You rely on the provider’s systems and terms to access or move the assets; that arrangement does not, by itself, guarantee immediate withdrawals, insurance, or recovery if something goes wrong.
What does third-party cryptocurrency storage mean?
The key distinction is who controls access to the private keys. In third-party custody, a professional custodian or service provider controls or manages that access on a customer’s behalf. An exchange account may include custody, as may a service dedicated to safeguarding crypto-assets.

The EU’s Markets in Crypto-Assets Regulation (MiCA) defines providing custody and administration on behalf of clients as “the safekeeping or controlling, on behalf of clients, of crypto-assets or of the means of access to such crypto-assets, where applicable in the form of private cryptographic keys.” That is the EU regulation’s definition, not a universal legal definition. Crypto-assets are represented on a blockchain or similar distributed ledger. A wallet is a way to manage access to those assets; it does not literally hold the coins. The SEC’s retail investor bulletin explains that wallets store private keys or passcodes. A private key can authorize transactions, while a public key can be used to receive assets and does not authorize spending. The SEC describes custody for retail investors as “how and where you store and access your crypto assets.” SEC Investor.gov, Crypto Asset Custody Basics for Retail Investors.

How does third-party custody differ from self-custody?
| Question | Self-custody | Third-party custody |
|---|---|---|
| Who controls access to the private keys? | The user. | A professional custodian or service provider. |
| Who handles key security and backup? | The user is responsible for setup, security, and recovery. Losing the keys or seed phrase can mean losing access. | The provider manages key access; the customer depends on its security, terms, and continued operation. |
| Common forms | Software wallets and physical hardware wallets can be used for self-custody. | An exchange account or a dedicated custody provider. The provider may use internet-connected storage, offline storage, or both. |
| Main trade-off | Direct control comes with direct responsibility for security and recovery. | Key management is delegated, but provider, operational, legal, and access risks remain. |
A hardware wallet is a physical device used to manage keys; it is not third-party custody by itself. The SEC says cold wallets are generally less convenient for transactions and generally more secure from cyberthreats than hot wallets, while warning that physical devices can be lost, damaged, or stolen. SEC Investor.gov’s custody bulletin.
Are hot and cold storage the same as third-party and self-custody?
No. These terms describe different things:
- Hot or cold describes a storage method: hot storage is internet-connected; cold storage is generally kept offline.
- Self-custody or third-party custody describes who controls access to the keys.
Either a user or a provider can use hot or cold methods. Offline storage can reduce exposure to some cyberthreats, but it does not eliminate risks such as loss, theft, damage, or difficulty recovering access.

What risks remain when a provider holds the keys?
Delegating key management changes who handles day-to-day access; it does not make the assets risk-free. A custodian may be hacked, shut down, or go bankrupt, and an intermediary may restrict withdrawals. The custody label alone does not establish who legally owns particular assets, whether they are segregated, whether insurance applies, or how recovery would work after a failure.
Investor.gov warns that deposits with an unregistered intermediary may leave ownership and recovery uncertain, and that withdrawals have sometimes been suspended during intermediary distress. Whether registration obligations apply depends on the service and asset involved; that warning does not mean every crypto custodian is unregistered or that one securities rule covers every crypto arrangement. What should you ask before using a custodian?
Use these questions to understand the specific service and agreement. Asking them does not establish that a provider meets any particular standard.
- Who can access or authorize use of the private keys, and what controls govern that access?
- Does the provider subcontract storage or key management? If so, who is involved?
- Which supported assets and storage methods are available, and how are hot and cold storage used?
- Are assets commingled, lent, or used as collateral? Is customer consent required?
- What physical and cybersecurity safeguards are used, and what privacy or data-sharing practices apply?
- What does any insurance policy actually cover, and what exclusions or limits apply?
- What setup, annual, transaction, transfer, and account-closure fees apply?
- What happens to access and withdrawals if the provider suspends service, fails, or enters insolvency proceedings?
The SEC’s retail bulletin recommends researching a provider and its regulation, checking supported assets, and examining key access, subcontracting, security, insurance, asset-use, privacy, and fee terms. SEC Investor.gov’s custody bulletin.

UK government material uses the term “custodian wallet provider” for a firm or sole practitioner that safeguards or administers cryptoassets or private keys for customers. It distinguishes hosted wallets, where a third party stores keys, from unhosted wallets, whose keys are administered by the user. This is UK terminology, not a universal definition.
