A licensed dealer generally must check a buyer through NICS before a non-exempt transfer and keep required transaction records. Those are not universal rules for every sale: state and local laws can add requirements, and interstate transfers follow different rules.

This is a federal framework, not a state-by-state determination. The Congressional Research Service’s 2025 overview describes the broader variation in U.S. gun laws; check the current official law for the states and localities involved before arranging a transfer.

Do private firearm sales require a background check?
For the ordinary same-state transaction between two people who are not federally licensed, ATF says the Gun Control Act does not require an FFL to conduct the transaction or require federal recordkeeping. That does not mean a seller can knowingly—or with reasonable cause to believe—transfer a firearm to someone prohibited from possessing one. DOJ’s explanation of federal law makes clear that the prohibited-person restriction still applies even where federal law does not mandate a private-sale check.

State and local rules can change the answer. They may require a background check or require the parties to use a dealer, and may impose permits, waiting periods, or recordkeeping. Because requirements vary and can change, do not infer that a sale is lawful solely because both parties live in the same state.

What happens when a licensed dealer makes the transfer?
A dealer generally verifies the buyer’s identity, completes the required transaction procedures, and contacts the National Instant Criminal Background Check System (NICS) before transferring a firearm to a nonlicensee. Federal law and regulations provide exceptions. For example, a qualifying permit recognized under the applicable rules may substitute for the check in specified circumstances; not every permit qualifies. ATF’s NICS-exemptions guidance and Brady Permit Chart describe the relevant categories.
NICS is a background-check system, not a guarantee that every prohibited person will be identified or that every transaction requires a check. CRS reported that NICS had processed more than 500 million background-check transactions since 1998 in its overview updated September 12, 2025; that is a cumulative figure, not an annual count.

What records does a gun dealer keep?
Federal dealer recordkeeping includes acquisition and disposition records and a completed Form 4473 for applicable transfers. ATF’s dealer guide describes the record requirements and retention periods; completed sale or disposition records generally must be retained for at least 20 years under the current framework. The precise records and applicable periods depend on the transaction and governing rules.
These are records maintained by licensees, not evidence of a single universal federal registry. DOJ explains that dealer records can assist with tracing a recovered firearm to its first retail purchaser and investigating suspected straw purchases.

Proposed retention changes are not current requirements
ATF’s May 6, 2026 notice on firearm-record retention is a proposal, not an effective change to current retention obligations. It discusses specific periods, including possible 20- or 30-year periods for certain records, and covers records used to facilitate private-party transfers. Do not treat those proposed options as the present rule. Consult ATF’s current guidance for the operative requirements.
Can you sell a firearm to someone in another state?
Do not use the same-state private-transfer rule for a transaction across state lines. ATF guidance generally calls for a firearm to be sent or delivered to a licensed dealer in the buyer’s state, where the receiving dealer handles the buyer’s paperwork and applicable background-check procedure. Federal law has limited exceptions for certain long-gun transactions, subject to conditions; do not assume an exception applies without checking those conditions and the laws of both states.

If the transaction crosses state lines, contact a licensed dealer in the buyer’s state and confirm the applicable federal, state, and local requirements before transferring or shipping the firearm.

Potentially. An occasional private disposition is different from operating as a firearms business, but the facts and current law matter. Federal law requires a license for a person who meets the definition of a dealer; the 2024 ATF final rule implements the broadened “engaged in the business” definition in the Bipartisan Safer Communities Act.

That rule’s present application requires care. ATF’s rule page, last updated May 12, 2026, identifies a preliminary injunction protecting named plaintiffs and a May 2026 proposal to rescind the rule. The information cited here does not establish the ultimate result of the litigation or whether the proposal has since changed the law. Anyone whose selling activity may amount to a business should check the current ATF rule page and applicable court status rather than relying on a blanket claim about the rule.

Practical checks before arranging a transfer
- Confirm where both parties reside. A same-state transfer and an interstate transaction do not follow the same federal route.
- Check current state and local rules. Verify any required background check, permit, dealer involvement, waiting period, and records through official sources for the relevant jurisdictions.
- Do not proceed if there is reason to believe the recipient is prohibited. The absence of a federally mandated private-sale check does not remove the seller’s legal restriction.
- Use a licensed dealer when the rules call for one or the route is unclear. Ask the dealer about its transfer process and policies; fees and participation vary.
- Plan for safe storage. DOJ notes that dealers provide child-safety locks with handgun transfers and offer secure-storage options. A lock or storage device does not make an otherwise unlawful transfer lawful.
