As of October 7, 2026, the U.S. Section 232 chip tariff is a 25% duty on a narrowly defined group of advanced computing chips and derivative products—not a blanket tariff on every semiconductor or device containing one. It took effect January 15, 2026, and includes substantial, use-based exceptions, including for products imported for U.S. data centers. Whether a shipment is covered depends on its technical classification, entry date, and declared use.
What is Section 232, and why was it used for chips?
Section 232 is a U.S. authority for adjusting imports after an investigation into their effects on national security. The Commerce Department’s Bureau of Industry and Security (BIS) says the Secretary generally prepares a report within 270 days of initiating an investigation; the President may accept or reject its recommendations and take action. BIS’s Section 232 overview explains the process.

Commerce opened the semiconductor investigation on April 1, 2025. Its scope included semiconductors, semiconductor manufacturing equipment, and derivative products: examples in the Federal Register notice include substrates and bare wafers, legacy and leading-edge chips, microelectronics, equipment components, and downstream products containing semiconductors. The investigation notice describes that broad subject; it does not mean every item in that scope automatically became subject to the January 2026 duty.

In the January 14, 2026 proclamation, the administration said the Commerce Secretary had transmitted the investigation report to the President on December 22, 2025, and found that imports, in their quantity and circumstances, threatened to impair national security. The proclamation attributed that finding to insufficient U.S. production capacity for semiconductors, certain equipment, and derivative products to meet domestic demand, creating dependence on foreign sources. This is the administration’s stated rationale, not an independently established production statistic. The proclamation sets out the finding and action.

What products does the 25% chip tariff cover?
The proclamation imposes a 25% ad valorem duty—calculated as a percentage of the applicable customs value—on products meeting its coverage rules. It applies to covered goods entered for consumption, or withdrawn from a warehouse for consumption, on or after 12:01 a.m. Eastern Standard Time on January 15, 2026. The proclamation says the duty is additional to otherwise applicable duties except where it specifically provides otherwise.
The operative coverage is defined by product classifications and technical criteria, not simply by whether something is called a chip. Customs and Border Protection (CBP) entry guidance identifies HTSUS headings 8471.50, 8471.80, and 8473.30, along with technical thresholds for logic integrated circuits and articles containing them, including performance and DRAM-bandwidth ranges. It directs importers to report an additional 25% ad valorem duty for covered entries. CBP’s CSMS guidance provides entry details; use it with the proclamation annex and current HTSUS notes when assessing a particular product.

The White House named NVIDIA H200 and AMD MI325X as examples of advanced computing chips. Those examples are not a complete product list and do not, by themselves, settle how a particular shipment should be classified. Coverage depends on the controlling technical definitions and customs classification. The White House fact sheet gives the examples; CBP guidance and the legal annex supply implementation details.

No. The investigation examined a broad set of semiconductor-related imports, but the immediate January 2026 duty applies only to specifically defined covered products. A chip, machine, or downstream device is not automatically subject to this 25% rate just because it contains semiconductor technology or appeared within the investigation’s subject matter. The product must meet the proclamation’s coverage rules, and the entry must fall within the effective period.

Which uses are exempt from the duty?
The proclamation lists exceptions for covered products imported for specified uses. These include:
- U.S. data centers;
- repairs or replacements performed in the United States;
- U.S. research and development;
- U.S. startups;
- consumer applications outside data centers;
- civil industrial applications outside data centers;
- U.S. public-sector applications; and
- other uses the Secretary determines will strengthen the U.S. technology supply chain or domestic manufacturing capacity for semiconductor derivatives.
These are use-based exceptions, not blanket exemptions attached to a product name. Classification, declared end use, and any applicable certification or administrative steps matter. Importers should consult the proclamation and CBP instructions and obtain qualified customs advice for a shipment.

How does the duty interact with other tariffs and customs charges?
For products covered by this proclamation, its terms and duties control over another Section 232 proclamation. It also excludes covered goods subject to this clause from specified duties imposed under Executive Orders 14257, 14193, and 14194. That does not mean all other customs duties or charges disappear: the proclamation describes the 25% duty as additional to otherwise applicable duties unless it specifically says otherwise. It also states that drawback is unavailable for duties imposed under this proclamation.
Have broader semiconductor tariffs taken effect?
The January proclamation directs Commerce and the U.S. Trade Representative to pursue or continue negotiations. It says broader, significant tariffs and a tariff-offset program may be considered depending on the negotiations’ status or outcome; the White House fact sheet also presents broader tariffs as a possible future action. Those statements describe potential next steps, not an expansion already made effective by the January action. The official materials cited here establish the narrow duty described above, not a later broad tariff. Because trade measures can change, check for subsequent proclamations, Federal Register notices, and CBP guidance before relying on this date-sensitive explanation.

How to assess a specific import
A product name alone is not enough to determine whether the duty applies. For an import decision, work through these questions in order:
- Classification: What HTSUS classification applies, and does the product meet the proclamation’s technical definition and thresholds? Check current HTSUS notes, the proclamation annex, and CBP’s complete guidance.
- Covered product: Is the item itself a covered product or derivative under the operative rule, rather than merely part of the broader investigation subject?
- End use: Is the declared use within a listed exception, and are the relevant certification or administrative requirements met?
- Entry date: Was the good entered for consumption or withdrawn from warehouse for consumption on or after the effective date?
- Other measures: Which other duties apply, and does a specific provision in the proclamation alter their interaction?
These are classification and compliance questions, not a tariff determination for any particular shipment. The controlling documents are the proclamation, its annex, CBP’s entry guidance, and current HTSUS materials.
