Open-Source vs. Closed AI Models: Safety, Oversight, and Access

Open weights can enable local use and adaptation, while hosted models keep operation under provider control. Compare artifacts, permissions, safeguards, and evidence rather than assuming one type is safer.

Neither open-source nor closed AI models are inherently safer. The practical differences depend on what a developer releases, what the license allows, how the model is deployed, and whether safeguards can be tested and maintained. Downloadable weights can enable local control, adaptation, and outside scrutiny; a hosted model keeps operation under provider control, which can make access restrictions and centralized updates easier. Each approach also has limitations.

What “open-source” means for AI models

“Open-source” and “closed” are shorthand for different release choices, not two precise or universally agreed categories. To assess a model, check which artifacts are available and what users are permitted to do with them.

  • Weights: the learned parameters that let a model generate outputs. Downloadable weights allow a user to run or adapt the model, subject to hardware needs and license terms.
  • Architecture and documentation: descriptions of how the model is designed and how it was developed or evaluated.
  • Inference code: software for running a trained model. Making it available does not reveal how the model was trained.
  • Training code and data: the code and data used to create the model. Their availability can affect how independently others can reproduce or validate results.
  • Evaluation results: reports about testing, including what was tested and under which conditions. Published results are evidence to assess, not proof that a model is safe in every deployment.
  • License: the rules for use, modification, commercial deployment, and redistribution. Downloadable weights do not automatically mean unrestricted use.

The International AI Safety Report 2026 notes that Meta’s Llama models have restrictive license conditions and include inference code but not training code, and are typically not considered open source. This illustrates why “open weights” is not equivalent to releasing the full model-building process with unrestricted permissions.

How access changes oversight and control

Question Downloaded weights and local operation Hosted model or API
Who operates the model? The user or organization can operate a local copy, if it has the required infrastructure and the license permits the intended use. The provider operates the model and mediates use through a hosted service or API.
What can the user control? Local operation can support adaptation and changes to the deployment. The extent of permitted changes depends on the license and available artifacts. The provider controls the hosted model and its service. Users generally have less access to model internals.
How can access be restricted? After weights are downloaded and redistributed, the developer cannot reliably monitor, update, or withdraw every copy. The provider can apply access controls centrally, although that does not by itself establish the quality of its safeguards.
How easy is independent scrutiny? Available weights and other artifacts can support examination and adaptation, but visibility into weights alone does not make training reproducible or prove safety. Users may have less access to internals and less ability to reproduce the model independently.

These are tendencies, not guarantees. A hosted provider may share evaluation information, while a downloadable model may come with limited documentation or restrictive terms. Assess the specific release and deployment rather than assuming a label tells you how much oversight exists.

What the evidence says about safety

The reviewed evidence does not establish a general empirical ranking showing that open-weight or closed models produce safer real-world outcomes overall. It supports describing mechanisms and trade-offs, not declaring one release type the safety winner.

Broader access can expand participation, enable local use, and give outside researchers or organizations more opportunity to inspect and adapt a model. It can also make modification or removal of refusal behavior easier. Once copies are distributed, the original developer has less ability to ensure that each copy receives updates, remains monitored, or can be withdrawn.

  • Compact, Connected Design: Includes a 2TB M.2 SSD, 10GbE LAN, Wi-Fi 7, Bluetooth 5.4, USB-C connectivity, and HDMI 2.1b.

Hosted access keeps the model under provider control and can support centralized restrictions and updates. Users, in turn, may have less access to the internals and fewer ways to reproduce the provider’s results independently. Central control is not the same as independently verified safety: the strength of the safeguards and testing still matters.

Capability, intended use, deployment conditions, and the consequences of misuse matter alongside release format. A model’s release status alone cannot establish whether a particular use is safe.

What current model-release figures show

The Stanford AI Index 2026, using model-inventory data credited to Epoch AI, reports these counts for 102 notable AI models in 2025:

Inventory finding Count
Models that used API access 47 of 102
Models without corresponding training code 81 of 102
Models that released training code classified as open source 4 of 102

These are counts from a database of notable models, not a census of all AI models or a measure of safety. The report cautions that categorization is incomplete and totals may not align with other parts of its chapter. It also argues that limited access to training code constrains external reproducibility, auditing, and validation of safety claims. The figures describe access patterns; they do not show that a particular release type caused safer or less safe outcomes.

How to compare models for an organization

Compare the actual release and planned use, then decide what level of control and evidence the risk requires. NIST’s AI Risk Management Framework, released January 26, 2023, and its Generative AI Profile (NIST AI 600-1), released July 26, 2024, offer risk-management guidance for identifying generative-AI risks and selecting actions aligned with an organization’s goals and priorities. They are frameworks, not rulings that open or closed models are safer.

  1. List the available artifacts. Record whether weights, architecture information, inference code, training code, training data, documentation, and evaluation results are available. Distinguish what can be inspected from what can be reproduced.
  2. Read the license for the intended use. Check permissions and restrictions on commercial use, modification, redistribution, and downstream deployment. Do not infer these permissions from the words “open weights.”
  3. Choose the deployment boundary. Decide whether local operation, a hosted service, or API access fits the use case. Consider who operates the model, who can access it, and what controls are available in that environment.
  4. Examine oversight and recovery options. For hosted use, assess provider access controls, update practices, monitoring, and incident response. For local or distributed copies, assess who can apply updates, identify misuse, and respond if safeguards fail; copies outside the organization’s control may persist.
  5. Review capability and evaluation evidence. Ask what capabilities were tested, which scenarios were covered, and whether the evidence applies to the organization’s deployment. Treat published evaluations as bounded evidence rather than a guarantee.
  6. Assess the consequences of failure. The safeguards appropriate for a low-impact internal task may not be sufficient where misuse or incorrect output could cause serious harm. Match the controls and evidence required to that specific risk.

How developers’ safety statements should be read

Developer statements describe their policies or positions; they are not independent evaluation findings. In July 2026, Anthropic said: “Whether open models do or don’t pose an increased risk, and whether that risk can be mitigated, is something that should emerge from testing, rather than be decided in advance.” Anthropic also calls for safety testing of sufficiently capable models in both release categories.

In an October 2, 2026 statement, Meta AI Research described its framework this way: “Our Framework outlines the capabilities we test for, the thresholds a model must clear, and the requirements we place on our safety and security systems, before a training run begins and before a model is deployed.” Such statements can clarify a developer’s stated process, but they do not substitute for evidence about how a particular model performs or how a deployment is managed.
