The U.S. Nuclear Regulatory Commission issued a construction permit on March 9, 2026, for Kemmerer Power Station Unit 1 in Wyoming. The permit holder is US SFR Owner, LLC, a wholly owned subsidiary of TerraPower—not NuScale. The action authorizes construction, not reactor operation.
Which reactor received the construction permit?
The NRC’s permit CPAR-1 is for Kemmerer Power Station Unit 1, a sodium-cooled advanced reactor project in Wyoming. Its holder, US SFR Owner, LLC, is a wholly owned TerraPower subsidiary. The Commission authorized issuance through Order CLI-26-5. NRC project information identifies the project and permit holder.

The NRC described the action as the first commercial reactor construction approval in nearly a decade and the first approval for a non-light-water reactor in more than 40 years. Those are the agency’s historical characterizations. It also said staff completed the design’s technical review in less than 18 months. The NRC’s March 2026 announcement provides those descriptions.

A construction permit is a project-level licensing milestone: it authorizes the holder to build the facility, but it does not authorize operation. Under the NRC’s Part 50 pathway, the applicant must obtain a later operating license before the plant can operate. The NRC’s licensing overview describes the separate construction-permit and operating-license steps.
#1 Best Overall
- Accurate WWII Replica : A 1/12 scale model of the U.S. Little Boy atomic bomb, metal model kits for adults, crafted from aluminum alloy for durability
- Heavy Weight : Thickened aluminum alloy sheet, Solid main body with a dedicated display stand
- Complete Assembly Tools : Includes an assembly guide, screwdriver, sanding rod, and decals for a rewarding build experience, with minimal glue(not include) needed
- Easy to Assemble : With a detailed manual, you can follow the steps to sand and assemble, quickly achieving your very own masterpiece
- Perfect for Collectors : Innovative full-metal nuclear bomb model, a must-have for history enthusiasts and collectors interested in WWII memorabilia
So “cleared for construction” does not mean Kemmerer Unit 1 is already built, generating electricity, or cleared to operate.
How is this different from NuScale’s approval?
NuScale’s US460 action was a Standard Design Approval, issued by the NRC on May 29, 2025. It approves a design that can be referenced in applications; it is not a permit to build or operate a specific NuScale plant. NuScale would still need to apply for permission to build and operate a facility using that design. The NRC’s NuScale licensing page describes the approval and remaining facility licensing steps.

| Reactor description stated by NRC | Sodium-cooled advanced reactor project. NRC March 2026 announcement | Light-water small modular reactor; six modules of 77 megawatts each, totaling approximately 460 megawatts. NRC NuScale page |
| What can happen next? | The permit authorizes construction; a later operating license is required before operation. NRC licensing overview | A facility using the approved design still needs applications for permission to build and operate. NRC NuScale page |
The two actions concern different companies, projects, reactor descriptions and kinds of NRC approval. NuScale’s design approval was not a rejection, nor was it the permit issued for Kemmerer. The available NRC descriptions do not establish a like-for-like technical comparison between the sodium-cooled Kemmerer project and NuScale’s light-water design.

In its March 4, 2026 news release, NRC Chairman Ho Nieh called the action “a historic step forward for advanced nuclear energy in the United States” and said it reflected the agency’s commitment to timely, predictable decisions grounded in an independent safety review. That is the regulator’s account of its decision; it is not an assessment of the project’s economics or operating performance. NRC news release.
