The specified period runs through December 31, 2026; drivers should check current IRS guidance and their state’s rules before putting dyed diesel in a road vehicle.
What Trump’s October 5 order does
The executive order, “Emergency Tax Relief on Diesel Fuel”, directs Treasury to determine whether it can defer certain federal excise-tax payments incurred from October 5 through December 31, 2026. That deferral is conditional: the order does not itself cancel the tax or promise that payment will never be due.

Separately, the order directs Treasury to have the IRS announce that it will not impose specified penalties under 26 U.S.C. 6715(a)(1) or (a)(2) when dyed diesel is sold for highway use or used on a highway during that period. The order says agency guidance must identify applicable conditions, taxpayers, locations, liabilities, and deadlines. It also calls for coordination with state governments.

The order preserves other compliance activity. Section 6(b) says agencies are to “continue all compliance enforcement measures, including audits, inspections, and monitoring programs, as provided for by law.” The penalty direction should not be read as an end to fuel inspections or other enforcement.

What “red dye” diesel is—and what the order changes
Dyed diesel is marked with dye so enforcement officials can distinguish it from fuel ordinarily taxed for highway use. Under the ordinary federal framework described in the IRS’s Publication 510 (December 2025 edition), dyed fuel receives specified tax treatment subject to conditions that include registration and prescribed dyeing requirements. The publication also says a LUST tax generally remains applicable to dyed diesel, apart from specified exceptions.
The October order directs temporary steps and new guidance; it does not amount to a permanent rewrite of those baseline rules. Until agencies issue the instructions the order calls for, the precise treatment of a particular sale, use, taxpayer, or location depends on the applicable guidance and conditions.

Can you use red-dyed diesel in a truck or car?
Do not assume the order gives every driver permission to use dyed diesel on public roads everywhere. It directs federal penalty relief for a defined period and calls for state coordination, but it does not establish that every state has adopted matching rules. Before using dyed diesel in a road vehicle, check the latest IRS implementation guidance and the rules of the state where the fuel will be used.
State action can have its own scope and dates. For example, the Georgia Department of Revenue issued a separate notice providing a state penalty waiver effective October 6 through 11:59 p.m. November 5, 2026. Those dates describe Georgia’s notice only; they should not be applied to other states.

Does the order eliminate the federal diesel tax?
No. It directs Treasury to assess whether certain federal excise-tax payments may be deferred, and it directs an IRS announcement concerning specified penalties. A deferral changes when an eligible liability is paid; it is not a tax repeal. The order’s text does not establish that later payment has been cancelled.
How long does the federal relief period last?
The order specifies October 5 through December 31, 2026, for the potential deferred-payment period and the specified penalty action. That period is not the same as a guarantee that every driver or transaction qualifies: implementation guidance and applicable conditions still matter.

Will this lower diesel prices?
The White House presented the order as an affordability measure for truckers, farmers, and consumers, saying it was intended to reduce costs. The White House explanation states the administration’s goal, not a measured price result. The available reporting does not establish a verified savings amount for an individual driver or demonstrate a specific pump-price reduction. The Associated Press reported the signing in Grand Island, Nebraska, on October 5, amid political efforts to address elevated diesel costs; that context does not quantify the order’s effect on prices (AP report).

What drivers should check before filling up
- Look for current IRS implementation guidance on the order, including which taxpayers, transactions, locations, conditions, and deadlines qualify.
- Check the relevant state revenue or transportation authority for state-level rules and any separate waiver dates.
- Confirm that the specific fuel use and location fall within the applicable federal and state instructions before using dyed diesel on a highway.
