Tesla FSD: What NHTSA Records Can—and Can’t—Verify

NHTSA has investigated reported Tesla FSD crashes in reduced visibility, including a fatal pedestrian strike. Those records do not corroborate the specific New Jersey crash details reported by The Tech Edvocate.

The specific New Jersey crash described in a September 10, 2026, article by The Tech Edvocate is not corroborated by the official NHTSA records reviewed here. Those records do document a separate fatal pedestrian crash involving Tesla’s Full Self-Driving (FSD) system in a reduced-visibility investigation—but they do not establish that the New Jersey incident happened as described, or that FSD caused the separate crash.

What is—and is not—verified about the New Jersey crash claim?

The Tech Edvocate article says a Tesla Model 3 fatally struck an 82-year-old pedestrian at a stop sign in New Jersey on July 6, 2025, while driver assistance was engaged. The official NHTSA materials reviewed for this article do not corroborate those specific details: the date, location, pedestrian’s age, stop-sign scenario, or system state.

That is a limit on what these records establish, not proof that no such event occurred. Nor would evidence that a driver-assistance system was engaged, by itself, prove that it caused a crash. The specific New Jersey account should therefore be treated as an unverified claim unless supported by independent documentation.

What fatal Tesla FSD crash does NHTSA document?

NHTSA’s October 2024 preliminary evaluation, PE24031, identified four crash reports involving FSD in reduced-visibility conditions. The reported conditions included sun glare, fog, and airborne dust. One report involved a fatal pedestrian strike, and another involved a reported injury. These are incidents identified when the agency opened its evaluation—not a complete count, a per-mile risk estimate, or a final finding that a defect caused a crash.

This is verified regulatory context, but it is distinct from the New Jersey story. The reviewed records do not connect the fatal pedestrian strike in PE24031 to the date, location, age, or stop-sign details reported by The Tech Edvocate.

How have NHTSA’s FSD investigations developed?

NHTSA opened PE24031 in October 2024 to examine FSD crashes reported in reduced visibility. In March 2026, it opened engineering analysis EA26002 to examine whether FSD detects degraded visibility and warns drivers with enough time to respond. An engineering analysis is still an investigation, not a completed determination of defect or causation.

NHTSA matter What the opening or summary records report What the figures mean
PE24031, opened October 2024 Four reduced-visibility FSD crash reports; one fatality incident and one additional injury incident. Estimated affected-vehicle population: 2,410,002. Counts identified when the preliminary evaluation opened; the population is not the number of vehicles involved in crashes.
EA26002, opened March 2026 Nine crashes and one fatality incident in the failure-report summary. Estimated vehicle population in scope: 3,203,754. Investigation-summary counts and a scope estimate, not a final causal finding or an exposure-adjusted rate.
PE25012, opened October 2025 58 incidents and 14 crashes or fires in the opening failure-report summary; zero fatality incidents listed. Reports summarized at the evaluation’s opening, not a complete safety rate or a final agency conclusion.

These matters address different questions. PE24031 concerns reported crashes in reduced visibility; EA26002 examines detection and driver-warning performance in those conditions; PE25012 concerns reported traffic-law violations while FSD was engaged. Their counts should not be combined as though they describe one set of events.

Does “Full Self-Driving” mean the car drives without supervision?

No. NHTSA describes Level 2 systems as providing assistance with steering and acceleration or braking while the human driver remains responsible for driving and monitoring the road. NHTSA’s October 2025 PE25012 opening resume says Tesla characterizes FSD as Level 2 and that the driver remains responsible for complying with traffic laws.

NHTSA’s Automated Vehicle Safety guidance puts the distinction plainly: “At this time, even the highest level of driving automation available to consumers requires the full engagement and undivided attention of drivers.” The product name can sound like a promise of unsupervised driving; the Level 2 classification and supervision obligation do not.

What is NHTSA examining about traffic-law behavior?

In October 2025, NHTSA opened PE25012 after receiving reports of possible traffic-law violations while FSD was engaged. The opening resume describes concerns including red-light intersection behavior, maneuvers into opposing lanes, and other traffic-law issues. Its summary table listed 58 incidents and 14 crashes or fires, with zero fatality incidents at that opening stage. These are defined reports in an open evaluation, not proof that every reported event involved a violation or a system defect.

Why can’t incident counts tell you whether FSD is safer?

NHTSA collects certain crash and incident reports under its Standing General Order, which has defined reporting thresholds for Level 2 advanced driver-assistance systems. A report count is not necessarily a census of all crashes. It also does not show risk per mile, compare drivers with and without assistance, or establish that a system caused the reported event.

For context only, NHTSA counted 39,254 people killed in motor-vehicle crashes in the United States in 2024. That broad national total is not an autonomous-driving statistic and cannot be used to calculate or compare FSD risk. The investigation populations and report counts above likewise do not provide the exposure-adjusted comparisons needed for a safety ranking.

What can readers conclude now?

Official records substantiate a separate fatal pedestrian strike among the reduced-visibility crashes identified in NHTSA’s FSD investigation. They do not substantiate the specific New Jersey details in The Tech Edvocate article as reviewed here. NHTSA’s later engineering analysis is assessing degraded-visibility detection and warning timing, while a separate evaluation examines reported traffic-law behavior. The outcomes of those open investigations are not established by their opening records.
