U.S. Withdraws Proposed $10,000 Reporting Rule for Crypto Transfers to Private Wallets

FinCEN withdrew its never-effective proposal for reporting certain crypto transfers involving unhosted wallets. The proposed $10,000 and $3,000 thresholds are not obligations under that rule.

No. The proposed $10,000 reporting rule for certain crypto transfers involving private wallets never took effect. FinCEN withdrew it effective October 6, 2026, and says it will take no further action on the proposal. The plan would have placed duties on covered banks and money services businesses—not created a blanket filing requirement for people moving crypto to their own wallets.

What happened to the proposed rule?

The Financial Crimes Enforcement Network (FinCEN) withdrew its December 2020 proposal on reporting, recordkeeping and identity verification for certain digital-asset transfers involving unhosted wallets. The withdrawal took effect October 6, 2026. In its notice, FinCEN Deputy Director Jimmy L. Kirby wrote, “FinCEN will take no further action on this NPRM.” Read the Federal Register withdrawal notice.

FinCEN said it considered public comments and withdrew the proposal as part of the administration’s deregulatory agenda and effort to ensure digital-asset rules are fit for purpose. Its October 5, 2026 release announced the withdrawal. The proposal never became an effective rule.

What would the $10,000 rule have required?

The 2020 proposal covered banks and money services businesses (MSBs) handling specified transfers of convertible virtual currency or digital assets with legal tender status. It focused on transfers involving an unhosted wallet or a wallet at certain foreign financial institutions outside the Bank Secrecy Act regime in a jurisdiction identified by FinCEN. The 2026 withdrawal notice describes an unhosted wallet as one “when a financial institution is not required to conduct transactions from the wallet.”

Proposed threshold Proposed obligation
More than $10,000 in a covered transaction, or multiple covered transactions totaling more than $10,000 within 24 hours FinCEN reporting
More than $3,000 in a covered transaction Recordkeeping, including customer identity verification

These figures are thresholds from FinCEN’s 2020 proposal, as recited in its 2026 withdrawal notice—not current obligations created by this rule. The proposed reporting trigger also covered multiple transactions that crossed the $10,000 total within 24 hours.

Does this mean you must report crypto sent to your own wallet?

This withdrawn proposal did not require individual wallet owners to file a report simply because they sent crypto to their own wallet. Its proposed duties applied to covered financial institutions and MSBs in specified circumstances. Since the proposal never took effect, neither its $10,000 reporting threshold nor its $3,000 recordkeeping threshold became obligations under it.

How is this different from the IRS broker-reporting rule?

The FinCEN proposal concerned anti-money-laundering requirements under the Bank Secrecy Act and certain transfers involving unhosted wallets. It was separate from Treasury and IRS rules on tax reporting by digital-asset brokers.
