The available dated reports do not support the claim that the alleged “fixer” pleaded guilty. The Justice Department announced charges on March 19, 2026, and a report published April 1 said Ting-Wei “Willy” Sun had pleaded not guilty. Those reports do not establish whether there was a later change in his plea.

What is the status of the case?

The U.S. Department of Justice (DOJ) announced on March 19, 2026, that Yih-Shyan “Wally” Liaw, Ruei-Tsang “Steven” Chang and Ting-Wei “Willy” Sun had been charged in a conspiracy to divert U.S.-assembled servers containing advanced artificial intelligence technology to China. The announcement described charges in an indictment, not findings of guilt.

MLex reported on April 1, 2026, that Sun pleaded not guilty. That is the latest plea-status information established by the dated accounts cited here; it does not verify a later plea or other case disposition. A guilty plea should not be reported as fact without a subsequent court record confirming it, including the date and count or counts involved.

What do prosecutors allege happened?

According to the DOJ’s March 19 announcement, Sun was a third-party broker who worked with Liaw, Chang and others to divert technology subject to U.S. export controls. Prosecutors allege that high-performance servers assembled in the United States were routed to China through a scheme involving:

NEMIX RAM 128GB (8X16GB) DDR5 5600MHz PC5-44800 1Rx8 1.1V CL46 288-PIN ECC RDIMM Registered Server Memory KIT
  • EXACT-MATCH UPGRADE — 128GB (8X16GB) kit DDR5-5600 (PC5-44800), 1Rx8 Registered ECC, 1.1V, CL46, 288-pin. The precise rank, voltage, and timing your server's memory controller expects, so it's recognized at full capacity and runs at its rated speed.
  • VERIFIED FITMENT — Compatible with Emerald Rapids, Xeon Scalable, PowerEdge, ProLiant, ThinkSystem, Supermicro. Spec-matched to your board's memory-population rules.
  • ENTERPRISE STABILITY — Registered (buffered) architecture offloads the memory controller so every slot runs fully populated at full capacity, while ECC catches and corrects single-bit errors on the fly — stopping silent data corruption and unplanned reboots before they reach production.
  • CHECK YOUR CONFIG — Server and motherboard memory support varies by model. Consult your system or motherboard manual for supported capacities, approved DIMM population order, and installation steps before purchase.
  • LIFETIME SUPPORT — Backed by a lifetime replacement warranty and free US-based technical support.
  • Fabricated documents;
  • Staged, bogus equipment intended to pass inventory audits; and
  • A pass-through company used to conceal the actual customer list and destination.

The DOJ said Liaw and Sun were arrested on March 19, 2026, while Chang was a fugitive at the time of the announcement. These are allegations made by prosecutors, not independently established facts about the defendants’ guilt.

What do the reported dollar figures mean?

ABC News reported on March 20, 2026, that the indictment alleged about $2.5 billion in server purchases through the pass-through company between 2024 and 2025. The report also attributed to the indictment an allegation that at least $510 million in servers were diverted to China between late April and mid-May 2025.

Both figures describe alleged transactions in this case. They are not court findings, an adjudicated loss amount or a general measure of AI-server exports.

Why are export controls part of the case?

The DOJ framed the prosecution as an export-control case involving advanced AI technology and servers assembled in the United States. Its announcement said U.S. Commerce Department restrictions include license requirements for exports and reexports of AI technologies to China and Hong Kong, and described the controls as serving national-security and foreign-policy interests.

Was Super Micro Computer charged?

The DOJ announcement names Liaw, Chang and Sun as charged individuals. The announcement does not name Super Micro Computer as a defendant, so the individual charges should not be described as charges against the company. The case concerns alleged diversion of servers; the DOJ account cited here does not identify a specific server model.
