zero-tariff outcome does not mean that every shipment qualifies, that customs formalities disappear, or that trade is as frictionless as within the Single Market.
Services and people: do not assume Single Market rights
The TCA contains arrangements for services and other areas, but its existence does not give UK businesses or people the same rights they had through EU membership and Single Market participation. The agreement should be understood according to its specific terms, not as a continuation of the four freedoms.
EU membership, Single Market participation and the TCA compared
| Question | EU membership | Single Market participation | UK–EU TCA |
|---|---|---|---|
| What is it? | Membership of the EU, a political and legal union. | Participation in a market framework based on movement of goods, services, capital and people. | A treaty setting terms for parts of the UK–EU relationship after membership. |
| Does it mean EU membership? | Yes. | Not by definition; it describes participation in the market framework. | No. The UK is not an EU member. |
| What does it mean for goods? | Goods move within the EU framework. | Movement of goods is one of the four freedoms. | Eligible goods can receive zero tariffs and quotas if they meet rules of origin; customs procedures can still apply. |
| What does it mean for services and people? | Part of the wider EU relationship. | Services and people are two of the four freedoms. | Specific arrangements apply under the treaty; it does not recreate the Single Market’s four freedoms. |
| Does it describe the UK’s current position? | No. | No, for the UK as a whole. | Yes. It governs parts of the post-membership relationship. |
What is the Northern Ireland exception?
Northern Ireland has distinct arrangements under the Windsor Framework for certain goods and related matters. Some EU rules apply there for goods, while Northern Ireland remains part of the UK customs territory. This is a geographically limited arrangement; it does not make Northern Ireland part of the Single Market for every purpose, and it does not apply to Great Britain or the UK as a whole.
For movements of goods from Great Britain to Northern Ireland, HMRC describes simplified processes for eligible movements under the UK Internal Market Scheme. Other movements may require full customs processes. The procedure depends on the goods and route; businesses moving goods should check current HMRC guidance rather than treating a general explainer as operational customs advice.

Does the UK–EU trade deal mean free trade?
It means the TCA sets trade terms, including conditional zero tariffs and quotas for qualifying goods. It does not mean every good or service moves without conditions or procedures, and it is not equivalent to Single Market participation. For a shipment, the relevant questions include whether the goods meet rules of origin and which customs processes apply to its route.
