Contracts on registered prediction-market exchanges are treated by the Commodity Futures Trading Commission (CFTC) as derivatives under federal commodities law; sportsbooks operate under state or tribal gaming authorization. Whether federal rules preempt state gambling laws for sports-related event contracts remains contested. The answer can depend on where you are and may change as legal actions develop.
How a prediction-market contract differs from a sportsbook wager
Prediction markets: buying and selling event contracts
The CFTC describes an event contract as a financial contract whose value depends on whether an event occurs, does not occur, or reaches a specified extent. Many are structured around a yes-or-no outcome. A displayed price reflects what market participants are currently willing to pay; it is not a guarantee that the crowd’s implied probability is correct.

On an order-book market, customers trade with other participants rather than necessarily placing a wager against the platform. Prices can move before the event is settled, and some contracts can be sold before settlement. Whether that is practical depends on the contract’s liquidity, fees and venue rules. The CFTC says registered exchanges generally facilitate trading rather than take the opposite side, but that structure does not make a position safe or profitable.

Sportsbooks: wagering under house rules
A sportsbook accepts wagers under its own published rules and the gaming framework where it is licensed. The sportsbook’s odds and payout calculation determine what a winning wager returns. Early cash-out, if offered, depends on the operator and product; it is not the same as assuming an open prediction-market contract can always be sold at a reasonable price.

Who regulates them—and why the state-law question is unsettled
Federal oversight of registered event-contract markets
The CFTC says event contracts traded on registered designated contract markets (DCMs) are subject to federal commodity-market law. DCMs must register and meet Commodity Exchange Act and CFTC requirements, including market-integrity obligations and surveillance. The CFTC says regulated exchanges must maintain rules addressing manipulation and insider trading, and advises customers to understand fees, penalties, payout terms and settlement determinations.
On March 12, 2026, the CFTC’s Division of Market Oversight issued an advisory reminding DCMs of their obligations, including matters relevant to sports event contracts. The advisory addresses exchange responsibilities; it is not a guarantee of customer protection from losses.

State gaming regulators’ position on sports contracts
State regulators have argued that some sports event contracts are sports wagering subject to state gaming laws. Connecticut provides a specific example, not a nationwide rule: on December 3, 2025, the state Department of Consumer Protection said KalshiEX LLC, Robinhood Derivatives LLC and Crypto.com lacked Connecticut sports-wagering licenses and ordered them to stop offering sports-event contracts to state residents. The agency cited state requirements involving age limits, technical standards, integrity controls, house rules, self-exclusion and consumer remedies. In September 2026, Connecticut officials announced further actions and said the state’s licensed-sportsbook rules and safeguards apply.
Those announcements establish Connecticut’s enforcement position; they are not a nationwide judicial ruling. The CFTC asserts that federal law gives it exclusive authority over event contracts on registered markets. State regulators have challenged sports-related offerings under state gambling laws, while the CFTC has sued states over their actions. In March 2026, the Commission published an advance notice saying it had withdrawn earlier proposed rules for reconsideration amid state actions and litigation; the notice solicits comments and does not resolve the dispute.
As of October 4, 2026, the responsible description is that the federal-state boundary for sports-related contracts is contested and changing. Neither the CFTC’s view nor a state regulator’s enforcement position, by itself, establishes a simple nationwide answer for every platform or contract. Platform access and legal status must be checked for the reader’s location and date.

Compare the practical risks and protections
| What to compare | Prediction-market event contract | Licensed sportsbook |
|---|---|---|
| Regulatory route | Federal derivatives framework applies to contracts on CFTC-registered DCMs; how that framework interacts with state gambling laws for sports contracts is disputed. | State or tribal gaming authorization and rules for the relevant location. |
| Price and exit | Often an order-book price that can move; some contracts may be sold before settlement. Fees and liquidity vary by venue and contract. | Odds and house rules determine the wager payout; early cash-out is operator- and product-specific. |
| Oversight and recourse | Registered DCMs have CFTC obligations. Check the venue’s registration, account terms and complaint channel; state regulators dispute the reach of federal authority for sports contracts. | The relevant gaming regulator sets licensing and consumer-protection requirements; safeguards and complaint routes vary by jurisdiction. |
| User protections | Federal exchange rules address matters such as integrity and disclosures. How gambling-specific age, self-exclusion and consumer remedies apply is part of the contested debate. | Local rules may impose age, responsible-gaming, integrity and technical requirements. |
| Before entering a position | Read the exact contract, event definition, settlement source and fees; assess liquidity, venue registration and the local legal position. | Verify the operator’s local license, age eligibility, odds, house rules, settlement, self-exclusion options and regulator complaint route. |
Losses, fees and the risk of being unable to exit
Both formats can lose money. The maximum loss on a binary-style contract may be the amount paid or another amount specified by its terms, but there is no universal loss cap to assume without reading the contract and account terms. Fees reduce returns, and an open position’s displayed price does not guarantee that a buyer is available when you want to exit. Sportsbook odds and payout calculations work differently, so compare the actual amount at risk and potential return rather than headline prices or promotions. The CFTC’s consumer guidance puts it plainly: “All speculation involves risk.” Use only money you can afford to lose and monitor open positions.

Settlement, integrity and consumer remedies
Before participating, find out which source determines the event result, how the rules handle postponements or other unusual outcomes, and how to challenge a settlement. These details are contract- or operator-specific. Connecticut’s regulator said the rules of the named platforms had not been reviewed by its gaming regulator and that the state DCP could not recover consumer losses in a dispute involving those unlicensed platforms. That example shows why local license status and complaint channels matter; it does not establish the remedies available for every platform or state.
The CFTC says registered exchanges must monitor for manipulation and insider trading. Connecticut’s regulator alleged that the cited platforms lacked state gaming integrity controls and could expose users to people with privileged information. Those are claims about specific offerings by a state agency, not a finding that every event-contract market has the same deficiencies.

Age limits and responsible-play protections
Minimum ages and responsible-gambling tools vary by jurisdiction. Connecticut says its online and in-person gaming and sports-wagering age is 21, and alleged that the platforms named in its December 2025 action allowed access by people under 21 and by self-excluded users. Do not apply Connecticut’s age rule or safeguards to other states. Check your local requirements and available self-exclusion resources; if gambling is becoming difficult to control, seek local support.
How to check a specific platform or wager
- Confirm where you are and when you are checking. Review the latest position of your state or tribal gaming regulator and any relevant court or agency actions. Do not infer legality from availability in an app.
- Identify the legal operator and venue. For an event contract, check whether the venue is a CFTC-registered DCM and read the account agreement. For a sportsbook, verify that the operator is licensed for your location through the relevant gaming regulator.
- Read the exact market or wager rules. Check the event definition, settlement source, cancellation or void conditions, fees, payout calculation and dispute route.
- Work out the exposure before paying. Consider the amount at risk, likely fees, liquidity and whether an early exit is actually available under the product’s terms.
- Check user protections. Confirm your age eligibility, self-exclusion status, integrity controls and the regulator or exchange process for complaints.
What the published figures do—and do not—show
A CFTC Federal Register advance notice states that DCMs certified approximately 1,600 event contracts for listing in 2025, spanning categories including financial, political, scientific, cultural and sporting events. That is the Commission’s count of contracts certified for listing; it is not a count of sports-betting customers, active contracts, handle or market value.
