Rhode Island Labor Laws Guide: Wages, Overtime, Breaks and Leave (2026)

Rhode Island’s general minimum wage is $16 an hour in 2026, but wage, overtime, break, leave, and youth-work rules depend on the worker and workplace.

Rhode Island’s general minimum wage is $16.00 per hour, effective January 1, 2026. Other rules depend on the worker’s age and job, the employer’s size, and the circumstances. This guide explains the main rules for workers and employers; it is an overview, not a decision about any individual claim.

What’s the current minimum wage?

The Rhode Island Department of Labor and Training (DLT) lists a general minimum wage of $16.00 an hour effective January 1, 2026. Its 2026 notice also lists narrower rates: $14.40 for certain students, $12.00 for certain 14- and 15-year-olds, and a $3.89 cash wage for tipped workers. These are not general alternatives to the standard rate: eligibility rules and other requirements apply, so workers and employers should check the current DLT notice and guidance before relying on one.

For tipped workers, the cash wage is not a guaranteed total-pay figure. DLT says wages plus tips must reach the regular minimum wage; if they do not, the employer must pay the difference.

What workers can do

  • Compare your pay rate with the rate that applies to your job category, and keep pay statements and your own record of hours and tips.
  • If your pay appears short, raise the issue with your employer or contact DLT Labor Standards about a wage complaint.

What employers should do

  • Confirm that a worker meets the requirements for any student, minor, or tipped-worker rate before using it.
  • For tipped employees, track wages and tips and make up any shortfall against the applicable minimum wage.

How often does my employer need to pay me?

DLT says, “Most Rhode Island employers are required to pay their employees every week.” Exceptions exist, so a different schedule should not be assumed to be permitted without checking the current rules. DLT’s Labor Standards FAQ and laws index are the appropriate places to confirm whether an exception applies.

Employers must maintain accurate daily and weekly time records. DLT’s December 2024 wage and workplace law guidebook also discusses payroll records, pay statements, and exceptions involving biweekly pay. Because that guidebook is older than the current wage notice, check the latest DLT requirements rather than relying on it alone for specific record-retention periods or approval procedures.

For employees

Keep your own notes of the days and hours you work and compare them with your pay statements. If the pay period or hours recorded do not match what you worked, ask for an explanation and keep relevant records.

For employers

Use a reliable timekeeping process that captures daily and weekly hours, and issue pay on the schedule applicable to your business. Check current DLT guidance for the detailed rules on statements, records, and any payment-frequency exception.

Should I be paid more for working overtime?

For eligible workers, Rhode Island’s general rule is at least 1.5 times the regular rate for hours worked over 40 in a workweek. DLT’s January 2026 employee notice states: “Overtime Pay – At least 1½ times the regular rate of pay for all hours worked over 40 in any one workweek.” Some occupations and establishments are exempt under state or federal rules. A salary by itself does not establish that a worker is exempt.

Retail work on Sundays or holidays has a specific interaction with the state’s overtime calculation. Do not assume that a Sunday or holiday premium automatically stacks with overtime for every worker or every hour. Classification, industry, and the applicable rule matter.

For employees

  • Track total hours by workweek, not just by day or pay period, and review how your regular rate and overtime were calculated.
  • If you are salaried or work in an occupation that may be exempt, ask which exemption your employer is applying; the label alone does not settle the question.
  • For Sunday or holiday work, check the applicable DLT rule rather than assuming a universal premium or a particular stacking formula.

For employers

  • Determine coverage based on the employee’s duties and the applicable state and federal rules, not salary status alone.
  • Track hours across each workweek and calculate overtime for covered workers using the applicable regular-rate rules.
  • Review Sunday and holiday schedules under the specific retail rules where relevant.

Does my employer have to give me a lunch break?

DLT’s meal-period FAQ describes a general requirement of a 20-minute meal period for a six-hour shift or a 30-minute meal period for an eight-hour shift. Exceptions include licensed health-care facilities and workplaces with fewer than three employees on a shift. The rule is not a promise of the same break in every job or setting; check DLT guidance for how it applies to a particular schedule and workplace.

Does my employer have to give me paid sick leave?

Rhode Island’s Healthy and Safe Families and Workplaces Act provides covered employees up to 40 hours of sick and safe leave annually. Whether that leave must be paid depends on employer size: employers with at least 18 employees must provide paid leave; employers with fewer than 18 must provide leave that may be unpaid.

Covered reasons include an employee’s illness, injury, or routine medical appointment; qualifying health needs of a child, spouse, domestic partner, or household member; and specified safety-related needs involving domestic violence, sexual assault, or stalking. DLT says advance notice applies when leave is foreseeable at least 24 hours in advance, and documentation is limited in specified circumstances. Consult current DLT guidance for coverage, qualifying uses, notice, and documentation rules.

For employees

Give advance notice when the leave is foreseeable and the rule requires it. If an employer requests documentation, check the limits in DLT’s guidance before assuming what may be required.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For employers

Determine coverage and whether leave must be paid using the employer-size rule, and apply the statutory limits on notice and documentation. Do not treat every sick or safety-related absence as outside the law without checking its qualifying-use rules.

Is paid vacation required, and what happens to accrued vacation when employment ends?

Rhode Island does not generally require employers to offer paid vacation. If an employer offers vacation, DLT’s FAQ says accrued vacation is payable at separation after at least one year of employment. Employees should check the employer’s vacation policy and DLT’s current guidance when employment ends.

Am I allowed to work if I’m under 18 years old?

Yes, minors may work, but the rules depend on age and circumstances, including school status, school vacations, federal coverage, and specific exceptions. DLT distinguishes workers ages 14–15 from those ages 16–17; there is no single schedule that safely describes every minor’s permitted hours or curfew.

For 14- and 15-year-olds, DLT requires the employer to complete an Intention to Employ a Minor form and retain the worker’s Special Limited Permit to Work. Older minors also face work-hour, curfew, and rest restrictions. Employers and families should use DLT’s current age-specific youth employment guidance and forms before work begins.

For young workers and families

  • Confirm the worker’s age category and school circumstances before accepting a schedule.
  • Ask the employer which permit and forms apply, and check that the proposed hours meet the rules for that minor.

For employers

  • Use the current DLT youth employment page and forms to verify permitted hours and conditions for each minor.
  • Complete the Intention to Employ a Minor form for 14- and 15-year-olds and retain the required Special Limited Permit to Work for employees under 16.

Where can I report a wage problem or discrimination?

DLT Labor Standards investigates specified matters including minimum-wage and pay complaints, overtime, Sunday and holiday premiums, vacation pay at termination, child labor, and leave. Its Wage Complaints page is the official starting point for a Rhode Island state wage complaint. The agency’s workplace notices and current guidance can also help employers and employees identify applicable rules.

Discrimination concerns follow a separate route: DLT directs workers to the Rhode Island Human Rights Commission or the state Division of Equity, Diversity & Inclusion. DLT’s laws index covers statutes on wages, payment, leave, child labor, wage discrimination, whistleblowers, and Sunday and holiday work. Different agencies and legal processes may apply depending on the issue.
